Hit by a cop tonight at Kroger-- need your advice!
On my way home tonight, I stopped at Krogers to fill up for a long trip tomorrow. I have a little car with a 12 gallon tank and it was about a quarter full. I've never put more than 11 gallons in it but tonight it went beyond 12, it went beyond 13, it went almost to 14 gallons. I stopped it because I knew something was wrong. So I go over to the window and tell the 2 kids there is a problem. The one tells me "that's not possible." I tell them they need to get somebody out here now, but they just laugh and say "that'll be $39.00." After some more words on my part and more laughter on their part, I give them a fifty, they give me back a one. I ask for my ten and they say I gave them two twenties. Again, I ask for a manager, and they laugh. So I part the car and go in the store and ask for a manager. After 20 minutes some jerk shows up and says "what d' ya' want?" I explain the situation to him and his says "not possible. The pumps are controlled by the county and our people don't make mistakes. Gimme' your name and if the draw is over I'll send it to you." I say, like right, how many times your drawers been over? He says, "never." I say "doesn't surprise me, you worthless piece of trash." At which he laughs and tells me to leave before he has me thrown off the property. I ask to see the cop, manager refuses. I walk to car, cop shows up. I start walking toward cop. He rushes at me, pushes me and then takes out baton and hits me on shoulder. I crumple to the ground. Cop laughs and tells me to "get the ... away before I arrest you." Right now I'm at home, but I can't feel my fingers on my right hand (sorry about the typing) my arm is numb and I can't move my shoulder. I think that I'm off to the hospital, put what else should I do? Of course, an entire parking lot full of people, but no witnesses. I tried to call an ambulance from the parking lot but don't have a cell phone and they wouldn't let me use the pay phone. Help!

Use of a baton is a serious level of force. In the Coast Guard, we use a 6-level use of force continuum, and the baton is Level 5, just below deadly force.
If you have reason to use a baton on someone, then you darn sure better be making an arrest afterwards, as the subject surely had to be doing something wothy of a charge.
As mentioned, time to seek legal advice. Document everything. If there is any bruising, get pictures. Go to the ER and have your injuries documented.0 -

Since its a gas station, you may be in luck....
Most have a decent camara system, since it helps to deter "drive offs"0 -

IMNSHO both the kids running the booth, the manager, and the cop need an AGM-65 up the arse, unfortunately the feds don't get involved in such "petty squabbles"0 -

Weve had a few places we went to and the same thing happenned to us with our 12 gallon hyundai and one time it didnt shut off on us until it hit 15 gallons and no gas was spilled on the ground. This was in Arizona by the way If its not a mom and pop type gas station get ahold of corporate and file a complaint with the gas company (thats what we did) They sent someone out right away and indeed the pumps were indeed off on thier calibration of how much gas was actually being dispensed as compared to the total gas you were charged for. 0 -

Contact the District Attorney's office for your county. They'll open an investigation on the officer and the incident. 0 -

I doubt a gas station would risk the twenty years in prison for tampering with a Weights and Measures calibrated pump. I suppose it is possible that there are people that stupid. It seems unlikely that a cop would whack someone with a night stick without trying to determine what was ging on first. I suppose there are cops that stupid. The odds of a gas station manager being that stupid at the same time and place as a cop that stupid just stretches the bounds of all reason. Could be something happened there before you arrived that set all this in motion. Only way to get to the bottom of it is to press charges against the gas station for ripping you off[I hope you saved the gas reciept showing your 12 gallon tank took over 14 gallons] and press charges against the cop for police brutality[go to the Doctor and have pictures of the bruising taken]. 0 -

My Truck holds 24 gal. I usually fill up when the low fuel light comes on and it takes 21.5-22 gal. Just the other day, the same thing happened to me MINUS the night stick. I fill up and BINGO.. it reads 29 gallon and some change.. I pay and go on. NO problem, OH I forgot to mention the 2.5 gallon gas can along with the 5 gallon gas can I filled up. My SUV has a 20 gallon tank, but if I run it to fumes it'll take 22 gallons to fill it to the top. The fill tube is sometimes long enough to hold over a gallon and the fuel lines can hold a good bit depending on tank location and engine location. 0 -

Were you yelling and freaking out on the employees? Did you walk toward the cop in a threatening manner? Did you lose your composure? Unless it is on video, It's pretty much your word against the cop. If you were not charged with resisting arrest or any other crime, you may have a shot at a lawsuit. I am not a cop but I have a degree in Criminal Justice. We were taught rule #1 cover your a@@. If you had to use any kind of force, you always charge them with resisting arrest. There are always two sides to every story. If you are telling the truth and can convince a jury you are telling the truth $$$$$$$$$$$$.
