To reauthorize the assault weapons ban, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Assault Weapons Ban and Law Enforcement Protection Act of 2007'.
SEC. 2. REINSTATEMENT FOR 10 YEARS OF REPEALED CRIMINAL PROVISIONS RELATING TO ASSAULT WEAPONS AND LARGE CAPACITY AMMUNITION FEEDING DEVICES.
(a) Reinstatement of Provisions Wholly Repealed- Paragraphs (30) and (31) of section 921(a), subsections (v) and (w) and Appendix A of section 922, and the last 2 sentences of section 923(i) of title 18, United States Code, as in effect just before the repeal made by section 110105(2) of the Violent Crime Control and Law Enforcement Act of 1994, are hereby enacted into law.
(b) Reinstatement of Provisions Partially Repealed- Section 924 of title 18, United States Code, is amended--
(1) in subsection (a)(1), by striking subparagraph (B) and inserting the following:
`(B) knowingly violates subsection (a)(4), (f), (k), (r), (v), or (w) of section 922;'; and
(2) in subsection (c)(1)(B), by striking clause (i) and inserting the following:
`(i) is a short-barreled rifle, short-barreled shotgun, or semiautomatic assault weapon, the person shall be sentenced to a term of imprisonment of not less than 10 years; or'.
SEC. 3. DEFINITIONS.
(a) In General- Section 921(a)(30) of title 18, United States Code, as added by section 2(a) of this Act, is amended to read as follows:
`(30) The term `semiautomatic assault weapon' means any of the following:
`(A) The following rifles or copies or duplicates thereof:
`(i) AK, AKM, AKS, AK-47, AK-74, ARM, MAK90, Misr, NHM 90, NHM 91, SA 85, SA 93, VEPR;
`(ii) AR-10;
`(iii) AR-15, Bushmaster XM15, Armalite M15, or Olympic Arms PCR;
`(iv) AR70;
`(v) Calico Liberty;
`(vi) Dragunov SVD Sniper Rifle or Dragunov SVU;
`(vii) Fabrique National FN/FAL, FN/LAR, or FNC;
`(viii) Hi-Point Carbine;
`(ix) HK-91, HK-93, HK-94, or HK-PSG-1;
`(x) Kel-Tec Sub Rifle;
`(xi) M1 Carbine;
`(xii) Saiga;
`(xiii) SAR-8, SAR-4800;
`(xiv) SKS with detachable magazine;
`(xv) SLG 95;
`(xvi) SLR 95 or 96;
`(xvii) Steyr AUG;
`(xviii) Sturm, Ruger Mini-14;
`(xix) Tavor;
`(xx) Thompson 1927, Thompson M1, or Thompson 1927 Commando; or
`(xxi) Uzi, Galil and Uzi Sporter, Galil Sporter, or Galil Sniper Rifle (Galatz).
`(B) The following pistols or copies or duplicates thereof:
`(i) Calico M-110;
`(ii) MAC-10, MAC-11, or MPA3;
`(iii) Olympic Arms OA;
`(iv) TEC-9, TEC-DC9, TEC-22 Scorpion, or AB-10; or
`(v) Uzi.
`(C) The following shotguns or copies or duplicates thereof:
`(i) Armscor 30 BG;
`(ii) SPAS 12 or LAW 12;
`(iii) Striker 12; or
`(iv) Streetsweeper.
`(D) A semiautomatic rifle that has an ability to accept a detachable magazine, and that has--
`(i) a folding or telescoping stock;
`(ii) a threaded barrel;
`(iii) a pistol grip;
`(iv) a forward grip; or
`(v) a barrel shroud.
`(E)(i) Except as provided in clause (ii), a semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
`(ii) Clause (i) shall not apply to an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.
`(F) A semiautomatic pistol that has the ability to accept a detachable magazine, and has--
`(i) a second pistol grip;
`(ii) a threaded barrel;
`(iii) a barrel shroud; or
`(iv) the capacity to accept a detachable magazine at a location outside of the pistol grip.
`(G) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.
`(H) A semiautomatic shotgun that has--
`(i) a folding or telescoping stock;
`(ii) a pistol grip;
`(iii) the ability to accept a detachable magazine; or
`(iv) a fixed magazine capacity of more than 5 rounds.
`(I) A shotgun with a revolving cylinder.
`(J) A frame or receiver that is identical to, or based substantially on the frame or receiver of, a firearm described in any of subparagraphs (A) through (I) or (L).
`(K) A conversion kit.
`(L) A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. In making the determination, there shall be a rebuttable presumption that a firearm procured for use by the United States military or any Federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.'.
(b) Related Definitions- Section 921(a) of such title is amended by adding at the end the following:
`(36) Barrel Shroud- The term `barrel shroud' means a shroud that is attached to, or partially or completely encircles, the barrel of a firearm so that the shroud protects the user of the firearm from heat generated by the barrel, but does not include a slide that encloses the barrel, and does not include an extension of the stock along the bottom of the barrel which does not encircle or substantially encircle the barrel.
`(37) Conversion Kit- The term `conversion kit' means any part or combination of parts designed and intended for use in converting a firearm into a semiautomatic assault weapon, and any combination of parts from which a semiautomatic assault weapon can be assembled if the parts are in the possession or under the control of a person.
`(38) Detachable Magazine- The term `detachable magazine' means an ammunition feeding device that can readily be inserted into a firearm.
`(39) Fixed Magazine- The term `fixed magazine' means an ammunition feeding device contained in, or permanently attached to, a firearm.
`(40) Folding or Telescoping Stock- The term `folding or telescoping stock' means a stock that folds, telescopes, or otherwise operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of a firearm.
`(41) Forward Grip- The term `forward grip' means a grip located forward of the trigger that functions as a pistol grip.
`(42) Pistol Grip- The term `pistol grip' means a grip, a thumbhole stock, or any other characteristic that can function as a grip.
