Putting in a new fence...
and the guys drilling holes for the posts hit an unmarked water main that serves the HOA common areas.
It's just a 2.5" PVC, but I'll be damned if the thing hasn't leaked with two different fixes.
I tried fixing it once, cause I felt bad the crew I hired hit it. That leaked. Then the HOA pres brought in the company that maintains the common areas, and his fix leaked. (at least I don't feel bad that mine failed.)
And the HOA is still CONSIDERING if I am at fault for this.
Why the pipe is running through my property without an easement is a mystery to me, too. It's not on any map and the only evidence the pipe ran through my place is a box at the edge of my yard (that I really didn't know what it was for, I thought MAYBE it had to do with my sprinkler system).
Actually, this "new" fence is replacing one I don't like. It's going in the same area with new post spacing.
Just venting a bit.

Did you have the county come and mark all the pipes,line ect that are underground?
If so you are fine.
That said HOA are a PITA.

Here in Utah. It's blue stakes...
In either case, they are responsible. So don't worry about it... That's why you call them to make sure you don't hit anything...0 -

The fence company made that call, and CATV, electric, water and gas all marked their lines.
This was an HOA line that's on no map, and as noted above, is a plastic pipe with a 12-18 sprinkler wire running next to it, that was severed too. I fixed the electrical.0 -

If not, inform the HOA they have X number of days to move it off your property or start paying a set amount (one time payment or per month rate) for the right-of-way!0 -

Many subdivisions have designated utilities corridors that are shown on the plat. No easements required, you agreed to it when you purchased the property. Chances are the HOA has restrictions about doing things like building fences and planting trees in those areas for exactly the problem you found. 0 -

Okay, we got the fact a locate was done and the pipe is not supposed to be there, but it is.
Why has it been so hard to fix the leak? 2.5" PVC should be easy to fix. Cut out the bad section, use the proper cleaner on the pipe and repair section, glue it all back together with fresh glue. Let it cure for an hour or so.

Cap both ends of the pipe then dont worry about it anymore, some one will want to fix it, then they can show you how and why that pipe is located in your yard. 0 -
The way I see it is;
You contracted it out-no fault on you
Contractor called 811-no fault on them
811 marked detectable utilities-no fault on them
HOA-put in a undetecable,unmapped utility-All on them,,,

PVC pipe, 2-1/2",, no big deal to a couple of illegal aliens, they'll have if fixed pronto. They can usually be found around the side/back of a Home Depot or Lowes.
Find it hard to believe the "fix" didn't work after 2 tries. Bad glue, sloppy cut, no cleaner? Think they make "slip on" flanges, something along these lines:

My solution to this problem will fix both the pipe and your legal concerns with the HOA.
Just install a valve with a shut off so that you can CONTROL the water flow!
Charge the HOA a monthly rate to keep the water flowing and close when you don't get paid!![8D]0 -
