Rape by the letter of the law... That's true.

But rape by its true meaning... Not a chance! Not when the young man voluntarily arrived at her door. Not when the young man invented excuses to be with her.

Let's not start with the legal age of majority or just where the line is drawn about age of consent. This isn't where the kid emerges from the encounter(s) physically battered and mentally broken for life. Though after Mom gets through he might be.

And just what about a 15 year old girl and a 28 year old man? Do you for a moment think that just because the law says the girl can't legally consent to sex that she can't or won't? Sorry, but I disagree. Fifteen year old girls often know a lot more about sex than boys.

Do you honestly think a normal male has much of a chance when a sexually mature female decides he's the one? If so, then you live in a different world than I do. Males don't fare well when females put on the full court press. I don't care how moral a male is, the chances of his being able to say no are slim at best.

The defining measure here is violence or force. If either is used by one party or the other, then it's most certainly rape! No different for a 15 year old boy or girl. If it's by mutual consent, then there's no actual rape even though the act may be unlawful.

We could go into STD's. We could ask the pregnancy question. We could preach morals. We could discuss the technicalities of law. We could... But these questions weren't asked.

Two people, both who knew better, placed themselves and others in negative situations in exchange for a few minutes of pleasure. As I said before, the sex is probably the least worrisome of all the problems caused by their actions. I'd guess at that level neither hurt the other.

The hurt is at the social and family level. The hurt could well extend to a number of mostly innocent folks who should have never had to deal with a situation like this. This is where a 15 year old boy (or girl) must come to know that should they decide to act as an adult, then they must be ready to face the consequences as an adult.

We've beat the subject nearly to death. We can all observe and pontificate on what should be or could be. We know what the law says. And it's all great theory as long as it remains theory. Human nature being what it is pretty much negates theory and leaves us to decide what the best course will be in dealing with what's happened.

I would be the first to agree that it would have been best has this never happened. I'll also assure you that should it have been that it was my 15 year old (boy or girl) there would have been no "wink" and acceptance on my part.

    Nord,
I agree with every point you made until the last paragraph. Any male on here that would not have jumped at the chance to bump a twenty something women when they were fifteen is, using the strict dictionary definition, queer.

I would ask any prosecuting attorney and jury members to declare that they would not do the same also.
This is where justice leaves law in the dirt.

The point was made earlier but I'll say it again. A man usually reaches sexual peak around 18. A woman, 30. These 2 hormonus beings were on the same plabe at the same time. That is why it is different than if it was the other way around.
    Rape? no.
29 yo man and a 15 yo girl? You better be ready to face the consequences.

Well for cryin' out loud..Of COURSE a kid would jump at it. That isn't the point, or is it? The last I heard the adult was the responsible party legally..Has that changed? What if it was your daughter and a mature male teacher? No, never mind.."That's different..." Pshhh..Kiss my grits..

I think it would be wrong to label any kid a queer for making a concious decision to not have sex regardless of the reason.

WHAT? How can a 28 year-old, supposed mature, woman be fooling around with an inmature 15 year-old boy and NOT be taking advantage of him? She is old enough, and should have enough sense, to realize the difference between right and wrong. As a 15 year-old, I would have nailed anything that came my way and offered. That is just a hormone filled young male. But a 28 year-old woman knows better! Heck yes, she was taking advantage of him!

Negative, he sure as hell knew what he was doing at that age. Trust me from personal experience a guy that age knows what he's doing when he nails a older women.
Sorry, but at 15 your hormones are running your brain. Most 15-year old guys would hump a doorknob given the opportunity.

This is an illegal activity in every state of the Union. It is called statutory rape.

Switch the genders -- 28 year old guy with a 15 year old girl, and you'll understand.

All I can say is if I was 15 and had a shot at a 28 yr old gal it would have been a major turn on for me [8D][8D][:D][8D]

"NOW press charges against the female before child protective services stops to say Hi."

+1, CPS will deal you and your wife a lot of misery if they get involved.

ss39, this is not directed at you and your wife, because it is your son and your right to raise him to your standards.

Otherwise I call BS. Where were these gals when *I* was 15? Molestation? Yeah, right! Not even close! More PC pablum horse manure! Now we have not only femNazis like rosie o'pig and hildabeest pushing their agenda, they have convinced a whole bunch of men to trade their pants for tutus.

    I'm confused. What's the problem?

Short answer: there isn't one. Some young guys get better quality loving from more experienced women than the ones their own age they would otherwise be snuggling in the hay loft or back seat and all of a sudden it's a BFD. Exploitation? HA !! Only to the ugly betty types who couldn't buy a kiss and those who buy into this propaganda.

Yet another example of how the liberal "it takes a village," "we know better than you do" sheep herd mentality has been foisted on this society.

Nord-I think this is where the problem comes in-a 15 year old (male or female) is not presumed to have the "capacity" to make this kind of decision (in the eyes of the law) even though in reality, that may be far from correct. The truth of the matter may be much different-but that is the presumption under law. Other presumptions of criminal sexual conduct occur when the person is an adult but may have a "diminished capacity" ie-mental handicap. Another adult could still be charged with "criminal sexual conduct" for engaging in sexual contact with a diminished capacity person. Both of these situations could be considered "criminal sexual conduct" or rape in the common term-in the eyes of the law. I assure you there are 15 year old girls who very well know what they are doing, but it is still considered "rape" in the eyes of the law. That is why I suggested sharpshooter contact an attorney if he doesn't want his kid drawn into a courtroom. His attorney can advise him and his son what to say (or not say) so that he gets the outcome he is hoping for, not one that will be forced upon him by the legal system.

    Just my opinion...

    GF -

I think that's what we both said in slightly different ways. My instructions to the young man and the young woman would be to keep their mouths shut should authorities try to intervene. It would be lawyer time should this happen. Until then I'd pray that everyone involved had learned a lesson and that none would wish to pursue the matter beyond where it's already gone.

Oddly, the devil in all this may well be the pastor. He's taken advantage of a situation by placing a misguided woman, a young man, a former husband, a policeman, the boy's family, and even his own son in jeopardy. All of this resulting from two people deciding to choose pleasure while ignoring the possible consequences. The defining factor which I'll agree to is that the young man may not yet have the capacity to think these consequences through. (At 15 I believe he did and chose to ignore them.)

Lots of blame to go around, but the true evil here is in the manipulation of the situation. I pity those who follow this preacher as he has no concept of Christ, nor Christianity.

Let's hope this whole situation passes quietly into history and that all involved have learned a lesson in life. In reality we'll be lucky if just the young man and the woman learned something, but we can hope.

sharpshooter039 - You're a bigger man than I am for dropping the charges. I would've got a restraining order against the cop, the preacher and "his" flock. Get me a nice Johnny Cockrain "Ambulance Chaser" to speak for me in the papers. Curious isn't using a car/truck to run over a person still considered "Assult with a Deadly weapon" or attempted something? I'd keep my good eye out for some bible thumpers[:D].

Nothing for nothing like it's been mentioned about bringing her up on charges just to protect your family. She's the "adult" so she should know better. It's sad that her ex did what he did.