`(43) Threaded Barrel- The term `threaded barrel' means a feature or characteristic that is designed in such a manner to allow for the attachment of a firearm as defined in section 5845(a) of the National Firearms Act (26 U.S.C. 5845(a)).'.
SEC. 4. GRANDFATHER PROVISION.
Section 922(v)(2) of title 18, United States Code, as added by section 2(a) of this Act, is amended--
(1) by inserting `(A)' after `(2)'; and
(2) by adding after and below the end the following:
`(B) Paragraph (1) shall not apply to any firearm the possession or transfer of which would (but for this subparagraph) be unlawful by reason of this subsection, and which is otherwise lawfully possessed on the date of the enactment of this subparagraph.'.
SEC. 5. REPEAL OF CERTAIN EXEMPTIONS.
Section 922(v)(3) of title 18, United States Code, as added by section 2(a) of this Act, is amended by striking `(3)' and all that follows through the 1st sentence and inserting the following:
`(3) Paragraph (1) shall not apply to any firearm that--
`(A) is manually operated by bolt, pump, level, or slide action;
`(B) has been rendered permanently inoperable; or
`(C) is an antique firearm.'.
SEC. 6. REQUIRING BACKGROUND CHECKS FOR THE TRANSFER OF LAWFULLY POSSESSED SEMIAUTOMATIC ASSAULT WEAPONS.
Section 922(v) of title 18, United States Code, as added by section 2(a) of this Act, is amended by adding at the end the following:
`(5) It shall be unlawful for any person to transfer a semiautomatic assault weapon to which paragraph (1) does not apply, except through--
`(A) a licensed dealer, and for purposes of subsection (t) in the case of such a transfer, the weapon shall be considered to be transferred from the business inventory of the licensed dealer and the dealer shall be considered to be the transferor; or
`(B) a State or local law enforcement agency if the transfer is made in accordance with the procedures provided for in subsection (t) of this section and section 923(g).
`(6) The Attorney General shall establish and maintain, in a timely manner, a record of the make, model, and date of manufacture of any semiautomatic assault weapon which the Attorney General is made aware has been used in relation to a crime under Federal or State law, and the nature and circumstances of the crime involved, including the outcome of relevant criminal investigations and proceedings. The Attorney General shall annually submit the record to the Congress and make the record available to the general public.'.
SEC. 7. STRENGTHENING THE BAN ON THE POSSESSION OR TRANSFER OF A LARGE CAPACITY AMMUNITION FEEDING DEVICE.
(a) Ban on Transfer of Semiautomatic Assault Weapon With Large Capacity Ammunition Feeding Device-
(1) IN GENERAL- Section 922 of title 18, United States Code, is amended by inserting after subsection (y) the following:
`(z) It shall be unlawful for any person to transfer any assault weapon with a large capacity ammunition feeding device.'.
(2) PENALTIES- Section 924(a) of such title is amended by adding at the end the following:
`(8) Whoever knowingly violates section 922(z) shall be fined under this title, imprisoned not more than 10 years, or both.'.
(b) Certification Requirement-
(1) IN GENERAL- Section 922(w) of such title, as added by section 2(a) of this Act, is amended--
(A) in paragraph (3)--
(i) by adding `or' at the end of subparagraph (B); and
(ii) by striking subparagraph (C) and redesignating subparagraph (D) as subparagraph (C); and
(B) by striking paragraph (4) and inserting the following:
`(4) It shall be unlawful for a licensed manufacturer, licensed importer, or licensed dealer who transfers a large capacity ammunition feeding device that was manufactured on or before the date of the enactment of this subsection, to fail to certify to the Attorney General before the end of the 60-day period that begins with the date of the transfer, in accordance with regulations prescribed by the Attorney General, that the device was manufactured on or before the date of the enactment of this subsection.'.
(2) PENALTIES- Section 924(a) of such title, as amended by subsection (a)(2) of this section, is amended by adding at the end the following:
`(9) Whoever knowingly violates section 922(w)(4) shall be fined under this title, imprisoned not more than 5 years, or both.'.
SEC. 8. UNLAWFUL WEAPONS TRANSFERS TO JUVENILES.
Section 922(x) of title 18, United States Code, is amended--
(1) in paragraph (1)--
(A) in subparagraph (B), by striking the period and inserting a semicolon; and
(B) by adding at the end the following:
`(C) a semiautomatic assault weapon; or
`(D) a large capacity ammunition feeding device.'; and
(2) in paragraph (2)--
(A) in subparagraph (B), by striking the period and inserting a semicolon; and
(B) by adding at the end the following:
`(C) a semiautomatic assault weapon; or
`(D) a large capacity ammunition feeding device.'.
SEC. 9. BAN ON IMPORTATION OF LARGE CAPACITY AMMUNITION FEEDING DEVICE.
(a) In General- Section 922(w) of title 18, United States Code, as added by section 2(a) of this Act, is amended--
(1) in paragraph (1), by striking `(1) Except as provided in paragraph (2)' and inserting `(1)(A) Except as provided in subparagraph (B)';
(2) in paragraph (2), by striking `(2) Paragraph (1)' and inserting `(B) Subparagraph (A)'; and
(3) by inserting before paragraph (3) the following:
`(2) It shall be unlawful for any person to import or bring into the United States a large capacity ammunition feeding device.'.
(b) Conforming Amendment- Section 921(a)(31)(A) of such title, as added by section 2(a) of this Act, is amended by striking `manufactured after the date of enactment of the Violent Crime Control and Law Enforcement Act of 1994'.

