Life is full of opportunities for poor decisions. Spending time in jail for fighting is what I would call a poor decision.

I see to it that they don't get into my face. Something like that is not inevitable and is therefore avoidable.

    Exactly
Almost totally avaoidable. If someone is in your face there is a reason they are there. Stop giving them a reason to be there.

I guess it depends where my face is. If it's on the street, I've learned to walk away. If it's in my home or office, I give them several chances to leave before I escort them to the door. I don't get so many people in my face that I can't simply remove myself from the situation. So long as they don't try to lay a hand on me.
I look at it this way; if I'm at a party and drugs are being used, I can leave the party rather than try to talk people out of using drugs. If somebody wants to start an argument, it's easier to un-ass that particular AO than to try to educate them.
I learned a very hard lesson that to push somebody away who is merely screaming at you is "harrassment" on your part, in the state of Colorado. Personally, I think it's ridiculous, but I'd rather live in Colorado than nearly anywhere else, so them's the laws, I just abide by them.

I would start by not yelling in someones face. Yelling in someones face will only escelate the problem.

Actually, and this will surprise some here, if someone even violates the personal space around your body, that is a type of assault in most places and the police can get involved. In regards to personally dealing with it, when someone actually tries to get into your literal face, turn sideways while still facing that person. That action alone will give you some space. If you need to, you can plant your foot, the one between you and him, and step away with the other foot. This will give you even more space. You can even place your crooked elbow in the space between you and him. All this will usually give you enough space that the attacker will not actually be able to "get into your face".

That is the passive part. If you want the agressive part read some good, but simple, martial arts books. Your attacker has a lot of soft body tissue that you can quickly and easily effect that will force them to back off. Way off. And it can be done with little movement and no lasting injury or damage so they can not call the police on you. Or if they do, it will just be their word against yours which is what you already have anyway.

by law here in SC, your both equally guilty if you both hit on or the other, doesnt matter who punched first, just by taking a swing at someone after they swung at you and both go to jail. its lame you should have the right to defend yourself

A very interesting question! I spent two years as an anger management counselor. Yep, people came to us for anger and domestic abuse issues, and about 90% of the people in the classes were court ordered.

All sorts of interesting situations had landed them there, and there was almost always a big difference between why they said they were there and why the court said they were there.

But to get to the question, if someone gets "in your face" you don't have a right to hit them. Sorry, but you don't. If you're driving a Mustang and somebody at a stoplight says a Mustang is a POS, you don't have a right to hit them. Sorry, but you don't. If someone is rude to you in a bar or cuts in front of you in line, you don't have a right to hit them. You can CHOOSE to hit them, but it's your CHOICE and you'll have to live with the consequences of it.

And you know what's funny, VERY, VERY rarely over the two years I did the program did I have some regular joe who truly got pushed into a corner and popped somebody. In fact, I can think of two over the two years. Sure, everybody's story was that they were just minding their own business and something happened to them, but then you read the file and find out that in fact they've been arrested a couple times before, and that they've got a drinking problem, and that they got fired from work for cursing at a customer, and on the night of this latest offense they were drunk and arguing with the wife, and on and on. I had one guy sit there and tell me for 18 weeks how he was totally innocent, how this was all a big misunderstanding, and how his 2 year old broke her legs totally by accident and that all the previous hospital visits were from falling down the stairs and bumping into coffee tables and so forth. That guy sure didn't pass the course.

So, you can always choose to hit that rude, annoying jerk or the guy who cut you off in traffic or the clerk who crushed your potato chips when bagging your groceries. Just don't be surprised when the police show up and the judge doesn't accept crushed potato chips as a valid defense for assault and battery.

If you'd ever seen my face, you'd know that I can turn people to stone with just one look (the Medusa effect). It's a good thing that my wife is blind.

I try not to put myself in any situation that may result in my hurting someone, as per my training. I'm pretty mellow, so it's hard for someone to actually piss me off enough to cause a physical confrontation. That said, usually about the time they poke me in the chest or lay a hand on me, I'm usually able to make they leave me alone. About the time my face turns purple and I roar like a lion, they usually run away [:D]

what do you do when someone gets in your face?

if you tell them to get out of your face and they don't, can you physically remove them from your face?

if they just stand there in your face and won't go away, is that some kind of assault they can get charged for? and what good is it if it's your word against theirs?

if you push them away, and then you get in a fight, is it (whiny granny voice) all your fault? or isn't it their fault for starting something in the first place?

The Wisdom Of The Ancients says, basically, clock the f8**ker. anytime after that, in an ensuing fight, when he makes a move towards you, you usually have the advantage in applying some Ancient Ass Kicking Technique. but when you both get hauled into court afterwards the judge usually doesn't agree with that.

plus, I'm frustrated because it's always been my experience that it's all my fault. that's right. somebody walks down the street and insults me, if I clobber him, I get in trouble. on the other hand, if I walk down the street and insult somebody and they clobber me, it's all my fault. so, I need to know what "the right thing to do" is if/when somebody gets in my face to keep it from being "all your fault".

another thing is, what do you do when you're about to get in a fight, and the dude is holding a pen? you know he's going to use it as a (potentially deadly) weapon. but in the bloody aftermath (yours or his), you know he's going to say "pen? what pen? that ain't my pen" or "so I was holding a pen, so what" or the pen simply disappears. what do you do when that scenario is about to happen?

yes, I have had all of the above happen to me. not lately. I've always wondered about it.

busch: If you have not been injured financially or thrown in jail, it would seem to me that you have handled the situations you have encountered in the past rather well. On the other hand, if you have, indeed, been judged the guilty-party, or if these type situations continue to happen in your life, then you might want to adjust your habits so as to have a more peaceful existence.

Some people lead sheltered lives, and I'm not knocking that, or the way they conduct themselves, while others go to where rough men dwell. A piece of advice given to me by one of my uncles when I told him I was off to join the Marines, was for me to "Remember who you are, and stand up if you're ever called out". Once people get to know you and your values, they tend to respect and accept you. I passed that same piece of advice on to my son, too, since it paid good dividends for me. Good luck to you.

    1) Put on "that" face
    2) Fart out loud.
    3) Say in a clear loud voice "Was that you?"
    4) Walk away holding your nose.
    5) Make your escape muttering "Jeeze"

I'd laugh and tell them what an idiot I think they are.
