    The 1st amendment does not protect the mexican flag in a display of conquering the USA
    Atleast I am not ready to concede the USA to the Mexicans.

    I second MOST of your proposition. But I actually like ALL of them, even if I don't necessarily like some of the behavior those rights protect.

    Let's not let a little Constitutional law get in the way of things here. After all, the flag itself is more important than the ideals she stands for.

    (Yes, I'm being sarcastic)

    That having been said, the Mexicans had a right to free speech as covered under the First Amendment. I agree with that statement. However, the right for these bar owners to swing their fists ends where our noses begin.

    Their free speech (hanging a Mexican flag over an American one) in this instance constitutes incitement as surely as if I'd worn a shirt emblazoned with the N-word while walking around Watts.

    Further stretching things in Broussard's defense, his act - in defiance of tacit police and civilian authority approval - was in itself an act of civil disobedience and/or free speech.

    Just my two cents.

    in my opinion flying the mexican flag over the american flag in 2007 is a big deal. flying the canadian flag over the american flag wouldnt be as big of a deal in my opinion. here is why...
    america has 20 million people from hispanic countries who are here illegally breaking our laws. they are now DEMANDING our health care, education, and other benifts and at the same time denouncing our hospitality and claiming to OWN this land as theirs. they dont respect our culture or our traditions.
    canada on the other hand is doing none of that. if it was a canadian flag i would ask the owner to remove it. since it was a mexican flag i would remove it myself and then burn down their store.
    mexicans and hispanics have basically declated war on america and the stated purpose of taking over this land as their own. i dont take kindly to people trying to take over MY country.

    i am openly admitting to engaging in acts of vandalism now in my city. last week i saw a car with a Felipe Calderon sticker and i threw a rock threw its window. i admit it and i support it. Felipe Calderon is an enemey of the united states and anyone who supports him will suffer the consequences. this is just the begging of american fighting back. and i mean FIGHTING. i will no longer ask my politicans. i will no longer demand my politicans. i will act.

    i am prepared for war.

    I'm gonna have to disagree with you. "Incitement" is a pretty tough standard to meet. It has to be pretty harsh expressions to qualify as incitement and to thus fall outside of the realm of protected speech. Even walking around Watts with N ! G G E R on your shirt, while certainly not wise or advisable, is protected speech according to my view and understanding of the 1st. If flag burning is an acceptable expression of a sentiment, I fail to see how this instance would be considered more heinous or less deserving of protection.

    Look, believe it or not, I'm on our guy's side. They were free fly whatever flag they wanted in whatever manner they wished, he was free to do whatever he wished, and they were both free to live with the consequences of their choices. End of story.

    Try to calm down, my friend. You do not want to engage in acts of violence, but rather use the forum members here to act as your sounding board on this matter. Venting our anger is okay as long as we don't go over the edge with it.

    It is not you nor other people like you that should be behind bars, but the politicians and the real criminals in this matter. Even though it seems that our representatives are not listening to us regarding the Third World Invasion and what we expect them to do about it, we have stopped the Amnesty Act & the Dream Act temporarily. This, through the dialogue we have been accustomed to, coupled with the Internet, and phone calls and faxes to elected officials. Hang in there Barking Dog, and please, be calm so we can punish the culprits responsible for this mess another way.

    According to the newspaper the students at a California undocumented alien highschool did the same thing except they compounded things by flying the stars and stripes upside down under the Mexican flag. I understand their pride, but its best expressed on Mexican soil without the comment of "We shall retake California without firing a shot" They must be poor students of history, it was Texas we took, not California. Had I been there I would have gone in and provided the necessary encouragement to the Princibal to go out and correct the situation personally & then call an assembly to explain the benefits of no repeats. Those little smart asses probably got the idea from parental attitudes. Actually with California sliding into the ocean maybe we should give them title to the coastline and two miles in. Might help them maintain their undocumented alien status. Seriously, I don't hate illegals, I understand their motives & in their place I might do it also. What makes me furious is when they stick it in my face and demand just about everything while being mouthy.

    Flag codes are VOLUNTARY. They are only a GUIDE and there is NO PENALTY for violating the flag codes.

    The only person who broke the law here, was the old idiot who cut it down. And you all though he fought for freedom, but infact he is now doing something against freedom, since that bar owner has the right to display the flag like that.

    You are all violating the flag codes all the time anyway. For example any clothe with a flag on it, like a t-shirt with a printed flag on it, is considered a flag, and must therefore also follow the flag codes.

    Flags must not be printed on things for temporary use, like napkins. You all use napkins with american flags all the time, especially on 4th of july.

    So get your facts straight.

    The restaurant owner is purported to be an American Citizen. As such, he had the "right" to do the stupid act. However, free speech is NOT always without consequences. Conversely, reacting to such speech is not always without consequences either.

    In todays climate of the on-going illegal invasion of the USA, reconquista, aztlan and other horsepoop, that invaders flag, flying over old glory, set this US Army vet off and he acted. I personally do not fault him for doing so, I personally applaud his straight forward actions and hope that the idiot restaurant owner does NOT press charges. If he does, I hope the vet gets a sympathetic jury, or a nullification by the jury.

    Enough is enough.
