Hit by a cop tonight at Kroger-- need your advice!
On my way home tonight, I stopped at Krogers to fill up for a long trip tomorrow. I have a little car with a 12 gallon tank and it was about a quarter full. I've never put more than 11 gallons in it but tonight it went beyond 12, it went beyond 13, it went almost to 14 gallons. I stopped it because I knew something was wrong. So I go over to the window and tell the 2 kids there is a problem. The one tells me "that's not possible." I tell them they need to get somebody out here now, but they just laugh and say "that'll be $39.00." After some more words on my part and more laughter on their part, I give them a fifty, they give me back a one. I ask for my ten and they say I gave them two twenties. Again, I ask for a manager, and they laugh. So I part the car and go in the store and ask for a manager. After 20 minutes some jerk shows up and says "what d' ya' want?" I explain the situation to him and his says "not possible. The pumps are controlled by the county and our people don't make mistakes. Gimme' your name and if the draw is over I'll send it to you." I say, like right, how many times your drawers been over? He says, "never." I say "doesn't surprise me, you worthless piece of trash." At which he laughs and tells me to leave before he has me thrown off the property. I ask to see the cop, manager refuses. I walk to car, cop shows up. I start walking toward cop. He rushes at me, pushes me and then takes out baton and hits me on shoulder. I crumple to the ground. Cop laughs and tells me to "get the ... away before I arrest you." Right now I'm at home, but I can't feel my fingers on my right hand (sorry about the typing) my arm is numb and I can't move my shoulder. I think that I'm off to the hospital, put what else should I do? Of course, an entire parking lot full of people, but no witnesses. I tried to call an ambulance from the parking lot but don't have a cell phone and they wouldn't let me use the pay phone. Help!

I would have to interview all involved then investigate before I could comment either way. Thats really the only fair thing to do. 0 -
Maybe after you ask for advice you could check back in and acknowledge some of the comments? Oh, wait...the troll meter is pegged! 0 -

As PennyPincher said - call an attorney.
And might I suggest Bondai & Bondai? This firm specializes in matters of police bullying and brutality, especially when inflicted with second-growth hickory. Bondai & Bondai recently won a $1 million settlement for motorist who while being cited for speeding had a Wolf City police officer drop Krispy-Kreme crumbs on her new Lexus. The cop is on suspension, and relief of his Internet discussion board moderation sideline is pending. Give them a call.

You guys sure this fellow isn't talking about a "rent a cop", as oppossed to a real LEO?
What would the deal be about asking to see "the cop",........does Kroger, have its own personal LEO, on duty 24/7?
I'll lay odds it was a store ninja, if it happened that way at all!0 -
Why was everyone laughing? The two clerks were laughing, the manager was laughing, the cop was laughing? If you were seriously complaining, I dont think anyone would be laughing. 0 -
I dont know you so I cant attest to your honor or truthfulness. Some of what I read is possible.I mean gas stations do tamper with pumps, some cops have been known to get out of hand.BUT the way it was described sounds like some BULLCHAT to me.I mean its just to much going wrong at one time.Your either the most unlucky individual I have seen or the only person to run across the filling station mafia with paid police protection. If its true than my apologies but I just cant buy what your selling right now. 0 -
"sounds like BS. Cop charged you and hit you for no reason? Something is most definately missing."
I agree. There is another side, or two, to this story.0 -

Advise 101,
Check the attitude at the door and no one will call the police to begin with. I'm sure he was told you were threatening someone, and when you walked up on him he reacted.
Doesn't make it right if your story is 100% accurate, but I would like to hear the other side before I made that assumption.
Attitude, anger and loud voices usually lead to bad things. Keep cool, and a cop will have reasonable doubt that you are a threat or a problem. Get ballistic, and they assume you ARE the problem.
Cops are human, and they must make a decision in a split second. I would do the same as a citizen. Walk up on me angry or hot and bothered, and you're not going to like my reaction either.
Also, I like to be the one to call the cops if needed. It's usually the wronged party who makes the call, not the party in the wrong.0 -

If it would have been me, I would have reached up and pulled off his nads and fed them to the laughing jerks behind the counter. But that is the way I handle adversity. Don0 -

+ 1 I'm glad I'm not alone in that one... [}:)][:p]0 -
Most of what happened was a response to your attitude and demeanor.
Like it or not, it wouldn't have happened to most of the GB members.
We have gray hair, we dress in an acceptable/conventional manner, We drive clean, neat, non-radical vehicles, we don't have offensively cranked up stereos in our rigs, we don't scream at gas jockeys, we don't yell at or act aggressive with policemen or service station employees, we mostly don't curse those people either - at least where they can hear us.
IF what you say actually occurred, I'd bet you missed at least one of the preceding behaviors/criteria.
I would pay good money to see the security tapes.
Why don't you tell us the name and location of the place and the date and time of the occurrence. Maybe, together, we can get you some money, or at least an apology from them.

