McDonald's worker wins strip-search suit

SHEPHERDSVILLE, Ky. - A jury awarded $6.1 million Friday to a woman who said she was forced to strip in a McDonald's back office after someone called the restaurant posing as a police officer.

Louise Ogborn, 21, had sued McDonald's Corp., claiming the fast-food giant failed to warn her and other employees about the caller who already struck other McDonald's stores and other fast-food restaurants across the country.
Ogborn was forced to undress, endure a strip search, and to perform sexual acts, the lawsuit said. The events were captured on surveillance video, which was shown to jurors during the trial.
Ogborn had been seeking $200 million. McDonald's Corp. attorneys argued the company was not responsible and contended the company was being sued because of its deep pockets.
Ogborn hugged relatives after the verdict was read.
"Louise has stood up for what happened to her and what McDonald's failed to do for three-and-a-half years, and this jury just vindicated her completely," said her attorney, Ann Oldfather.
McDonald's is evaluating whether to appeal the decision, a spokesman said.
"While we are disappointed with the verdict, we remain vigilant in our efforts to protect our employees and provide them with a safe and respectful workplace," said William Whitman, a spokesman for McDonald's USA.
Ogborn accused the company of negligence leading up to the events in April 2004, when she was detained for 3 1/2 hours.
In the lawsuit, she said someone called the restaurant in Mount Washington impersonating a police officer and gave a description of a young, female employee, accusing her of stealing from a customer. The caller instructed an employee to strip search the woman, according to testimony.
A former assistant manager, Donna Summers, was placed on probation for a misdemeanor conviction in relation to the incident. Her former fiance, Walter Nix Jr., is serving five years in prison for sexually abusing Ogborn during the 3 1/2-hour search.
A Florida man, David Stewart, was charged with making the hoax phone call but acquitted last summer. Police have said the calls stopped after Stewart's arrest.

Forced by her manager?????
Nowhere does it say manager...asst manager yes, but come on Don...a phone call?....would you honestly perform a sex act on someone because of a phone call????
I dont care if I had been accused of stealing the hope diamond, there is no way a strip search would be allowed UNLESS a cop (female) was present, and then to perform sex acts???? I dont think the girl was that stupid..
Needed the job? there are other jobs out there,...something smells in this one...0 -
Well now we know that stupidity can finally be listed as a paying occupation.[V][V] 0 -

This happened three years ago. She is 21 now, not then. I'm glad she had her day in court. The manager should have known better.0 -

Ass. man. is manager when the manager is not there[:D], so what if she is not the sharpest knife in the drawer, that did not give the ass. man. , who should have know better, the right to even question, let alone strip search, a 17-18 yo kid. Manager & McD's should have their people in authority trained better, that is why they (McD's) are paying. How many HS age kids work at McD's? You are going to tell me they do not, or should not assume some responsiblity for the safety and well being of their employees?

she was 18 when this happened 0 -
Yea, she was dumb to submit to it, but it doesn't make it not a criminal act. 0 -

So puppy dog did what he was told? Why didn't he have the brains to sue McDonalds, too?
His gal lost her job, he lost his fiance, and he's going to jail!
Looks like 6 million dollar girl is the only one with brains.0 -
Donna Summers???? Now we know where and how the background for "love to love you baby" was recorded! [:0][}:)][}:)][;)]
BTW could that "sexual abuse' have been cavity searches?

You are right of course. That leaves us with two choices.
1. She really is that stupid.
2. She smelled money on day one.
I know we aren't supposed to judge a person by their appearance, but I'm going with option one.0 -
I watched this on 20/20 last night. This is about the weirdest thing I ever heard of.
There was a security camera in the ceiling of the manager's office, pretty good quality video. Certainly the two asst. managers knew of this camera?
So, they showed this middle aged manager, the guy who is now in jail, and this naked little teen aged girl, trying to hold a black apron in front of herself for cover. At one point, the guy ordered her on to her hands and knees, and he began spanking her ass. This was at the direction of the fake cop on the phone. He beat her ass for 10 minutes and left it cherry red.
Then, again acting on orders over the phone, the middle aged guy ordered the naked girl to give him a bj, which she did. I couldn't believe they showed this, they pixillated the girl's head but otherwise it was x-rated. This asst. manager thinks it is part of a police investigation to do this, knowing that it is recorded on camera?
He deserves five years just for being stupid.
On 20/20 they said that the cops traced the call to a prepaid phone card belonging to a guy in Florida, who worked as a prison guard. He was tried and acquitted.
They said that about 90 similar calls had been made over several years, all over the country. They did not say how many cases went as far as this one did.
The upshot of the case was that the female asst. manager, the one who forced the girl to strip in the first place, and who was convicted and did a year's probation for her role in the sexual assault, also sued McDonald's and collected a million dollars.0 -
[:o)]Now she can afford to go to medical school. 0 -

they should have put it on the menu, and claimed it was her job, instead of offering me 2 apple pies, i can get a bj and a rim job0 -
Great some dirtbag attorney got 40% over a case that should not have even been filed. 0 -

Sweet dreams are made of this.

My daughter-in-law was stripped searched in the Lizton, IN high school about 15 years ago. She was accused of stealing some money from a teacher. None was found - even in body cav - well you know the rest. After a couple of years she got less than 100K. A couple of folks were fired or transfered from the school. The bast**ds deserved worse! It's all about intimadation guys. How smart can a kid be to stand up for what's right? The operative word here is "kid". 0 -

Sharon and I were in a Wendys a several months ago and there was a girl that was working as hard as she could(white, appeared to be Pentecostal)the other emps. were giving her a really hard time. You could tell she wasnt quite right, and when I say that I mean not as "street smart" as you and me.I automaticly think "whats there angle" when I interact.I am by far not the smartest man in the world. But I can sense when people are trying to pull one over on me. When I heard of this girl in Ky thats the first thing I thought of was that girl in Wendys.I guess some people arnt as smart as you black roses.Do you ever cut anybody any slack,Or are you always this intolerant0