Well this is what I'm curious about. I see all these marchs on Washington for rediculous causes. Why haven't I ever seen any public demonstration in mass for gun rights? Where would be the vocal point to bring a large amount of people together on the same day(s) regarding gun rights? We need to mobilize and flex. There are many of us out there. 0 -
I have no doubt the bill will make it through the house, but it will not be so easy to get it through the senate where the dems are only a slim majority. It will still take 60 votes to pass it and if the minority leader can keep enough of the republicans from voting for it then they don't have the numbers and the whole bill is just an ominous warning of what is to come in a few more months. 0 -
I'll tell you after last weekend with the Zumbo deal, you look and see that if we stick together we can get it done. It amazed me how fast we firearm enthusiast stuck together, hit it hard, and made a change. Now this is what we need to do to Washington. One way or another we need to make gun owners across America understand what the second amendment is about. There are too many of us who say "what about the nut job down the street?", or " it won't effect me." Those are the folks who need to be educated on the 2nd Amendment.
We've shown our power this weekend, now We need to do the same at the polls and get rid of those who are out to destroy Our Constitution. We need to get rid of career politicians who fill their own pockets, and elect people who are actually for the people.
We need more than ever to break up the 2 party system. I am a registered republican, but I have been watching at how republicans and the good old boys from the big corporations seem to rub elbows too much. There are too many American workers who have suffered because of corporations and I hate them. I hate NAFTA or any free trade agreement that let's American corporations move their companies out of country for the cheap labor. If it were up to me I would tear up any free trade agreements and charge one hell of a tariff to bring that non American garbage back into the country.
I dislike Democrats for one simple reason. Their Communist. If you could see what east Germany looked like before the wall came down, you would agree. There isn't any difference in way they were living and what Democrats want today here in this country.
If it took a Million Pro Gun march on Washington, I'm there! But timing and sponsorship would have to be there, and I don't think that the NRA would be a good sponsor, because they act too much like the politicians already in power.
We've proved we can make a difference this last weekend, I am all for Organizing and letting our elected officials know how we stand

