    A chargeback is not a legal victory. If you rented the equipment you owe the rental company regardless of your dispute over whether or not the card number should have been written on the contract. Depending on the contract terms, the rental company may be within its rights to 1) put a lien on your property if the rented equipment was used to improve real estate, 2) put this on your credit report if the contract included a personal guarantee, 3) file suit against you for the full amount due plus any fees or costs of collection including lawyer's fees, or 4) in some states file this as a criminal action for "theft of services" with the local magistrate court.

    It would probably be smart to write the credit card company and withdraw the chargeback.

    Regarding credit card numbers on receipts - handwritten or imprinted receipts are not subject to card number truncation laws. Only ELECTRONIC - meaning card wipe or ATM terminals - are covered by these laws. See below:

    Visa Account Number Truncation Requirements

    Effective July 1, 2003, for all new terminals, Visa USA mandates that all but the last four digits of the cardholder account number, and the entire expiration date, be suppressed on the cardholder copy of all transaction receipts generated from electronic (including cardholder-activated) terminals.

    Effective July 1, 2006, for all existing terminals, Visa USA mandates that all but the last four digits of the cardholder account number, and the entire expiration date, be suppressed on the cardholder copy of all transaction receipts generated from electronic (including cardholder-activated) terminals.

    MasterCard Account Number Truncation Requirements

    Effective April 1, 2005 MasterCard requires all cardholder receipts generated by newly installed, replaced, or relocated ATM and point-of-interaction (POI) terminals, whether attended or unattended, must reflect only the last four digits of the primary account number (PAN). Fill characters that are neither blank spaces nor numeric characters, such as X, *, or #, must replace all preceding digits.

    Federal Account Number Truncation Requirements

    On December 4, 2003, President Bush approved a federal law which preempts existing state laws requiring truncation of account numbers on customer receipts, thereby creating a uniform national standard. This legislation, called the Fair and Accurate Credit Transactions Act of 2003, provides (among many other things) that "no person accepting credit cards or debit cards for the transaction of business shall print more than the last 5 digits of the card number or the expiration date upon any receipt provided to the cardholder at the point of sale or transaction. The law governs electronically printed receipts and does not apply to transactions in which the sole means of recording the credit or debit card account number is by handwriting or by an imprint.

    United Rental violated my privacy by giving my full CC number, security code, and expiration date on the receipt, then giving it to a third party ( driver ) and then another third party ( contractor ). I will gladfully hope they sue me or do something to my credit. I will sue their socks off for wrongfully violating Federal Law by truncation of the CC number on a receipt. I have notified the Federal Trade Commission of their wrongdoing. They have already admitted it was wrong of them to do this and I got the wrong copy of the receipt. Lets play ball.. Visa has already said they are turning them in also. This sale went thru a electronic swipe on the computer. IF I were in the wrong the Visa people would not have credited the account. The contract was not signed by me or initialed by me for use of my card. BTW in order for a lien to be installed on a property a judgement would have to be won in court.

    It takes a civil suit for a lien to be PERFECTED. Filing a lien requires only a quick trip to the clerk of court and a small filing fee.

    Since the rental agency "violated your privacy" why not burn their building down, or form a posse and hang the offenders? Fact of the matter is that their clerical mistake does not justify you ripping them off and no judge is going to take your side. Vigilante justice is unacceptable in our legal / criminal system.

    I was raised to understand that two wrongs don't make a right. They screwed up and you reported them to everyone who will listen. That is one matter. The second matter is that you rented a forklift, used the forklift, and you should pay for the forklift as agreed. That is what I would do, then I would never use their services again.

    If you are terrified of identity theft, call your card company, kill that card, and have them send you a new one.
    I have done it before, and it was no big thing,......I presume you have more than one card to get you through the 5 to 7 day wait.
    Stupid mistake, and I don't blame you for bringing them to task on that, but using it as an excuse to rip someone off, is not right in my book.
    But then I don't have multiple "collector" Corvettes.
    Maybe I have something to learn.

    i wish i didn't have to pay for something every time someone got mouthy, power company, insurance company, cable company, and my mortgage company would never see a dime

    i have done a few charge backs, each i got the money back soon but the case was not closed for 90 days if i received what you did my bank would not allow it, and take the money back, it is not their place to "punish" the companies foul up

    where you harmed?, did you loose anything?

    You guys are full of yourselves. CC company wouldn't delete this charge if the Rental company didn't do something wrong. Rental company even admitted their mistake. But I guess it is ok for some of you to go to the bank and have the teller give the party behind you your deposit ticket and pin number to your account. No problem. I guess some of you need to publish your CC number online so all could see along with all your security information. Look here administration why doesn't Gunbroker just publish all the CC numbers , security codes and ID's of the members. Why that wouldn't be wrong would it? They violated my rights of privacy. A small penalty to pay for a mistake. BTW I repeat again, I DID NOT sign the contract or initial use of this card.

    BTW, the new card was issued about 8 hours later.... after I was given the rental agreement from the contractor. Let's see.. the delivery boy, three workers and the contractor had access to my information. Visa said charges were made the day of the rental besides the rental itself. Hummm... I wonder who? This card has a 30K dollar limit. So, Visa will get to find out who charged up my stolen ID that United Rental gave out to strangers. Now just think if I had not read the agreement that night or didn't read it at all. Imagine getting your bill with a whole bunch of charges ( up to 30k dollars on it ) Just think about that for a few minutes.

    NO lien can be filed on any property that can be applied to a property without a court hearing. NO problem.. IN SC this would be called a claim and delivery for a hearing. Two opposing parties argue to the Magistrate their case.

    Sure,.....you got a chargeback because of the violation of policy.
    Still does not change the fact that you rented a machine for a set amount of money.
    You have a new card, and unless your card was with Bank of Dillsmacks, you are held harmless for any false charges.
    Make a deal with the folks for a reduced amount, to make up for your time.
