Cook County Communist Commissars are trying to shut down the new Cabelas Superstore by banning FFL's within 15 miles of each other.
Cabelas thumbed their nose at them and presented their backside when they put a flying Thursday inside the Chicago Sun-Times with ads for Rem 1187's and 870's, Sig-Sauer, Glock, Hi-Standard, S&W and Taurus.

Just weeks after its gala grand opening, the Cabela's superstore in
Hoffman Estates, IL is facing closure by the Cook County (IL) Board. This
impending action stems from a pair of proposed county ordinances
prohibiting the retail sale of firearms at a location 15 miles or less from
any other federally licensed firearm dealer. The proposals further prohibit
retail sale of firearms within one mile of any school, church, place of
worship, nursing home, homeless shelter, public housing, or military
installation. With respect to these restrictions, Cabela's Hoffman Estates
store loses on all counts - as does every other federally-licensed gun
dealer in Cook County.
"This proposal is an election year stunt instigated by Cook County
Commissioner, Larry Suffredin," said ISRA Executive Director, Richard
Pearson. "Although this is something that we'd expect to see from a
gun-control extremist like Suffredin, I'm surprised to see astute
politicians like Commissioners Claypool, Quigley, and Murphy signing on as
co-sponsors to this farce."
"Cabela's Hoffman Estates store employs hundreds of Cook County
residents and brings in millions of sales tax dollars for the County,"
continued Pearson. "If Cabela's cannot sell firearms, then there is no
Cabela's. If there is no Cabela's, then those retail dollars flee to
DuPage, Kane or Will counties. The cash-strapped Cook County treasury
really can't afford such a huge hit just because Larry Suffredin doesn't
like people who own guns."
"From a practical standpoint, Suffredin's proposal is a non-starter,"
commented Pearson. "It bears repeating that the Chicago Police Department
has determined that 88% of murderers have previous criminal records as do
76% of murder victims. Federally-licensed firearm dealers are not the
problem - career criminals are."
"Furthermore", continued Pearson. "When was the last known case where
someone walks out the door of a gun shop, in the door of a nursing home,
and then proceeds to shoot the place up? The same Chicago Police Department
report lists alleyways as being popular places to get murdered. Why then,
did Suffredin not specify that no gun shop could be within one mile of an
alley? The reason is simple - shock value. Suffredin prefers to play on the
plight of our most vulnerable citizens in order to advance his quixotic
campaign to disarm hunters and sportsmen. Commonsense is not part of the
Suffredin lexicon."

But if Cabelas does leave, what does that do to the other FFLs in the County? This action is arbitrary and capricious, and would not hold up in court. Also, it sound like there is no provision for pre-existing FFLs to be grandfathered, raising constitutional issues. Better to keep Cabelas, with its team of attorneys, in the county fighting instead of fleeing.

I still think the best thing to happen to Cook county would be if it would fall off into Lake Michigan. You also hear alot about the Illinois State Rifle Association. They must really suck because they can never stop any of that bullcrap that goes on in that state. Why can't the ISRA organize and sue the state and Cook county for Constitutional infringements? Another thing I can't figure out is how Cook county can come up with new rules. Cabelas had to be zoned to sell firearms when they applied for their FFL at that store. Zoning is approved by the county. Cook county wouldn't have a leg to stand on if this went to court. 0 -

Illinois and its leadership (Blagovich and Daley) are extremely anti-gun and will do whatever it takes to take away that right.
The ISRA can do whatever they want to try and head off actions like this but it will not work. Blagovich and Daley have judges in their pocket so to speak and these judges will always side with them. There will be no grandfathering of this rule...they want dealers to dry up and disappear.
Here is what I would like to see happen:
1. Every firearm manufacturer should refuse to sell their products to this state since the leadership feels guns are the real problem and taking them away will solve all the problems. Well then your LEOs dont need guns anymore if it is gonna be all peaches and cream.
2. Every firearm manufacturer that is located in that state needs to relocate to a gun friendly state like Texas, Tennesse, etc. Take the jobs and tax base and move south...screw IL and those that lead these half-wits (no offense intended to our brothers and sisters on here who may live there, but it seems they are the minority).
3. Every major sporting goods retailer like Cabelas needs to pull the plug on that sewer called IL and let them lose revenue yet again.0 -

This law was proposed by Commissioner William Beavers ex- Chicago alderman, ex- CPD cop and Larry Suffredin ex- lawyer. Its a carbon copy of the Chicago ban with extra's thrown in.

