buying a handgun from out of state dealer
is it a federal or a state law that you cant buy a handgun from out of state ffl. I live in north dakota but i'm still a south dakota resident. and i want to buy a handgun and have it shipped to the local dealer in north dakota but i was told by a guy at work that i cant do that. i haven't asked the local dealer yet weather that would be legal or not but the guy at work said it was a federal law that you cant buy a handgun from a out of state dealer.

If you are still a south dakota resident you can purchase a handgun from the SD dealer, but not from the north dakota dealer. The big question is what proof do you have to offer either dealer of which state you are a resident. And how long have you lived in ND.
In answer to your question about whether or not you can buy a handgun from an out of state dealer. Yes you can, but it must be shipped by him to a dealer in the state which you reside. He does the background check when you pick up the gun.0 -
It can't cross a state line directly to you. If you are a legal resident of SD then that's where you must pick up the gun in person. It can't be delivered across a state line.
If the SD dealer sends it to a ND dealer he can't sell it to you because you are a resident of SD and you can't buy a handgun in another state.0 -
i work in north dakota but i own a home in both north and south dakota. so i still have a south dakota license. i do plan on switching residence just haven't gotten around to it yet. i live in a small town and they only do license changes once in a great while. 0 -
According to this FAQ from the ATF website you can buy a handgun in either state.
(B12) May a person (who is not an alien) who resides in one State and owns property in another State purchase a handgun in either State? [Back]
If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a handgun in that State. However, simply owning property in another State does not qualify the person to purchase a handgun in that State.0 -

This is correct...but they don't give specifics as to what is required to establish dual residency...

They should say "if a person lives in both states for at least 3 to 6 months each" then you would at least have a requirement to meet.0
