    I think he has a great court case against that lady and her department, as well as the sheriffs department.

    They would have had to have suspected an imediate threat to someones life or well being to do what they did.

    He did the perfect thing. Video taped the whole episode, got names on tape...did not get vulgar or try to force them to leave the property by physical force or threaten them with bodily harm.

    From the looks of it he lives in a rural area and unless Indiana is that much different than other states, you dont need permits to do improvements or construction on your property.

    Someone from the Health Dept is going to be in deep sheet in court.

    +1 If that illegal trespass is upheld, there will be NO protection for anyone.

    What. What's that...the ACLU isn't on top of this?

    How could that be?

    Just remember, the cop did his job as sworn...produced volumes of BS to persuade compliance, ignored the law, did nothing when asked to act, probably topped off the day with a jelly filled. Typical cop day. Went home feeling he served his community. Seen it before myself.

    This is a terrible violation of the guy's Constitutional rights.

    I would be willing to contribute some money toward helping him get good legal assistance to right this wrong.

    If I could get the details of name and state, I'd write the governor and whatever other officials are appropriate.

    This is your future, folks.

    Unbelievable....

    It was obvious that the deputy was not sure of his, or her, "authority", but took the "govt" line. He should have removed her, regrouped elsewhere and found out the facts of the situation. IF there was any legal grounds for further action, it should have been undertaken from an informed, legal basis.

    Baaaad mojo.

    If this complaint and film crossed my desk, on one of my deputies, the crap would indeed hit the fan.

    Acting under color of authority, with no legal basis, in apparent violation of the State and Us Constitutions = big trouble.

    The umbrella of "Qualified Immunity" to civil liability has been removed, far removed.

    These type of government abuses MUST be identified and pushed to the full extent of the law, EVERY time they occur. This type behavior should be hi-lighted and made into a frightening prospect for EVERY government and police official.

    Maybe then, crap like this will become the exception, rather than the rule.

    If he truly understood the law he would have placed the lady under citizen's arrest for trespass, and the deputy would have been bound by law to accept the citizens arrest.

    The deputy, if I understood the conversation correctly, didn't concur with the lady on her right to look and go see. He did the right thing by staying at the point of public common access.

    I had similar conversations with people working for other county agencies, and state agencies. They claimed the right to go forth on private property, which I said no. I refused to accompany them and warned them if the people said anything about trespass or a warrant that I would arrest the trespassers and take them to jail.

    He will win nothing in court. He did not have enough prior law education to set this up to win big in the courts. He knew just enough to get frustrated, but fell short of stopping the event.

    Has anyone found out any more info on this. county? outcome?
    he said in the video Nov. 22, I believe... I'll find out more if no one knows, I don't want to be on a hunt if we already have some answers
