Man Accused Of Shooting Alleged Sacramento Car Thief
SACRAMENTO, Calif. - A south Sacramento man who told police he was defending his property was arrested early Wednesday after shooting a teenager who was allegedly trying to steal his car, authorities said. Police said 42-year-old Sou Saechin told them he accidentally shot the teen at about 3 a.m. on Rock Creek Way.
But officials said Saechin went too far in trying to protect his red Honda.
"What we try to stress to people is that deadly force, the use of a firearm, is never justified under any circumstances to protect property," said Sgt. Matt Young of the Sacramento Police Department.
Police said Saechin came outside of his home armed with a .22-caliber rifle and confronted three alleged burglars.
Saechin fired one shot, hitting one of the alleged burglars in the chest. The three fled the scene, police said.
Saechin's wife said her husband was not trying to kill anyone but only wanted to warn the robbers.
Saechin was taken to jail on suspicion of assault with a deadly weapon. Bail was set at $30,000.
The injured teenager was taken to Kaiser Permanente Medical Center for treatment and is expected to survive. Police said they are looking for two other people who were involved in the attempted theft. The men were described as Asian and between 18 and 20 years old.

I think it's completely justifiable. If it happened more often people would think before commiting crime. No one is punished. They get a smack on the hand and go on their way.

You can't go shooting people that steal from u unless they are in the house. then if there is a "make my day law" shoot'em.. I sure as hell ain't going outside to possibly get shot at. they can have the car thats what insurance is for. 0 -

Just about all states require that there be a clear and present danger to yourself or others to justify using deadly force. You may not shoot someone who is stealing your car. You may want to (I do), but legally you cannot.
In fact, many states require you to try to run away before using force when threatened or attacked. My state requires this and the legislature just turned down a "stand your ground bill" to change this law.
I do not run away from violent criminals. I believe it is every citizen's DUTY to kill violent criminals on the spot and I don't give a damn WHAT the legislature says.0 -

I'm liking the castle doctrine that just got signed in Texas. Someone comes in your house all bets are off. That is the way it should be. I think the guy should get off for defending his property, hell he worked hard for it why should someone else just be able to come and take it and you not be able to do something to stop them in the act. 0 -
The poor guy is toast. The perp (and his family, neighbors and anyone who ever knew him) will sue him into the poorhouse. Not right.

by the name of the victim, Im guessing he must be a Southeast Asian immigrant, probably Mien or Hmong from Laos or Thailand?
and the thieves were also probably Hmong or Laotian or possibly Viet?
South Sacramento is mostly blacks and southeast asians living in that area0 -

Asian gang members.......he caught the one trying to steal the car....he didn't see the other two.......when they came into view, one reached inside his coat like he was going for a gun and got shot. This guy has been hit 4-5 times already. 5 cars a week are stolen in that area.
Radio talk show host Tom Sullivan bailed him out yesterday when he found out the perp was in the hospital "without charges", and Sou was in jail. It's going to be interesting what the D.A. does with this case, it won't be easy to bury with Sullivan all over it.0 -

It's worse than that Monkey. After you let them cart everything off because it's illegal to stop them, you file a police report. The police file the report because they don't have time to investigate petty crime. There was a time when stealing a car was a serious crime, but now it's in the same category as taking a pack of gum from the corner store. On paper it's still a serious crime, but I've heard several police spokesmen call it "petty crime", and say they just don't have time to deal with it. 0 -

I've known people who lost out of work because of they didn't have a car. Sou Saechin may have relied upon that vehicle for his livelihood.
And even if he didn't, how many of us can afford to just, in effect, give our car away?
If you're so wealthy that you can afford to just hand them out to any scumbag who wants one, please, by all means, publish your name and address with the message "I will not defend my property" plastered right underneath it.

how many people can afford to give their life away over property ? how many people can afford to take the life of someone over property ? america is a very wealthy nation and we have more cars than people.
also, its not morally acceptable to kill over property. a humans life is always worth more than a car. also, there is a thing called auto insurance.0 -

If people knew they would be legally shot/killed for damaging/stealing others' property, they wouldn't do it. At least most wouldn't. WHY should the auto insurer have to pay for a car so some THUG can have it?? We have more cars than people? And this has to do with what?
When someone breaks the law, they lose their rights as far as I'm concerned.
Someone who steals the property of others is of less worth than the object being stolen. They don't deserve to be breathing. Like I said before, nothing makes my blood boil more than a thief.0 -

California has clearly-defined laws then one can use deadly force.
Even then, they state it "may be justifiable" when necessary to resist the attempt to commit a forcible and life-threatening crime.
Rape, murder, mayhem, fire-bombing an occupied structure, etc.
The owner could have used force to eject the trespasser, but only in response to a similar amount of force used by the trespasser to stay upon the property.
All us armchair lawyers haven't a clue how these things really get decided. The cops want bodies, any bodies. The prosecutor wants cases. Any cases they can win.
Shooting a guy in the chest was not a good idea, however. If he goaded the gang to chace him into his house, and they got justice while "pursuing him into his occupied residence through force", it might have ended differently.0 -

hmmm, so is there a dollar figure on your death warrant ? how low a figure would kill over ? what about stealing a cup of coffee ? does that warrant a death penalty ?
also, you are right on one thing. if people knew they were going to be killed for stealing then they would probably steal less. that would apply to jay walkers too. it would also apply to illegal gun owners. i guess we should just kill one site people who break gun laws

This is the law of the land, but it is wrong.
You should be able to shoot to protect property.
A person has spent months, or years, of their working life to earn their property. It should be legal to protect it.0