I hope to hell you got a receipt for the gas.
I hope you get a lawyer before your keyboard cools from typing your story.
I hope you call the Shift Commander and request a visit to the site of the ATTACK upon your person with lawyer present.
.
I hope you do not look like you fell into a nail bin at a hardware store and have more tats than skin left.
I hope your children were not tramuatized by this.
I think you need to file assault charges on the cop.
I hope to hell if it is true the cop that attacked you and did not arrest you goes to jail for a hell of a long time.
Are you sure there is nothing you have left out?
Call Bondai; he loves to help!0 -

With all due respect to the law enforcement pros on this list:
There are some people who believe there are no crooks who own businesses.
There are also some people who believe there are no crooked cops.
I know better from personal experience, on both counts, and it sounds like you ran into both. I ran into a rogue cop in '89 when some idiot speeding around a curve ran into me. I got charged, I politely asked the cop some questions about the accident scene, and he got mouthy. I politely excused myself, turned to walk away to my car, and he got more mouthy, yelling across the road at me that I didn't respect the law, threatening me "Don't get disorderly on me" and daring me to answer. He was a rogue cop.
Yes, the screening procedures may be better than they were back then, but they are still not perfect -- even with everyone doing their best, there are a few rogues, smart alecks and just plain crooks who slip through the cracks and manage to get hired on the force. Having said that, I have to agree with the guys here who say you screwed up when you let those 3 goad you into losing your cool. Any time you lose you cool with crooks, rogues, or smart alecks, you have LOST, because they are sitting and waiting for exactly that to happen so they can strike. I know a little about the criminal personality, and that's how it works -- you gave 4 predators an excuse to jack you around. The burden of proof is now on you to prove (1) you did not instigate it when you lost your cool, and (2) you got set on by 4 predators. I also respectfully agree with the guys here who said take the fight back to them through civil channels -- I firmly believe that all crooks, rogues, and smart alecks who manage to slip through the cracks and get hired onto the force are a huge LIABILITY to everyone - especially to their colleagues in uniform. If you brought it on yourself, like some members here opined, that will come out in the process too. Do you know how to document? Get as much concrete detail down on paper, NOW, while it's still fresh on your mind - including which way the wind was blowing and what song was playing on your car radio. When people document facts, the BS shows up for what it truly is. When people fail to document, though, the BS sounds good in court and BS rules the day.
Since my bad experience in '89, I've worked with a lot of cops and ex-cops, and found 99.9% of them to be great people and totally trustworthy, who put up with a lot of junk and keep their poise. But they also need to realize that any losers on the force reflect badly on them.
Best of luck.0 -

I think you are dead wrong on both statements. I believe EVERYONE here knows there are bad cops and crooks in business. But, the other thing everyone here knows is, most stories like this (at least 98%) are lies and we would want to hear the other side or see the video tape before we accepted a one sided line of BS.0 -
Telling a store manager "doesn't surprise me, you worthless piece of trash" is asking for trouble, but it's no justification to get beaten to a pulp. That's just my opinion - but I'm new, you're the moderator, that makes you the boss. 0 -

That's assuming he's telling us everything. I think we're only getting one side, and not the whole truth.
If his story is square with the facts, the cops should be fired. My experience is these guys slant the truth to make them look good, and the cop look bad.
Being a moderator has no weight on opinion or anything else around here. In fact, it's usually a good reason to get beat up on.[;)]
By the way, welcome to the zoo. Hope you'll stick around.0 -
dheffley,
I agree with you, based on my experience, most stories that grab at the gut are incomplete, and it is a fact that most of the "nasty-cop-beat-me-up" stories I've heard turned out to be B.S. I've seen cops trying hard to keep some guy flying on drugs from hurting himself while they're restraining him, but those stories don't make the headlines. On the other hand, it's also been my experience that guys who are working hard at trying to sell a big fish story do not usually include unflattering details like this fellow's admitting to telling the store owner, "doesn't surprise me, you worthless piece of trash." I could be wrong, but I've spent a lot of time on the job sorting out truth from fiction in stories a lot like this one, and once in a while they do turn out to be true. This one rings true to me, based on my experience -- but obviously I could be wrong.
Thanks for the welcome, dheffley. I'll probably stick around for a while --- it's a fun zoo, and I like the way you and Nunn keep a firm hand on the moderator's tiller.0 -

Dont know if there are any video cameras in the area, but they may be able to help get to the bottom of this if there were.
Keep in mind we are only hearing one side of this story. Of course drsck is not going to say anything that would put himself in a bad light.
I would take the advice already given, call an attorney, and if need be, file a complaint with the ofcrs agency.
Not to say your being dishonest drsck, but people have been known to tell stories about mistreatment only to later be proved by videos, audio tape or witnesses to be lying.
If what you say actually happened to you the way you say it happened, then you may have a case. Again CONTACT AN ATTORNEY.0 -
