LARGO, Fla. (AP) - A Florida homeowners group wants three-year-old Kimberly Broffman to take her Big Wheel and hit the road.
They've banded together to oust the toddler from their Tampa-area community, which bans residents under 18.
The child's grandparents admit Kimberly's been living there in violation of homeowners' association rules for three years. They say her mother has a drug problem, and isn't capable of caring for the child.
The grandparents say they live on a fixed income and can't afford to move until they sell their house. They lowered the price months ago, but still haven't found a buyer.
They also say they can't afford to hire an attorney.
The Lakes homeowners association filed suit to oust Kimberly last month

I can see both sides of the situation....the house is up for sale, they are trying to go by the rules...give them a break...
The home owners assoc feels that if one is allowed to stay any longer then more will probably come and that is not wanted I guess...
So let the courts decide?....seems a freaking waste of money and time...

I can see both sides of the situation....the house is up for sale, they are trying to go by the rules...give them a break...

...if someone CHOOSES to live in one of these "controlled" communties, and AGREE and SIGN the HOA agreement, they should abide by what they agreed to...may not be right, but they agreed to it...now they need to go out and watch the grass grow, grease the bearings on their wheel chair, play shuffle board or boca ball...[^]

Interesting to see how some feel the laws should be enforced to the fullest during time of family crisis, absolutely no leniency. Of course if it applied to them they would be screaming the loudest of course! IF the HOA had given them three years and then enforced no biggie obviously if you can't sell the house in three years too bad lower the price. On the other hand since it appears the HOA is just now identifing the problem it would be prudent for them to wait and let the people sell and leave. I can't believe some hard asses want to throw them out in the street for doing the right thing by their grandchild. And the statement that the grandparents are not fit to raise kids due to their daughters failure is the most assinine thing I've ever read. I know of several situations where families raised thier children the same and had two turn out fine and one screw up blaming the parents without knowing anything about them just proves to me once more why we have two completely different views from the public on everything and most of the time only one makes sense. You let them stay within reason, and then the HOA makes a offer or the family can default. Either way It seems to me a few of you could have used a hug when you were younger 0 -

If I were the Grandparent and my Grandchild needed me for protection. I swear to God, that's exactly what I would do. Yes I would try and sell. But until I did.. there would be protection!!!

Also typical of a double standard. If someone tried to set up a development for Under 55 they would end up in a discrimination suit in a heartbeat. I hope I don't turn into an a$$ like that when I get old.

Well Rules are rules, but is the rule legal. I used to work with a man who rented to a couple who got divorced and the man moved out (hmmm). The woman was unemployed! She couldn't pay the rent. So he issued an eviction notice. She in turn appealed the notice stating that there was a child involved and she simply didn't have the funds to move. So there she stayed for another 18 months while the rest of us payed for her to finish school. My friend who bought the place for a rental investment was him self laid off and was over taxed with his own bills and forced sell his own house while she sit there paying nothing because he couldn't find a buyer for the house with her in it.... I asked why he didn't just tell the bank that he couldn't move because children were involved? Turns out that only landlords can be put one the spot not Banks... Now That is fair!!!! Now there is also a nice little kick in the butt for my buddie. Turns out the the father in the case was a very thoughtful father. He would come over every day while and babysit while his ex went to school 10-12 hrs a day... Supposedly the experience brought the couple back together and they were remarried shortly after she graduated school. So this story does have a happy ending. Just not for my buddy and of course the taxpayers who paid the bill for a year and a half.

"Rules" are not "Laws". The VAST majority of HOA "Rules" will NOT stand up in court. This one would NEVER win in court.
The parents should tell the HOA to shove it up their collective Azzes!0 -

Try to find a house anywhere in Northern Virginia that does not have an HOA. They are few and far between, and the ones that do exist cost too much, since they are all on acreage. So if you want to live somewhere around here and not drive clear to West Virginia, you are stuck with HOAs.0 -
Interesting. Where I live and it is probably a city ordnance even in a 55 and older designated area a certain percentage of the residents can be under age. Otherwise if a 60 year old guy married a 25 year old gal she could not move in. 0 -
The Grandparents probably moved there for the same reason all the other residents did. Because they didn't want to deal with a bunch of kids. They have violated this agreement now for THREE YEARS.
Anyone who has a home on the market that long has it overpriced.
The one to blame here is not the Grandparents, who are trying to do the honoroable thing, or the HOA, who are trying to uphold their rules, and maintain their property values.
The blame lies with the daughter who is too busy taking drugs to raise her own child.

