The story in a nutshell....

Grandparents have custody of 3 year old in a 55 and older community...Home owners assoc told them the girl had to go or they have to...
House is up for sale (has been since last year)...HOA wants the girl gone NOW!!!...

Florida community sues to remove child

LARGO, Fla. (AP) - A Florida homeowners group wants three-year-old Kimberly Broffman to take her Big Wheel and hit the road.

They've banded together to oust the toddler from their Tampa-area community, which bans residents under 18.

The child's grandparents admit Kimberly's been living there in violation of homeowners' association rules for three years. They say her mother has a drug problem, and isn't capable of caring for the child.

The grandparents say they live on a fixed income and can't afford to move until they sell their house. They lowered the price months ago, but still haven't found a buyer.

They also say they can't afford to hire an attorney.

The Lakes homeowners association filed suit to oust Kimberly last month

My comment...

I can see both sides of the situation....the house is up for sale, they are trying to go by the rules...give them a break...

The home owners assoc feels that if one is allowed to stay any longer then more will probably come and that is not wanted I guess...

So let the courts decide?....seems a freaking waste of money and time...

    Every homeowners association sends you their rules and regulations before you even move into the house, insist that you sign indicating that you have read and understand these rules and then mail it back to the association. No kids means no kids and it should come as no surprise to grammie and gramps that the neighbors want Kimberly OUT.

    Everyone has an excuse.. Can't they read and do what they agreed to. Who the heck do they think they are " Special " and the rules do not apply to them. I hope the homeowners association sues their socks off, takes their home and lets them live in a box.

    check bilaws on visitation of children, maybe child can bounce to a friends house and back until house is sold?

    You are incorrect in saying that EVERY HOA does this. I have bought 3 houses, all in HOAs, and I never saw the bylaws until weeks after settlement. As for this case, the same thing happened about 10 years ago when I lived in AZ. The child's parents were killed in a car crash and the child went to live with the grandparents in a 55+ community. HOA tried to sue them to thrown them out. HOA lost big time. As it should have.

    Amazing.....a homeowners association has the power to evict a 3 year old child from a residence.

    If the H.A banned inter-racial couples or gay men from living in their community ACLU lawyers would be coming out of the woodwork to sue.....

    I agree. Most HOA board members are just little Nazis on power trips. One of the HOA presidents we had told everyone he was a big shot at the Saudi Embassy. Well, I happen to know people there and I checked. He is a janitor.

    Next thing you know Gramps and Grandma will have a daycare with 12 screamin' brats to supplement their poor income. OR one of the other HOA people will put a huge boat in the driveway,.. clearly knowing NO boats are allowed. They are only leaving it there till it sells...

    well i guess crotchedy old people SELECT where to live !and i am sure some ex lawyer,attorney,politian or other useless person is running the association because they need to be in charge of something. and i'm sure none have broken a law ever!you can't select you're neihbors unless you're on the board of an appartment building in manhatten!good luck.

    I'm sorry the little girls parents were killed. Even though it is a circumstance that was not controlled by the grandparents it put them in a bind out of their control. No doubt the HOA will not feel bad doing what they need to do. I run into similar situation in the rental business. Things change in life and people move on. Judge would give the grandparents time to sell the home or put the child in another relatives possession. IF the grandparents are not capable of taking care of the little one on their income the courts will find someone who will.

    Have the HOA buy them out at the lowest possible price would be the best outcome.

    Next best would be to adopt the little girl out to a good family. The grandparents are probably not fit to raise her. After all, their daughter is a POS.

    None of this is the HOA's fault.

    sorry? this is my last reply tonight, but blame the builder! because he sold the house to the homeowner?apparently the association could not fund the building on their own,so they just choose to rule it!why wouldn't they just live somewhere else? because they would have no one to rule over! sound familiar?

    The only homeowners association I've ever been a member of was the Green Run Homes Association in Virginia Beach. I didn't even know the place was run by an association until I went to closing. They drop a lot of things on you at closing thinking you won't bother to read that stack of paper before you sign it. Surprises at closing piss me off, but I did sit there an read the whole package. Two lawyers, one real estate agent, two secretaries, and one wife were getting more irritated by the minute, and the more irritated they got, the slower I read.

    Bottom line is I did read and understand the bylaws and signed them anyway. Since I agreed to them I was bound by them. These folks signed the agreement. If they signed them without knowing what they were agreeing to, that just means they were careless. They are bound by the bylaws.

    If the lawyer is stupid enough to show you the contract two or three weeks after closing, that's his problem. Just simply say "I don't agree to that." End of story.

    Sounds like a pretty undesirable senior settlement, if the grandparents are having a hard time finding a buyer.

    HOA could realize that they are running a crappy outfit, and are now entertaining a public relations nightmare, and back down.

    They probably won't, though.

    Grandma and Grandpa screwed up. They bought into a piece of crap, disguised as "dignified senior living." Let it be a lesson to us all as we get older. NEVER GIVE UP ANYTHING!

    I am darn glad that I live where there are no HOA Nazis, no ordinances, no building codes, no deed restrictions, no covenants. If I want to test fire a gun in my yard, I do it. Actually, I do it quite a lot. If I see a neighbor outside as I am preparing to fire, I holler over a warning, but that's all the concession I intend to make.

    I will not live in a city. I will not put up with a HOA or any other restrictive bullcrap. I will not have a landlord.

    Change the rules in the middle of the game? Danny, how do you feel about the immigration laws that will force small Mexican children back into Mexico? They are here illegally just like that little girl in Florida.

    David...

    There are thousands of houses for sale in Florida and its NOT because they are undesirable....its because of very high property tax and very high insurance..Most are paying more for tax and insurance than what they are paying for the mortgage....

    For the record, yes they signed the agreement but it was well before the girl came to live with them....and they are very willing to move, they just need more time to sell the place they are in...

    I feel for them, but they did sign a binding agreement ... I don't know where to draw the line but 3 years seems like the HOA was working with them.

    Maybe this publicity will inspire Realtors to help them out by giving the property a push again.

    Around here when a property has been on the market for an extended period, Realtors start walking around it and not showing it.

    laws are guidelines. even men in a military formation cant walk a perfect line in parade without one step out of time or a wandering column every so often. guidelines are reference points to allow people to gauge themselves andto make course adjustments. grace and mercy should be the rule for special considerations. thats what honest judges and courts are paid to do....interpret and administer properly. it really works when its done right. sad in most cases, it doesnt.
    if the gramps set out to do the crime with forknowledge, that would be unexcusable and the hoa would be right. but it appears they are trying to protect an innocent child from harm. hoa should pass mercy and allow them to continue. im sure a comprimise could be struck where the big wheel must stay in the back yard etc.. afterall, rules for neighborhoods for 55 and up are designed to eliminate dangers associated with older folks driving, walking hazards, etc... putting children into an environment where these hazards for younger children increases, is actually endangering children. so, hoa's do have a good purpose in setting guidelines. [;)]
    i mean serious, would you go tell your kids to go play in the road where 80 year blind and deaf drivers all drive every day? think it out.[;)]
