    I know your neighbors are dumb asses. They should not have put the drive way there.
    But you are starting a civil war. You are going to put your new tenants right in the middle of it.

    Exactly.. Once a trespass , always a trespass.. They come on the property for any reason.. it is arrest city.

    I know the mentality.
    You should never have let it get personal.
    When he initially threatened you, you should have sworn out a warrant for assault and gotten a trespass order for this lot and your home lot. Maybe it's not too late.
    In Va the use of threatening profanity is actionable.
    These types need to go before a judge to temper their rash behavior.
    They need a lesson in private property rights and the judge, not you needs to give it to them.
    Then the next time, and you can bet there will be a next time, the judge will slam him (and his wife if she's involved) good.
    I had a similar, maybe worse, situation only my two paving contractor witnesses didn't show up in court.
    A little voice recorder might be handy when you visit the lot.
    I'd take the initiative on this.
    When you get materials and/or a prefab on the site it might comprise a tempting mischief opportunity for these critters. Prepare for it.

    Female Sheriff's Deputy was a hoot. I was actually on the tractor when the Deputy pulled up. She said I was doing the right thing. Looked at the survey and couldn't believe the guy was using my property.

    All of this is true. It will only escalate. Be prepared and document everything! Write down conversations,dates, take pictures, etc. I'm afraid you are going to need it. Speaking from experience.

    I actually did that when I sent the certified letter. Tenant said the place was for sale. It is a legal mess just like the other properties in the sub division. I got my deed cleaned up ( by the seller ). Others in subdivision have liens on them. Original builder filed bankruptsy.
