Who's Deer is it??
I would like to hear all of your thoughts and opinions on this question? Assume your Deer hunting and a nice 8 point walks up and you fire and hit him in a vital area. He runs but you know he's going down, however a few seconds pass and you hear a surprisingly close shot crack the air. You began following your Deer and another hunter happened to be seated against a tree close to 100yrds off with permission to be there. You see he shot your Deer as well and is begining to gut it. You approach loudly not to surprise him and you look and he's hit the Deer also in a vital area. Who do you say this Deer belongs to?

I think it would be a shared situation; that is if both hunters are reasonable individuals. Unless an autopsy was performed it might be hard to prove which shot was actually more deadly.[:D] 0 -
I don't much care about the rack so he could keep that. I would surely have a discussion about sharing the meat. I had an encounter with a guy like that once and now have a good friend and hunting buddy. 0 -
[I believe it should belong to the hunter who shot it first.] If I were in a tree stand and I took the second shot thinking that I killed it. I would probably be upset at first... until I looked at the deer and saw that it had been shot already. Then I would still be upset.[:D] 0 -
If I was the second shooter I would probably give it to the guy that shot first just because he had already made a kill shot. But as someone else said, two reasonable hunters could work that out. We are supposed to be grown ups. 0 -
Up in the Adirondack region of New York, where I hunt it is always the guy who draws the first lethal blood, and sometimes the first blood. We have infact had a neighbor superficially wound a deer, and had it pop out by one of our group, and was promptly dropped. The neighbor showed up when the field dressing was going on, and we went back, and he showed us the blood before our guy neck shot this buck. We promptly congradulated him, and said nice buck. We gave him a ride back to his home, and let him drive his pick up in to pick up his buck. We got a nice big bag of jerky and 2 bottles of Southern Comfort in return. we enjoy being neighborly, and doing the right thing.
However, there is sometimes this is not the procedure that is operated on by others. It is a shame, but no deer is worth getting shot in the back over.0 -
Yup, reasonable men working it out. I hunt for meat AND fun. I would not let it come to a violent confrontation. If he takes it, I still have my tag and get to keep hunting. Some years I get two tags, some years only one (buck). I surely isn't worth dying for. 0 -
I would have no argument with the other hunter. I hit the deer and it ran off - I didn't kill it only wounded it. Ran by him and he hit it and knocked it down killing it. Its his deer. 0 -
it belongs to the FIRST hunter,..provided it was a kill shot. However,..you need to work it out, and if you can't, just shoot another deer. 0 -
2nd hunter owns its-just one of those things. 0 -
I would explain to him that you also had shot the deer before he did and ask if you could at least take a picture of yourself with the deer (For bragging rights[:D]) and then let him have the deer and then go shoot yourself another BIGGER buck. 0 -

I had this same thing happen to me a few years back. I shot this 6 pointer, got a good hit on it and it bolted. The next thing I hear are 6 or 7 shots ringing out on the property next to where I was hunting (we both had written permission to hunt there). I followed the blood trail from my hit and it ran right to the deer this other guy was starting to gut. I told him it was his, after all he made swiss cheese out of it with that autoloader he was using. Two day's later I shot a nice 10 pointer, dropped it in it's tracks. 0 -

One of my friends says that the best trophy is a big chest freezer full to the top...you can't eat antlers or tracks. Good ethical men would agree with a solution, or start a fire, and have dinner on the spot!0 -

According to the unwritten rules of hunting, and good sportsmanship, the deer belongs to the first hunter. This is what we teach in Hunter Education class. However, good sportsmanship isn't always present in the woods. I would say talk it out with him. 0 -

here in these parts, it's the one who finally dispatches it. Happened to me a couple of years ago. heard a shot, a 4 point runs at me, I drop it with a shot from a .35 Marlin. college aged kid comes intenly tracking a miniscule blood trail. (brisket shot) I had it dressed, and he said he had shot it first. I said "law of the jungle...I dropped it dead here...how about I flip ya for it! and it won't be one of those 'Pittsburg Steelers, thanksgiving day flips!) Remember that one ewhere the guy called heads, the flip was heads, and the idiot ref thought that the other team won the toss? it was that year).
he called 'tails', it was 'Heads'. I looked at the coin, and him and said "Tails it is sparky...enjoy your deer"
Ran into a guy a couple of hours later, and he asked 'doin any good?' told him about the coin flip deal, and he said "That was You?"...told him yep. turns out it was the father of the kid that I flipped for the deer, and he drug the deer down and took right off for finals week." Told me thanks, and said 'hunt here anytime you like!" (also the caretaker for open hunting property) Asked me if there was anything he could do for me, and I handed him a bag of trash I'd picked up. Day eneded with coffee and brandy in his barn.

for 5 generations my family has always gone by first blood gets the deer..... now days in this greed filled world I have seen fist fights break out over a deer.... just yesterday i ended up in an argument with a man.... i shot a deer in the front shoulder and tracked it about 300 yards... he shot it in the rear end and it could not get up and eventually died.... he left it in the woods to go get his atv untagged and i caught up with it tagged on is property and drug it out to the car... not more than 30 min later he came out creaming that i stole his deer... i told him i shot it furst and had the blood trail to prove it but if he wanted it he could have it.... eventually we got to talking and ended up chatting for over an hour during which i offered him the deer many times... he kept saying no its ok i dont really want it i just have had a bunch of stuff stolen from the property and have seen a lot of dead deer that people shot and didnt recover.... i told him that the only reason i went on his place is i didnt know exactly who owned it and that i was not leaving a crippled deer in the woods.... he told me next time just stop at the house and ask and i will be more than welcome to go back in and track one.... long story short first blood gets the deer..... 0
