Today a Missoula judge called one of those men, 21-year-old David Moorse, a hazard to the community because Moorse already had a federal warrant for weapons violations.
Now he and 25-year-old Jacob Scharff are each charged with criminal mischief, a felony, and cruelty to animals, a misdemeanor. Investigators said the men admitted to them that they were driving drunk on Nine Mile Road Monday morning, when one of them pulled a .22 and shot a horse. The horse's owners later had to put the horse down.
Those men are still each claiming the other pulled the trigger.
Investigators got the two men's license plate number from a man who was suspicious of the way Moorse and Scharff were driving. When those investigators tracked the two down, they admitted they were in the area and shot the horse.

The one guy is already wanted by the Feds for a firearms violation. He is really up the creek. Just by being in a car in which there was a firearm probably puts him in posession of the .22 that killed the horse.