Did you expect something different from a man coming from Texas that actively promoted illegal immigration..to do anything but encourage illegal immigration when he took the highest office ? Was the bill introduced by a republican? Was the last one? We will never escape laws. The soccer moms and the extreme antis will never go away. You have to look at it realistically. All we can hope for is middle ground, so everyone has some level of satisfaction. Even though that's an impossible task because the democrats always want more. We had all the laws we needed on the books, years ago. There should be no discussion over gun laws at all any more.
Everybody needs to realize we're at the middle ground right now. We don't have real freedom like we're supposed to already. Many people don't realize this and that's what's dangerous. No matter what guns people prefer, we're all on the same team.0 -

I feel gun owners are lacking the exposure that other special interest groups get. We don't make our voice be heard enough. People think of NRA, not normal citzens hitting he streets and protesting our dang rights.
Another lacking I see that we could fix is reaching out. Take people out shooting with you that haven't had exposure. I have turned a bunch of my wifes female friends around on their idea of guns. There are now 6 women in my wifes salon that conceal carry daily. Gun owners aren't reaching out enough and letting people that have had no exposure to responsible shooting/hunting/gun owners see they are nothing to be afraid of. Each person counts.
My wifes friend was scared to death to even TOUCH one of my guns. She wouldn't even touch it at first until some other women grabbed it like it was no big deal. I took her shooting and now we are going to be shopping for a gun for her next weekend.
We can change peoples mind if we just expose them. I have never had a person totatly new to shooting, go shooting with me and not have a fun time and change their minds on if they should be banned or not.0 -
We, gunowners, can be our own worst enemy. By not sticking together on issues, all issues affecting any type of gun. Look our the "G-banners" divide and conquer. I know many hard core hunters who did not object to the AWB because they never hunted with those types of firearms and didn't mind them being banned. Same with the 50 BMG guys in California. Many gun owners in California could give a bababooey less about the "Big Sniper Guns" being banned, 'cause they didn't own one and never planned to. We must stick together even if they decide to ban all WWII Liberator pistols from ownership! I mean how many folks could that effect anyway? We all know that when they ban even one type, ie, machine guns in '86; they will not stop at the next one on the list. The only reason this thread has so many responses is because the topic bill listed just about every gin made, and it hit home with us all. We got to be willing to write, call, raise H*ll about EVERY Infringement on Gunner's rights...Not just the ones that apply to us.
And yes ladies, education is the Key. One of my wife's friends was afraid to hold my wife's .357 she keeps in her beauty shop because she was "afraid she might shoot somebody!" I quickly let her know that a pistol does not have the ability to control one's mind,(except when it comes to spending $$$ at a gun show) and it would not MAKE her go on a killing spree.
Education starts with our families.
Let your children's teachers know that shooting is one of your kid's favorite sports; and p*ss on you if you haven't made it one. My son got a BB gun when he was 5, a shotgun at 8, a .22 at 10, and his own AR-15 M4 at 12. An AK followed the next year. he is now 15 years old and out shoot most of the guys on our county sherrif's SRT team. (Really, he goes shooting with them about once a month.) Just bought him a Glock 35 at age of 15 for competetion. And when we go camping or to the river fishing, he carries it openly when with me.
And I don't have to worry about him screwing with drugs, beer, or committing any robberies lately. He has not shot a single one of his friends, because he was TAUGHT gun safety along with the gifts. His friends have asked him could they take them off the wall (not locked up) in his room and he tells them No...your finger prints will make 'em rust! Plus "my dad will beat your butt if you take them down". But he can tear down an AK, AR15, FAL, CETME, and most any other firearm or pistol in our household. And repeatedly checks "Clear" before taking a firearm back into the house, even after checking it before putting it in the car to come home from shooting. Now my we have custody of our two grandchildren, and my four year old grandaughter is wanting a BB gun for her next birthday. She will get one. And we will have another generation coming who will be willing to stand up for their 2nd amendment rights.
But as for Right Now! How to handle the current ban proposals?? RAISE Hell! 'Cause the wheel that squeaks loudest will get the grease. Scream loud at hard at any politician you can, especially those running for president, then go out and vote against those who support ANY kind of further gun control. In fact look for one who will repeal some of the cr@p we have to deal with now.

