Summary of GunBroker.com User Agreement: Changes for 2026
From time to time, GunBroker.com reviews and revises its policies, including the User Agreement. This disclosure summarizes substantive changes to the prior User Agreement, which was effective August 4, 2023. The new version is the User Agreement effective April 6, 2026. The 2026 provisions apply to all Users immediately, regardless of when a User registered or conducted a transaction. Users will be prompted to accept the terms and conditions before conducting any additional transactions. Any User who does not agree with the revised terms must discontinue use of the Site.
This Summary of Changes is intended to inform Users of key updates to the User Agreement. Most revisions are organizational, clarifying, or stylistic in nature to improve readability and consistency. However, certain provisions have been added or revised in ways that may affect Users’ rights and obligations. While this summary highlights what we believe are the most notable changes, other changes may be material to certain Users. Each User is responsible for reviewing the entire User Agreement to understand how it applies to their use of the Site. Nothing in this summary should be interpreted as a statement regarding the relative importance of any provision.
Among the changes to the User Agreement in 2026 are the following:
- General Clarifications and Technical Corrections. Minor grammatical, formatting, and definitional updates have been made throughout the Agreement to improve readability and reflect current business practices and legal requirements. These changes do not generally alter the substantive rights or obligations of Users.
- Clarifications of GunBroker.com’s Role as a Marketplace. The Agreement further clarifies that GunBroker.com operates solely as a marketplace platform and is not a party to transactions between Buyers and Sellers, does not take possession of items, and does not act as an auctioneer, escrow agent, or fiduciary.
- Updates to Data Use and Content Rights. The Agreement clarifies how User-submitted content and transaction-related data may be used, including the use of aggregated, non-identifiable data for business and analytical purposes.
- Reorganization and Structural Updates. Certain sections of the Agreement have been reorganized, renamed, or separated (including dispute-related provisions) to improve clarity and usability. Headings, definitions, and formatting have been revised for consistency.
- Account Maintenance, Inactivity, and Fees. New language clarifies that accounts with extended periods of inactivity may be subject to closure or inactivity fees, as described in the Fees section.
- Expanded User Responsibilities and Compliance Obligations. User obligations have been revised to emphasize compliance with all applicable laws, including those related to firearms, export controls, and sanctions. Additional clarifications address both Buyer and Seller responsibilities in completing lawful transactions.
- New Time Limit for Filing Claims. A new provision has been added establishing a contractual time limit for bringing claims. In general, Users must file any claim, lawsuit, or arbitration proceeding within one (1) year after the event giving rise to the claim, unless a longer period is required by applicable law.
- Expanded Arbitration and Dispute Resolution Provisions. The arbitration section has been revised and expanded to provide additional detail regarding how disputes are resolved. Updates include a required pre-arbitration notice process, additional procedural rules, and clarification of Users’ rights and obligations when arbitration is elected. The agreement continues to require individual arbitration and includes a class action waiver.
- Clarification of Liability Limitations and Legal Protections. The limitations of liability section has been updated for clarity, including reaffirming that GunBroker.com provides the Site “as is” and limiting the amount of damages that may be recovered. Additional language clarifies that Users agree not to bring claims against individual employees or representatives of the company.
- Updates to Identity Verification and Account Security. The Agreement now clarifies that, in certain circumstances, Users may be asked to provide identifying information, such as a Social Security Number, for verification, fraud prevention, or legal compliance purposes. This information may be transmitted to trusted third-party service providers for verification.
- Expanded Communications Consent (Calls and Text Messages). Provisions regarding communications have been updated to more clearly describe Users’ consent to receive calls, text messages, and other electronic communications, including those delivered through automated technologies, for account-related, transactional, and marketing purposes, subject to applicable law.
- Clarifications Regarding Payment Methods and Transaction Risks. The Agreement provides additional detail regarding permitted and prohibited payment methods and clarifies that certain payment methods may not be eligible for protections such as the Buyer’s Protection Program. Users are reminded to review payment terms carefully before completing transactions.

Summary of GunBroker.com Privacy Policy: Changes for 2026
From time to time, GunBroker.com reviews and revises its policies, including the Privacy Policy. This disclosure notes substantive changes to the prior Privacy Policy, which was effective February 4, 2025. The new version is the Privacy Policy effective March 30, 2026. The 2026 Provisions are applicable to any user immediately, without regard to when a transaction took place or when a User became active on the site. Any User who disagrees with a policy change must immediately cease using the site.
This Summary of Changes is intended to inform GunBroker.com Users of key changes made to the Privacy Policy. Most of the changes are grammatical and organizational, to make the Privacy Policy more easily understandable to Users. Please note, however, that there are some substantive changes. While this document summarizes what in our opinion are the most substantial changes, other changes may affect some Users in a material way. For that reason, every User is responsible for determining which provisions of (and changes to) the Privacy Policy and associated documents are of material importance to them. The User is advised to review the entire Privacy Policy to refamiliarize themselves with its provisions. Nothing herein shall be construed, and no appearance or non-appearance of any item in the list below shall be construed to represent GunBroker.com’s opinion of the relative priority or importance of any provision to any User; nor shall these changes be construed as an admission of the insufficiency of any prior language or provision.
Among the changes to the Privacy Policy in 2026 are the following:
- Multi-Factor Authentication (MFA) and SMS-Based Account Security Added. The Privacy Policy has been updated to expressly disclose GunBroker.com’s use of multi-factor authentication (“MFA”), including SMS-based two-factor authentication (“2FA”), for account login, password reset, sensitive account changes, fraud prevention, and suspicious activity monitoring. The Policy clarifies that authentication codes, fraud alerts, and other account security messages are transactional in nature and are not marketing communications. It also clarifies that Users may not opt out of receiving security-related authentication messages while maintaining an active account.
- Clarification Regarding Text Message Opt-Out and Security Communications. The section governing text messages and mobile communications has been revised to distinguish marketing communications from account security and service-related communications. The updated language clarifies that opting out of promotional text messages does not affect receipt of authentication, fraud alert, or other account protection messages.
- Data Retention Disclosure Added. A new data retention provision has been added to explain that Personal Information is retained as long as reasonably necessary to provide services, comply with legal obligations, prevent fraud, resolve disputes, and enforce agreements, subject to Applicable Law.
- Registration and Identity Verification Clarifications. The Policy has been revised to clarify that mobile phone numbers and email addresses may be used not only for registration and fraud prevention at the time of account creation, but also for ongoing authentication, account protection, and fraud detection purposes.
- Organizational and Technical Corrections. Minor typographical, grammatical, and formatting corrections have been made throughout the document, including clarifications in the Identity Verification section and minor corrections in the marketing and cookie disclosures. These changes do not materially alter the rights or obligations of Users but improve readability and internal consistency.
