C&R sale denied by seller

    Notify ATF or the Federal Trade Commission that you contractually purchased a firearm on GB with your FFL and the seller whom is a FFL holder refused transfer.

    The Federal Govt. controls State Commerce and someone is trying to restrict the Federal Govts. authority.

    Technically you could take the seller to US District Court/ or file a complaint the the Trade Commission under Title 15 US Code (Commerce), Chapter 1, Section 2....."Monopolizing a trade". $1 Million fine, 10 years in prison.

    Under Section 6 and 11 that property is to be seized and becomes US property.

    Section 15 explains how to take him to Federal District Court.

    Make an example out of 'em.

    I just got another e-mail from the seller. He says he will ship rimfire guns to C&R holders but NOT centerfire guns! That is TOTAL BS!!! [}:)]

    Yeah, but it may be ignorance too. If you really want that gun why not show him the C&R list, or ask his reasons. It may be a guy that want to sell and you can show him that you are the top buyer (maybe only).

    There's no point in trying to educate him as he is obviously not receptive to either logic or law. Maybe he'll regret it when he sees how many bids he's missed. It's one thing to have a policy against accepting a C&R altogether but to "pick and choose" the type of firearm that qualifies for C&R is ridiculous. The ATF has already established those requirements. I don't even want the damned gun now.

    Your call, and he certainly seems to be an interesting guy. I have had some luck educating good guy dealers a little short on C&R knowledge and have acquired some nice Woodsman along the way, so it is worth remembering for next time.

    I've also had this problem...seems to me that some FFL01s are
    either mentally challenged or have an elitist complex.

    That's fine w/me....they just won't get my business.

    One would expect that as a licensee he is bound by ALL the provisions
    of the governing laws and regulations binding him by his license. He cannot pick and choose customers any more than a cabbie can refuse to pick up a Negro passenger.
    This issue should be pressed with BATF and maybe the NRA.

    That is not the dealers problem. Accepting a bogus C&R that appears to be legit is not a crime. The crime is committed by the one who attempts to pass the bogus C&R.
