Hypothetical Question Here, Dont Get In a Tizzy
Okay. So a person I know lives in California. He wants to purchase a weapon in Minnesota that is illegal in California. He then wants a person he knows in Minnesota to ship it to him in California on the down-low. What do you think of this idea ? Plausable ?

sure it can happen but I would not want to be either of the people. 0 -
Despite the fact that California laws are wonky, this person chose to live there, as such, agrees to abide by said laws.
When someone breaks a law concerning gun ownership, it puts a black eye on all gun owners, because when the media catch wind of it, they make it headline news. It then becomes more fodder to pass more and more gun laws.
If your friend wants this weapon, he should move to a state where it isn't illegal to own it.0 -
Won't work! The FFL guy in Calif. has an approved list he can receive from - if it's not approved in Calif. - no deal![8D] 0 -
if the weapon was shipped with other items, how likely would it be that the shipping company or anyone would know whats inside ? i heard they dont scan the packages with x-rays so they would never know a gun was inside. also, even if they knew a gun was inside they wouldnt know if the gun was illegal or not. 0 -

Take your contact phone number, you might need it for your one phone call.0 -
It would be pretty easy to do only I would break the gun down and send a few packages over time but I dont know of any gun fun enough to risk time in jail. It would only take that one wrong fella to see it[xx(]. 0 -

Yeeeeah, that's what I thought.[:o)][:o)][:o)]
As long as the Feds don't catch you - no problem - however, IF, they DO ... I hear Leavenworth is beautiful in the Spring![:o)]
... and who knows - being the 'cell block beech' ... well ... I guess that's a personal preference issue![:D][:D][:D]0 -

This idea just goes from bad to worse!
Now your not only talking about breaking state laws but federal laws too ... as gagirl said:quote:Originally posted by gagirl

There is a Constitutional right to ignore laws that are unconstitutional. It can take a lifetime to get the law declared unconstitutional. The Supreme Court may also decide to not hear your case; or rule against you.
There is also the right of the jury to determine if the law you are accused of breaking is a just law when judging the innocence or guilt of the accused.
It would seem waiting in jail for the years required to apply either of the two options is a sucker bet.
Fight like hell to change the law; or move.
Your Gub'Ment wants to control and tax you; if you do not comply they will jail you for your insolence.0 -

Yep - and be willing to "Do your time for your crime!"
Every year some yahoos declare the tax laws unconstitutional ... and serve their time.
... just depends what you want to do with your time. Me? I like my summers![:D]0 -
Plausible but illegal. highly illegal. don't try it. 0 -
The good news is you will get free room and board out if the deal also. [:p] [}:)] [;)]
Tell him to move.0 -
ship it to Mexico and smuggle it across the border, can't get in trouble that way [:D] 0 -
Actually, you don't have to 'smuggle it across' anymore - just chase away the National Guard troops and BRING it on across with your drug shipment![:D][:D][:D]
Have a great day, Gents! Off to play![8D]0 -
Granted it can be done, what is the point? If you can't live in Brazil the rest of your life without lifting a finger the crime just ain't worth it. If you want to live dangerously play on the train track, that'll give you a thrill. 0 -
The post office and ups do not xray their packages. You probably could ship this gun 9 times in a row and get away with it.
But the tenth time, the package breaks open. Interstate shipment= Federal crimes. A couple of guys are going to jail for a long time.0 -
Can you say " Hi, I'm Bubba the axe murderer's new girlfriend, you can call me Susan" If its illigal dont do it. Its not worth it to do the time. 0 -

if an illegal alien carries it across the border they will just give him a drivers license and a 3 year tax break.....oh, and give his kid free health care and college tuition0 -

Even if it was possible, where would you shoot it? I had several firearms that became illegal when I lived in Kalifornia. My choice was to register them (a wait for the subsequent confiscation by the libs) or move. I got out of there... 0 -
Nothing is worth the cost this deal might cause both individuals involved. Kali would love nothing more than to make an example some
dufus trying to pull this off.........0 -

Gun shipments get damaged all the time. You don't want to explain why your shipment of used dvds turned into an AR-15. 0 -
at this current point in time there isn't a gun out there worth going to jail for, there are many that are cal legal 0 -
True ... and AFTER you get out you can take up archery - guns will be OUTTA THERE
at least for you and your buddy ex-felon)![8D]0 -
I'm sure it happens all the time but it's illegal. An out of state buyer can't buy from a private party. An FFL selling to an out of state buyer must observe the buyer's home state laws. Both as per federal law. Bringing a banned gun into CA violates CA state law.
Why go all the way to MN? I'm sure the parking lots at AZ, NV and OR gun shows are full of cars with CA plates. That's the problem with insane gun laws; they can be circumvented and they turn otherwise lawful people into criminals as they try to exercise their Constitutional rights.0
