NRA Wins Big in California State Court of Appeals
Fairfax, VA - The California State Court of Appeals announced today their decision to overturn one of the most restrictive gun bans in the country, following a legal battle by attorneys for the National Rifle Association (NRA) and a previous court order against the San Francisco Board of Supervisors.
"Today's decision by the California State Court of Appeals is a big win for the law-abiding citizens and NRA Members of San Francisco," declared Chris W. Cox, NRA's chief lobbyist.
In 2005, NRA sought an injunction against the San Francisco Board of Supervisors to prevent them from enacting one of the nation's most restrictive gun bans. NRA won the injunction, but the City's mayor and Board of Supervisors ignored the court order and approved a set of penalties, including a $1,000 fine and a jail term of between 90 days and six months, for city residents who own firearms for lawful purposes in their own homes.
"We promised our California NRA members in 2005 that we would fight any gun ban instituted by the San Francisco Board of Supervisors, and we haven't given up that fight," continued Cox. "Today we see our second win for the Second Amendment against the San Francisco gun ban. We beat them once in court and the City's attorney appealed based on his personal disagreement with the court's first decision to overturn the ban. Now we've beaten them again. The California State Court of Appeals has upheld the state preemption law."
Today's decision came in the form of a 3-0 opinion in favor of the lower court ruling overturning the gun ban.
"This decision is a thoughtful and well-reasoned legal opinion," concluded Cox. "I'd like to thank our approximately 4 million members, including the hundreds of thousands of members in California, for their continued commitment to protecting our cherished freedoms."

That is the way it is around these parts. No matter what the NRA does or doesn't do, it will never be good enough. In most situations that had come to this, most people would stop and think maybe, just maybe, they had gone too far and were making their decisions based on emotion and not reason and logic.0 -

The NRA opposed this city ordnance from the start and threatened to sue the city if the supervisors passed it. They did knowing full well CA state law prevents cities and counties from enacting gun laws. State prerogative, only, under state statute. The CA Supreme Court loves gun laws and upholds all passed by the state legislature but they had to strike down a law passed by a city. State gun laws they love and support, city gun laws are un-Constitutional under CA law.

Funny,I got an email from CCRKBA today telling me they had won this case.
They did mention that several other gun rights organizations helped them.
I seem to get emails from them blowing their horn every time something positive happens.
I'm starting to wonder about them. [:(]

From your attitude I am sure you are not really asking for a response. It appears that you believe we "NRA types" don't understand any of the constitution. But even at that, it would seem reasonable if you "non-NRA types" would, if not actually offer muted praise when the NRA does some good for gun rights, but at least hold your rabid criticism for a few moments.
But I know that is too much to expect.

Unfortunately, I'm just as guilty as you are in aiding the enemy. I've sent the NRA countless donations/etc over the years...BEFORE my eyes were finally opened to who they really are.

Sorry, I have been there, the NRA turned their back on me, and thousands of other guys like me, search some of the threads about getting a FFL, most of those hoops were not there 20 years ago when I got my first ffl, the crime bill that created the new rules put about 70,000 FFL's out of business, including me, the BATF called me and told me I would be prosuceted for federal perjury, being a NRA dealer, I called them looking for direction, their legal department would not even talk to me. a few months later, a good friend of mine who was also a FFL spent $10 K to try to keep his license, he and his lawyer appealed to the NRA for advise, and were told "we don't get involved" his suit is now the precedent for that law, he is a member here, if you want more details about his case, I can send you his contact info.

Sorry, I have been there, the NRA turned their back on me, and thousands of other guys like me, search some of the threads about getting a FFL, most of those hoops were not there 20 years ago when I got my first ffl, the crime bill that created the new rules put about 70,000 FFL's out of business, including me, the BATF called me and told me I would be prosuceted for federal perjury, being a NRA dealer, I called them looking for direction, their legal department would not even talk to me. a few months later, a good friend of mine who was also a FFL spent $10 K to try to keep his license, he and his lawyer appealed to the NRA for advise, and were told "we don't get involved" his suit is now the precedent for that law, he is a member here, if you want more details about his case, I can send you his contact info.

So did GOA or any other organization help you out. I am just curious because I have seen many posts about how the NRA did you wrong but I have not read anything about GOA or others coming to the rescue. I am not trying to flame anybody but I am curious if any other organization helped you out.0 -

Don, I appreciate this information and offer of more. I read and considered what you posted carefully. In regards to more info, I have more to read now than I can handle. And with the problems you and others had, at face value I would have to agree with you in regards to anger at the NRA. But it may be that you and most others here don't fully understand where I am coming from.
To try to explain that, I will mention the subject of religion. For a few years here, most members thought I was a godless atheist. Recently in one topic it came out and surprised one or two members to learn that I believe in a creator. Just not the exact same creator they believe in.
In regards to the NRA, it is a fluid, ever changing organism. (Yeah, I know LaPierre seems to have been around forever). And it has tremendous name recognition, organizational skills and power far beyond anyother gun rights organization I know of. If the NRA ceases to exist, that loss will be seen as a major victory by the anti-gun side and might even invigorate them to even more intensive anti-gun actions than they might have taken if the NRA remained in existance and continued to project their power (real or imagined, it still projects power to the anti-gun side).
So it is possible that I could agree with every anti-NRA person here that the NRA is not our friend. But the people that are running the NRA can be replaced by popular vote of the members (via the board of directors) and each and every one of the executives that are not liked by gun people can be replaced. And then the NRA can be redirected to a direction that would make the present anti-NRA people proud.
Many Americans dislike many things about the USA. But with the USA being a democracy, we know that we have a chance of changing the USA to our liking. So few of us shout that we hate the USA and wish for its demise. One reason for that is that it would be hard to replace the USA or to rebuild the USA from scratch.
The NRA is actually not structured all that much different than the USA in regards to the members voting in the board of directors and then the directors chose who does and does not run the NRA. If instead of fighting among ourselves, we gun people could take back the NRA, along with all its tremendous resouces and power, and have it do as we want it to do.0 -

Speaking of other organizations, I have always wondered why the gun makers always seem to be absent from the gun rights battle. Or I have I missed something? This is in their best interest. 0