Here's some of the highlights:
Sec. 58-131.5. Unlawful firearm or laser sight accessory in motor vehicle--Impoundment.
(a) The owner of record of any motor vehicle that contains an unregistered firearm, a firearm that is not broken down in a nonfunctioning state, or a laser sight accessory shall be liable to the county for an administrative penalty of $1,000.00 plus any towing and storage fees applicable under Section 58-164 of the Code. Any such vehicle shall be subject to seizure and impoundment pursuant to this section.
(b) Whenever a police officer has probable cause to believe that a vehicle is subject to seizure and impoundment pursuant to this section, the police officer shall provide for the towing of the vehicle to a facility controlled by the Sheriff. Before or at the time the vehicle is towed, the police officer shall notify any person identifying himself as the owner of the vehicle at the time of the alleged violation, of the fact of the seizure and of the vehicle owner's right to request a vehicle impoundment hearing to be conducted under Section 58-164(d) of the Code.
Sec. 58-132. Registration of firearms.
(a) No registration certificate shall be issued to any person unless such person:
(1) Shall possess a valid Illinois Firearm Owner's Identification Card in accordance with the Firearm Owners Identification Card Act found at 430 ILCS 65, et seq., as amended;
(2) Has not been convicted of a crime of violence, as defined herein as weapons offense, or a violation of this Ordinance; and,
(3) Has not been convicted within the five years prior to the application of any:
(i) Violation of any law relating to the use, possession or sale of any narcotic or dangerous drug, or,
(ii) Violation of Article 12-2 of the Criminal Code of 1961, as amended and found at 720 ILCS 5/12-2, for aggravated assault or any similar provision of the law of any other jurisdiction; and,
(4) Has vision better than or equal to that required to obtain a valid driver's license under the standards established by the Illinois Vehicle Code of the State of Illinois, as amended; and,
(5) Is not otherwise ineligible to possess a firearm under any federal, state or local law, statute or ordinance.
(b) All applicants for a registration certificate under this Ordinance shall file with the Sheriff on a form provided, a sworn application in writing. The application shall include the following:
(1) Name, social security number, residential and business address and telephone number of the applicant;
(2) The applicant's age, sex and citizenship;
(3) The applicant's Illinois firearm owner's identification number;
(4) The name of manufacturer, the caliber or gauge, the model, type and the serial number identification of the firearm to be registered;
(5) The source from which the firearm was obtained;
(6) Evidence that the applicant meets the criteria of this Section;
(7) Two photographs of the applicant taken within 30 days immediately prior to the date of filing the application equivalent to passport size showing the full face, head and shoulders of the applicant in a clear and distinguishing manner;
(8) Such other information as the superintendent shall find reasonably necessary to effectuate the purpose of this Ordinance and to arrive at a fair determination whether the terms of this Ordinance have been complied with.
(c) The Sheriff shall be the custodian of all applications for registration under this chapter.
Sec. 58-132.5. Unregisterable firearms.
Note:(1) Those validly registered to a current owner in the County prior to the effective date of this Ordinance, and which contain each of the following:
(i) A safety mechanism to hinder the use of the handgun by unauthorized users. Such devices shall include, but shall not be limited to, trigger locks, combination handle locks, and solenoid use-limitation devices; and,
(ii) A load indicator device that provides reasonable warning to potential users such that even users unfamiliar with the weapon would be forewarned and would understand the nature of the warning;
This one is possibly the scariest, Depending on who interprets the law as it's written, How many fire-arms have a loaded chamber indicator? Also remember we have to stay under 12 rounds..... Any Shotguns have a loaded indicator? Rifles? Think of all those 1911 colt types ? any revolvers have loaded indicators? I have a nice Belgium browning O/U , the last time I looked it wasn't built back in the 1960's with a loaded chamber indicator. Technically they could confiscate everything including black power rifles if they have a mind to do it. If Your unfamiliar with cook county We had a drought up here for 4 years where residents could not order ammo to be shipped to their houses because Distributors were informed they would be charged by County prosecutors due to a loop hole they found in the laws here. Don't tell me These guys will not pull that stunt on getting rid of "Evil Firearms". All these law makers have to do is change a comma or two and it could include rifles and shotguns also. I'm still thinking about loosing merely a 1911 pistol because it was made with out a loaded indicator.
Sec. 58-133.5. Fingerprints.

1 firearm . . . $20.00
2--10 firearms . . . $25.00
More than ten firearms . . . $35.00
Sec. 58-137.5. Exhibition of registration.
Any person carrying or having in his possession or under his custody or control any firearm, shall have on his person or within his immediate custody a valid registration certificate for such firearm issued hereunder, which shall be exhibited for inspection to any peace officer upon demand. Failure of any such person to so exhibit his registration certificate shall be presumptive evidence that he is not authorized to possess such firearm.
Failure of any person to exhibit a registration certificate for any firearm in his possession, custody or control shall also be cause for the confiscation of such firearms and revocation of any registration certificates issued therefore under this Division.

Sec. 58-138. Possession of ammunition.
No person shall possess ammunition in the County unless: He is the holder of a valid registration certificate for a firearm of the same gauge or caliber as the ammunition possessed, and has the registration certificate in his possession while in possession of the ammunition;

Sec. 58-138.5. Possession of laser sight accessories.
Ever used a laser on a pistol as a training aid at the range and have you seen how much your hand moves during a double action shot? Well kiss that training aid good bye,,,,,,
And if it's looking at one for home defense, I guess accuracy is no longer a concern with the law makers in Cook County.
Sec. 58-139. Permissible sales and transfers of firearms and ammunition.
No ammunition may be sold or otherwise transferred within the County except through a licensed shooting gallery or gun club or a licensed weapons dealer as defined in Chapter 54, Article III of the Code or as otherwise allowed by the Code.
Better not loan a box of 12 guage shells to a buddy or neighbor unless you go down to the gun store to transfer ammo..... ( I forgot there will no longer be any GunStores in the county able to remain open with such restrictionsThe proposals further prohibit

Sec. 58-142.5. Destruction of weapons confiscated.
Whenever any firearm or ammunition is surrendered or confiscated pursuant to the terms of this Division, the Sheriff shall ascertain whether such firearm or ammunition is needed as evidence in any matter.
If such firearm or ammunition is not required for evidence it shall be destroyed at the direction of the Sheriff. A record of the date and method of destruction and an inventory of the firearm or ammunition so destroyed shall be maintained.

Machine gun means any firearm from which eight or more shots or bullets may be discharged by a single function of the firing device. Which leads us back up to the definitions yet again where I see
