NRA Wins Big in California State Court of Appeals

Fairfax, VA - The California State Court of Appeals announced today their decision to overturn one of the most restrictive gun bans in the country, following a legal battle by attorneys for the National Rifle Association (NRA) and a previous court order against the San Francisco Board of Supervisors.

"Today's decision by the California State Court of Appeals is a big win for the law-abiding citizens and NRA Members of San Francisco," declared Chris W. Cox, NRA's chief lobbyist.

In 2005, NRA sought an injunction against the San Francisco Board of Supervisors to prevent them from enacting one of the nation's most restrictive gun bans. NRA won the injunction, but the City's mayor and Board of Supervisors ignored the court order and approved a set of penalties, including a $1,000 fine and a jail term of between 90 days and six months, for city residents who own firearms for lawful purposes in their own homes.

"We promised our California NRA members in 2005 that we would fight any gun ban instituted by the San Francisco Board of Supervisors, and we haven't given up that fight," continued Cox. "Today we see our second win for the Second Amendment against the San Francisco gun ban. We beat them once in court and the City's attorney appealed based on his personal disagreement with the court's first decision to overturn the ban. Now we've beaten them again. The California State Court of Appeals has upheld the state preemption law."

Today's decision came in the form of a 3-0 opinion in favor of the lower court ruling overturning the gun ban.

"This decision is a thoughtful and well-reasoned legal opinion," concluded Cox. "I'd like to thank our approximately 4 million members, including the hundreds of thousands of members in California, for their continued commitment to protecting our cherished freedoms."

    My memory isn't as good as it once was...but I believe those by-laws were changed after they ran Neal Knox out. They intended to never again be faced with the position of the head of the NRA being a strict constructionist.

    Eric, Even as I come to have less support for the NRA, unlike many here I cannot wish for it's demise. With such a situation it is difficult (for me) to find a way to offer an example so that maybe, if you care, you (and maybe others) can have a better understanding of why I think like I do. Let me try and please bear /work with me on this just as I will do the same for any reply you might have for me. For ease of presentation, let me start by listing some facts that I believe exist:

    #1. We gunners almost always fight from a position of weakness. Many powerful people, politicians and organizations (well funded organizations) are ALWAYS againist us.

    #2. Because of #1, we gunners need all the help we can get. If someone/something is doing at least a little good for us, we cannot afford to throw that in the trash.

    #3. There are few, if any, national pro-gun rights organizations that can call a press conference and then be reported/quoted in the nationwide media. The NRA, to a degree, has such power. The only other one I have seen, on a very much smaller scale, is the Second Amendment Foundation. Such power as I have mentioned signifies that the NRA, for various reasons, holds other pro-gun power. We cannot afford to just up and flush that power in the toilet.

    #4. While the NRA makes some mistakes (by accident or on purpose is another argument) it does do a whole lot of good for gun owners and gun rights. And since the NRA is not ALL POWERFUL, nor does it own you or your gun rights, it is impossible for the NRA to singlehandedly destroy your gun rights. So, until another, better organization springs up, one as large and as powerful as the NRA. we cannot afford to wish for the demise of the NRA.

    #5. By the continued existance of the NRA, many politicians are at least somewhat fearful of coming out too strongly against gun rights. If the NRA folded overnight, that would be a neon sign invitation for all the entities (I mentioned above) to come out in force and try to totally destroy ALL our gun rights.

    #6. Rather than go to the tremendous time, effort, work, and money required to build a huge "gun rights church" (the NRA) I would prefer to replace the leadership of the NRA, keep the huge church and start doing a better job fighting for gun rights. Just as it is usually quicker, cheaper and easier for you to rehab a large house for your family than it is to start from scratch and build a new one.

    #7. If it presently is not possible to "reform" the NRA, then the first step we need to do is to change things so that it is possible.

    #8. If everyone still insists on the demise of the NRA, then we need to get to work and built something similar to replace it because we need it. I DON'T SEE THIS EVEN REMOTELY HAPPENING HERE ON GB.COM. And that is a sign of either a weak plan or no plan for when the NRA is flushed. And that is a big, big mistake.