I think that's a good idea. this is a very important issue, and like you said there are a lot of people who do take it seriously. enough to say "forget about work" just get in their car and drive to DC and demonstrate. who cares about anything else. I bet more ppl would show up than for anything else at any time. and what would it accomplish? it wouldn't change the anti's minds, nothing will lets be realistic, this is about who can make who do what.
it would remind them how many votes they're losingit would show them that we do care enough to do something about itit would prove to them that we are capable of doing something about itit would bolster the pro-gun politicians' efforts to do something about itin short, we have to prove to them 4 things:

capable

Youre right on that one...The dollar is what determines the vote of all politicians. We have to figure out how we as gunowners can hit the Politicians in the Pocketbook when they vote "anti-gun." The days of someone sticking up for their ideals or values are long gone when it comes to government. So take $$$ away from them...by letting them know "en Masse" that they will not get our vote. One thing that comes to mind is getting active in a grassroots organization locally. Writing and calling poly's to let them know how we want them to vote, and then let them know we will NOT vote for them if they go the other way. Cute Little Ol' John Edwards was a senator here in NC when the ruling to do away with petty-*ss lawsuits against the gun industry was coming before the senate. I wrote him and let him know that me, my gunclub and all the members of our range, wanted him to vote to pass that legislation. His office wrote back and gave some stoopid answers as to why they felt this legislation was wrong and they would have to vote against it. I then sent him another letter back, expressing "gunowners all over NC" (made it look like it was more than just me.) would definitely NOT be voting for him in the next election. And now thank God he's gone.
Rep. Mike McIntrye on the other hand is a Pro-Gun democrat. Big time gun lover and hunter... He voted for the law, and we wrote him to express our content and the fact that we were well pleased with him to go against the normal Democratic way of being anti-gun. Remind them also that their voting records are public and they are being checked by you and all other gunlovers.
A group of gun folks here in Fayetteville are now currently drafting a letter to our Chief Law Enforcement officer, Sheriff Moose Butler, asking him to start approving and signing off on Class III transfers. Right now he won't do it because he got pissed off at some colonel out at Ft Bragg who went over his head trying to get a machine gun signoff. We are going to let him know that as law abiding gun collectors, the federal laws allow us to own MG's, and that he is not allowing us to enjoy that right. And if he doesn't we will do all we can thru news ads, supporting other candidates, and put all our money into making sure he does not get elected for another term. Straight and to the point, but in his pocketbook.. Thats how they listen.

I believe all is done that can be done in the political process..that corruption is so deeply entrenched in Washington and the state capitals that there is no hope of regaining anything from them.

You know, I think you are right...the "righteous" have turned into the "self-righteous"; seeking their own way, and the ways of those who want the little American to play to their wishes. I do fully expect to see a major attempt at a complete ban within the next 10 years or so. With more and more Republicans taking up the case too, simply because there isn't enough money in it for them. The organizations like Soros has; along with many others, is more than willing to pay thru the nose to disarm America. And they can afford it. I have an uncle who worked with CIA for his entire career. He said one of the major contradictions to a Russian attack on US soil during the cold war was the fact that they knew so many private citizens owned guns and had no way of calculating that factor into their battle plans. Now without a "cold" war, and with so called "primitive" methods of the terrorist vs. our awesome technology. The US military planners no longer see a need for the citizen to be armed, in fact it stands in the way of some of the government's plans toward totalitarianism. Thats one reason the United Nations approach toward world disarmament was bally-hooed by so many "Westerners" as the way to get rid of crime. Bullsh+t. They are no more worried about crime as I am looking for Polar Bear repellent here in North Carolina. They want "subjects", not citizens.
But until the big Fall of our current system of government, I will continue to be a Squeakin' Wheel. Unless of course the Driver of the Cart decides to "replace" instead of "grease" this ol' wheel. But I'll worry about that one when they decide to come and get 'em. Daddy always taught me not to lie...but then again, Daddy never had to deal with the current Government as we have it. This weekend on my days off I'm going to compose a letter for our congressmen. I already have 13 folks willing to sign the letter in their name. I'll provide the letter, stamps, and envolopes for these folks. I'll be looking for more people also that I know. There is going to be alot of letters to send off shortly. [:)]

If EVERY gun owner would do such as that, it would create some notice... problem is getting people off their butts and doing something. The Great (but not Late) Jesse Helms was a buddy's with one of my friend's dad. We had the chance to sit and talk with Mr. Helms from time to time when he was at their home. He told us that the one thing that every Senator would most often listen too, were the letters that came into their offices. They had someone who reported to them each week, the number of letters about a particular agenda. The reason he said, was that for every letter that was written, there were a thousand who felt the same way, but just wouldn't take the time to write. Now I seriously doubt there are many in the Senate now with the Integrity of Mr. Helms, but it might help.
I had some friends out at a local range I frequent, and they were griping about this subject too. I asked them all how many had written their US representatives about it. Got a bunch of blank stares... Hell most of them didn't even know who their congressman was. I told them then don't say a d*mn word when it gets passed then. If they ain't willing to fight for it, then it must not be worth griping about. And I don't want to hear the whining when they lose some more rights... 'Cause I won't give mine up.0
