NRA Lawsuit: New Orleans Gun Owners' Rights Violated During Katrina Firearm Seizures

NEW ORLEANS -
The National Rifle Association has hired private investigators to find hundreds of people whose firearms were seized by city police in the aftermath of Hurricane Katrina, according to court papers filed this week.
The NRA is trying to locate gun owners for a federal lawsuit that the lobbying group filed against Mayor Ray Nagin and Police Superintendent Warren Riley over the city's seizure of firearms after the Aug. 29, 2005, hurricane.
In the lawsuit, the NRA and the Second Amendment Foundation claim the city violated gun owners' constitutional right to bear arms and left them "at the mercy of roving gangs, home invaders, and other criminals" after Katrina.
The NRA says the city seized more than 1,000 guns that weren't part of any criminal investigation after the hurricane. Police have said they took only guns that had been stolen or found in abandoned homes.
NRA lawyer Daniel Holliday said investigators have identified about 300 of the gun owners and located about 75 of them. Some of them could be called to testify during a trial, he added.
"Finding these folks has been a nightmare," Holliday said. "That is really the guts of our case - to establish that there was indeed a pattern of the police going out and taking people's guns without any legal reason to do so."
In April 2006, police made about 700 firearms available for owners to claim if they could present a bill of sale or an affidavit with the weapon's serial number.
An attorney for the city and a police department spokesman didn't return a reporter's telephone calls Wednesday.
Alan Gottlieb, founder of the Bellevue, Wash.-based Second Amendment Foundation, said the police department has returned only about 100 of the 1,000 seized guns.
"Obviously, we don't expect the city to find everybody. We only wanted to see a good-faith effort, and that's what the city didn't do," Gottlieb added. "It's a bad example to let them get away with it."
In court papers filed Monday, NRA attorneys say finding the gun owners has been difficult because the storm has scattered so many residents.
New Orleans had an estimated 455,000 residents before Katrina, but less than two-thirds of that number live there now.
The NRA is asking for a delay in the trial, set to begin Feb. 19, saying they need more time to find gun owners. U.S. District Judge Carl Barbier had not yet ruled on the request Wednesday.

One of those "what have you do for me lately?" statements? And just how does the NRA "sell" something they do not own? If they really are that powerful, to be able to "sell out gunowners" you would be wiser to get on the good side of the NRA. I too would prefer to enjoy my basic rights without having to ask the government to give me those rights via CCW, castle doctrine, etc. But if I cannot just have those basic rights, my second choice is to get those rights via laws such as CCW. With that I have my carry right and can them work on turning that "priviledge" back into a basic right.
And same question I asked the other poster. If you don't stand with the NRA, just what/who do you stand with? Or are you one of the millions and millions of free riding moochers who only complains but doesn't help? I guess the latter.0 -

How many years did it take them to do this,,,we all know the only reason they are doing a damn thing now is because they have cought so much hell over their last sell out,,I am sure just like most of us here ,you go to more gun boards than this one and its the same on almost every board,people are leaving or nor renewing the NRA in droves,the only board I have been on that still praises the NRA is over at Nuge's board and they worship him as a God so whatever he sprays out they believe,,The NRA has waited so long to make a stand everyone is starting to stand against them0 -

Get off your dang "high horse" attitude with the NRA. Yes, they did good work in the past, but that is all they have done. They have sold out to the highest bidder and now are just trying to make money by playing both sides of the issue. I don't support them, no matter what you or anyone else says. BTW...it is NONE of your stinking business, but I am a by-God dues paying member of GOA. An organization that actually supports gun-owners and their fight against libs in America, and also supports us against the more and more common sell outs of the NRA. I just love the way the NRA rushed to the aid of gun owners in New Orleans. Katrina happened over two years ago! What took so freaking long??? And now they are wanting to delay the case even longer! If we didn't have the NRA we'd be in deep dodo. Mistakes are made that's true but it's also true that "if we don't hang together , we will surely hang seperately". Kick the NRA's ass but don't desert the cause. And if you feel GOA or the others are better , then use a little beer money to support them too. The only reason that the pols are in check is because they're in fear of what a campaign against them by the NRA specifically will do.
Fine, so here's my solution: get an ad hoc committee formed to confront the NRA. Stop griping and do something.

I am a member of the NRA.
I don't agree with a lot of the NRA's actions.
But who else stepped up to the plate to help return illegally confiscated guns to their rightful owners in LA?
I'm asking to be educated.
If the GOA or any other (nearly anonymous) organizations have done the same thing for the people of Lousiana, I haven't heard about it.
And I'm not talking aobut "decrying the situation". I'm talking about real action.

The lawsuits filed are action. Yeah, it's not done with yet, but like I said earlier, I don't know who else has taken even that action.

Look at the situation in a practical sense.
When you don't have political muscle on your side , you're just fodder for someone to try to run your life the way they see it.
It's great to be a total indivdual and not need "no damn laws" to justify your actions (such as carrying a weapon for personal defense)but if the microscope focuses on you there better be an NRA, GOA or other org to save your butt.
I'll give you a personal example. My uncle , a great gun guy, now passed , was robbed at gunpoint of all his firearms. Well , to keep the story short , the police did nab the miscreants and got the guns (most of them anyway) back. When my uncle wanted his commemerative 45 the Philadelphia police said they were keeping it for evidence. Right. Been there. He said , "OK , I'm calling the NRA legal dept." . Guess what , he got his 45 back that day!
No NRA, no 45 , it's that simple.0 -

Really, I think that is BS.
When I was a NRA DEALER selling memberships and clintons BATF threatened to prosecute me for perjury, the NRA would not even recommend a lawyer to me, not only did they turn their back on me, but every other dealer who was not working out of a store front. A very good friend of mine spent 10K on legal fees, his LAWYER contacted the NRA legal department, they told him they don't get involved.
The NOLA case is just smoke and mirrors for the masses. I doubt it will ever be resolved.0 -

The NRA is doing nothing but jumping on the band wagon of the Second Amendment Foundation.
Both Nagin and Riley should have been arrested back when a Judge ORDERED him to return firearms to the people of New Orleans back in Feb.
