NOW! I'm really confused !
Thanks for all of the replies on my selling a gun to a 20 year old. I still don't have the "concrete" proof that would make me feel comfortable. I've tried not to do too many stupid things over the years, and don't intend to start now. I think I'll pass on this one. The law is too ambiguous(which means I don't understand it), I think I'll err on the side of caution. Thanks agaion to everyone.

sell it to his mom and then he can have a note from her to have it at the range, here in UT you can have a handgun if your over 18 but you have to have note from your mother to have the ammo 0 -
I didnt read all the responses on your last question but it is very easy. You said you are selling it at an ON LINE auction. Unless you are going to do a Federal LEGAL face to face transfer it Can NOT be done. If you are mailing it somewhere it will have to go to an FFL and that FFL will NOT transfer it to someone under 21. IF you are doing a Local Face to Face sale and there are NO local laws that prohibit someone from 18-21 from buying a gun it is LEGAL.

I have it listed on an auction site. The buyer lives about 3 miles from my home, and wants to buy it face to face. Whenever I do sell one of my guns, I use an FFL to ship. I just always thought that an individual needed to be 21 years of age to buy a handgun., weather through a dealer or private person. I need to know how to obtain this information, and see it in writing. Knowing this for sure, would be a bit more knowledge than I had yesterday.

No, I'm not hard up for the cash. It's a question, and if he is a person with a sound mind with the proper attitude, why shouldn't I sell him the gun? Unless of course it's against the law!
That was the whole gist of the question. Money had nothing to do with it. It was a hot enough topic that apparently, a lot of people were reading it, and possibly also wanted to know.0 -
although it may take to long to execute this sale, for future reference, this is how to get as concrete an answer as it gets:
1. write letter to BATFE describing in detail the question. wait. recieve letter detailing the answer. save.
2. write a letter to the state a.g. with same question. wait. hopefully, recieve letter with save answer. save.
when making a sale as described, i would reccomend you be extra meticulous in your documentation.0 -
It is legal in Michigan as someone else indicated. I bought my first handgun when I was 19 and it started me down the slippery slope that led to a career in law enforcement and a lifelong love of both handguns and long guns.
My dad bought me my first couple of long guns but after I shot a couple of handguns at a deer camp in Northern Michigan (near Glennie)-I was hooked.
Why don't you just calm down, go to your local police station in the morning and ask to see a copy of your states firearms laws and tell them what you want to do. You indicated that it would be a face to face transaction in your earlier post so just ask the cops and have them SHOW YOU THE LAW THAT APPLIES. Pretty simple. Then ask them to make a copy and attach it to your paperwork that you generate at the sale.
In Michigan, the prospective purchaser goes to the local police agency and picks up a permit to purchase. There are 3 copies that are filled out by both buyer and seller. Seller keeps one and the buyer takes the other two copies back to the police station to register the handgun. If your state is like Michigan-they won't give him the permit if it is not legal for him to own the handgun.

I am calm. It's everyone else that seems to be nervous. This started out as a simple question. If someone didn't have an answer, then don't respond. I was trying to avoid opinion and conjecture, and yes, I know that it's impossible on a message board, but all I wanted was a simple answer.
Apparently, a simple answer doesn't exist. Not here anyway. If the answer was impossible, then the next best thing was a direction for mre to follow to get the answer.
I know that a lot of members are, or have been involved in law enforcement. Sorry, but I try to avoid most of you folks if I can. If you recall, in earlier posts I got reply's like "can you say go to jail". Then I got others that said it was perfectly OK. I posted the same question at another group that I belong to, but they weren't nearly as vibrant as you guys. I'm glad that I joined. WHATEVER! It was fun antway.