Mommy gets loaded and has a good time while Grand Pa and Ma care for her child and piss off all their neighbors.
If the grandparents are serious about leaving a community with HOA rules restricting children and the real estate market is having a problem as Black Roses stated, then they should consider a trade. They could trade their restricted property with "very high property tax and very high insurance" in Florida for a non restricted "very high property tax and very high insurance" in Florida. Both have the same problem and hopefully some old geezer in a non restricted community is craving a restricted community to get away from the brats. I wonder why some commission hungry real estate agent hasn't done this already.0 -

Mexican children are not American citizens, so none of this applies to them. I'm talking about an American child who's living against the rules, but the grandparents are trying to sell out to conform to the rules. I think the HOA should be forced to allow them time to sell.
By law, if I let someone move in with me and they establish my home as a residence, I have to go to court and have them evicted, I can't just make them leave. And, a judge may give them months to find another residence if he thinks I'm out of line. I think the HOA should have to follow the same rules, and if the grandparents are trying to sell, they should be given an acceptable time to do it before being evicted.
Mexicans? Your not another one who wants to give them protection under the constitution when they are here illegally are you? Same for terrorist? Same for enemy combatants? Where does it end?
Lot's of HOA's are being busted in court because some of there rules violate the bill of rights. Private agreements cannot violate the BOR or we would have slavery again.0 -

I have found that HOA's have alot of power and usually end up winning. I personally would NEVER live under them but I did when I lived with my parents. I hate them. I wonder though if the family can get protection under the fair housing act which bars discrimination for reasons of race, gender, religion, age and so forth. 0 -

Yea I bet that as a 6 mo old baby she was riding that bigwheel around making all that damn clacking noise then at 1 she was chalking up the shuffleboard court for hopscotch, at the ripe old age of say two she was probably a real terror heck walking around the Mobile home park singing stupid Barney songs and such, see now if those damn grandparents had kept that little poop in line we would not be having an issue. Hell next thing you know one of those old farts might have a Hospice Nurse living in with them, what is the world coming too!0 -
I lived in one of those "Deed Restricted" HOA run communities for 9 years, Never did I get a copy of any bylaws, They had a tendency to make up their rules as they went along, even down to telling people what color to paint their houses.. Law says you have to have a security fence around your pool, I put one up and they tried to make me take it down. They said it Blocked the view, yea right. When quoted the law about swimming pool security they tucked their tails between their legs and the incident was forgoten.
If they want them out so bad, buy their place, simple..I guess they want them to just abandon their home.0 -

I guess you missed the part where I said the Grandparents were trying to do the honorable thing, and that the blame lies with the drugged up daughter. Still, I think the HOA has a valid point, and three years is more than enough time to comply with the rules, one way or another.
I don't live in an area that is governed by restrictive rules because I want to make my own choices about what I do with my home. Other people live in regulated communities because they don't want to live in an area where they may be exposed to conditions that they don't like.
The Grandparents chose to live in a regulated community. Either play by the rules, or find a new game.

Laws without compassion suck.Rules without compassion are even worse. If you move into a place that does not allow children, knowing that you have children thats not right. Having children move in with you two or three years after you have moved, that has to be different. Most renters have more rights then people that move into a HOA. HOA's have to have exceptions. An HOA has to be able to buy you out at fair market value, or give you three years to sell. 0 -
Living in an HOA with scads of rules and regulations, I mulled over an answer to this dilemna and here's what I came up with. It has to do with those annoying tenets of Christainity, i.e. compassion, kindness, understanding, forgiveness, etc. that so many folks are so quick to toss out in a conversation as it suits them.
