Sellers are responsible for complying with applicable federal, state, and local tax requirements. However, for transactions subject to Marketplace Facilitator sales tax requirements, GunBroker calculates the applicable sales tax and remits it to the appropriate taxing authority on the seller's behalf.
Marketplace Facilitator Sales Tax
Most states require online marketplaces such as GunBroker to collect and remit applicable sales tax under Marketplace Facilitator laws.
For these transactions, GunBroker calculates the applicable sales tax and adds it to the Order Total Payable.
Because GunBroker does not accept payment from buyers on behalf of sellers, the seller collects the full Order Total Payable directly from the buyer, including any sales tax calculated by GunBroker.
The transaction generally works as follows:
Buyer → Seller → GunBroker → Applicable Taxing Authority
- GunBroker calculates the applicable sales tax and adds it to the Order Total Payable.
- The buyer pays the seller the full Order Total Payable, including the sales tax.
- GunBroker collects the sales tax amount from the seller through the seller's GunBroker account.
- GunBroker remits the tax to the appropriate taxing authority.
Sellers should not separately remit Marketplace Facilitator sales tax that GunBroker is responsible for remitting.

Sales Tax Not Collected by GunBroker
For transactions where GunBroker is not required to collect and remit Marketplace Facilitator sales tax, the seller may still have an independent obligation to collect and remit applicable state or local sales tax.
Tax requirements vary by jurisdiction. Sellers are responsible for determining whether additional tax obligations apply to their business or transactions.
Buyer Tax Exemptions
Buyers who qualify for a sales tax exemption must submit the appropriate documentation to GunBroker for review and approval.
When an applicable exemption has been approved on the buyer's account, GunBroker will apply the exemption when calculating sales tax on qualifying transactions.
Sellers should use the sales tax amount calculated by GunBroker for the order rather than independently modifying the Marketplace Facilitator tax calculation.
