    HOWEVER......having said all that, I'm not a big fan of trick laws that are used in a discretionary way by prosecuters, otherwise you have no fair and just legal system. It's like the RICO law, which, theoretically, could be used to prosecute a bunch of little kids selling "homemade" lemonaide, when they are really mixing up a batch of CountryTime lemonaide mix.

    The subject law is obviously designed to help the innocent, and that's a big plus. Let's face it, someone breaks into a home, hammers a family members head with a bat, they need to die, the sooner the better in my opinion, before they can maim or kill the innocent. So who's the murderer here? The innocent homeowner who's stepson was brutally beaten, who might have brain damage for the remainder of his life, or Hughes, one of the rats that caused the whole mess? Hughes' Mom sounds like Al Sharpton and Fox News reporting the Jena 6 Hate Crime, if you ask me, totally one sided to make the victims look like the criminals. I can go for more laws like this.

    That crime happened a long time ago,perhaps a year ago.Clearlake is in Lake county with a population of at least 50,000 so they got that wrong.Clearlake is a dried up resort town,with a lot of corruption but not that much crime.A lot of locals call it Oakland north because of the amount of blacks there.Not a nice place to live.Almost bought a house there once glad I didnt.

    My brother and sister-in-law live in Lakeport..... across the lake from Clearlake. A friend of mine is a Deputy Sheriff in Lake county.

    It is common knowledge that Clearlake is loaded with parolees and other undesirables.

    The Rev Brown's claim that Lake County has racist laws is BS. The law quoted is a Calif State law, not a county ordinance. Its called the "Calif murder rule".

    It is used all the time on both black and whites in bank robberies and other crimes where people are armed. Example.... if 2 guys rob a bank, then get into a shoot out with police where one bad guy is killed, the surviving robber is charged with murder even though the police shot the first bad guy.

    That has been the law here for years and its a good law whether the left wing wackos like it or not.

    The black kids mama is right. Her son didn't kill his child hood friends, but by trying to kill the shooters step son he caused his buddies to die. If they had not broken in that house at 4am and beat this boy with a baseball bat they would all be alive, maybe. I would have killed all three. This boy should not only be charged with murder, breaking and entering, theft by taking, theft by strong arm, armed robbery, but also attemted murder. If you hit someone in the head with a baseball bat and cause permenant brain damage then that means you where trying to kill that person. I hope he rotts in jail!! The father being on weed and drunk doesn't matter. He had a prescription. Did these hoodlooms have prescriptions? NO THAT'S WHY THEY BROKE IN AND TRIED TO STEAL IT. I FEAL NO PITTY FOR THEM!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    I'm surprised this is rarely instituted there. In Illinois it is common place for any one who commits a burglary or robbery that goes bad be charged with murder if ANYONE dies during the commision of the crime. The only difference is that it's usually a cop that does the killing around here, it is unfortunately rare that the victim uses a firearm to protect him/herself. locally.
