Big legal question here
A close friend of mine's 60 year old father is currently locked up on a driving under the influence of drugs charge. I was really surprised, since I knew he is an alcoholic, but I didn't know anything about him taking any drugs. And sorry, but I have no idea what kind of drugs are involved. When I went down to the county jail today to get more information about what he is charged with and to arrange visitation for his family, I found out he also has four outstanding warrants (most likely driving related), and that his bond is $250,000, in full. No 10% down, not that I had any plans on bailing him out for even $20. Oh, and Immigration wants to talk with him, since he's in this country illegally. He got deported back to Mexico a few years ago after his third DUI, but he crossed the Rio Grande into Texas after about five months living with his relatives in Mexico.
Anyways, what I want to know is, what is the likelihood of him getting deported again without serving any jail time here? I'm hoping that's what he'll be offered, and it would be best for both his family and the taxpayers if he just got sent back and was told don't return. Anyone here have any first or second hand experience with something like this?

No, I am not kidding about any of this. And yes, if he is sent back to Mexico, he will either cross the border again or keep trying. I just don't want to see him spend the last years of his life locked up in a prison cell. 0 -

As I told the sheriff's deputy at the county jail this afternoon, he just doesn't want to learn. If anyone thinks that I am forgiving him, excusing him, or justifying anything that he did, you could not be more wrong. I'm hoping that something good for his family will happen. 0 -
I understand what you?re saying. Maybe the ?something good happening for his family? would be him remaining incarcerated and unable to hurt anyone. You want to help but sometimes you just can?t. Good luck. 0 -

The last time he got arrested for a DUI was a few years ago. Since that was his third DUI, he was given a choice: Ten years in state prison, or get deported back to Mexico. He chose to be deported, spent most of the winter down there, then came back across the border. This is why I'm wondering if he will get a similar choice this time around. 0 -

I would not be surprised if he gets the suspended 10 years in the jail as a reward for coming back!, sounds like a winner to me

The courts don't look at what is good for the defendants family, they look at what is good for the public and in this case jail time is needed to protect the public from him.
It's only a matter of time before he kills someone on the highway. He obviously doesn't give a rats ass about our criminal or immigration laws as he continues to break both. He should be jailed for the DUI, then deported, and if he re-enters the US again jailed for 10 years.0 -

i remember the illegal drunk in wichita...had numerous DUI's ...ran a stop sign one night and killed a 31 year old mother..the young daughter survived....he never should have been in this country, he should have been EXECUTED.. 0 -

The best thing for SOCIETY and his family is about 10 years in prison for this guy. While in prison he can not kill some other family driving while drugged up or drunk.
His propensity to break immigration, driving and drug laws is very disturbing. We CITIZENS are sick and tired of illegals coming here and creating destruction and mayhem.

The family is here legally, except for his son, who was deported right after he was let out of prison. His son (whom I have never met) was told that if he gets caught for anything on this side of the border, he goes straight to prison again, so he hasn't been back.
It really would be best for everyone if he went back to Mexico and stayed there. That way the US taxpayers aren't paying for all his meals and healthcare. But, I don't know what's going to happen this time around. That's why I was asking if anyone had any similar experiences.0 -

I would agree with deportation only if he would accept a surgically inserted GPS chip that would allow us to track the piece of crap's position 24/7.

Something I learned years ago dealing with junkies, applies here. Junkies don't have friends or family, they have co-dependents and victims. Alcoholism is an addition. You cannot help one who will not help himself. I fail to see how the family will be better off with him deported and then back here in the same fix again. He will not get better treated so, and may never get better. 0 -
