Bass Pro/Outdoor World-a gripe
Went into my local Bass Pro/Outdoor World today in Aurora, Co. Was on my motorcycle, coming back from playing pool out of town last nite, so I had my cue stick with me. Went in thru the gate, and about 10 feet past the entry, was jerked back by my shirt collar by the greeter, who said "Hold on there buddy". Appears he wanted to inspect my cue to make sure I wasnt stealing anything on the way in. My issue is in the being grabbed by the shirt collar and pulled back. He pulled hard enough to upset my balance for a second. General manager apologized profusely (altho somewhat unconvincingly), greeter argued that he only "tapped my shoulder". 2 customers spoke up that greeter did pull my shirt rather harshly. This is the 2nd time Ive had problems with rude bozos at BassPro shops. With the exception of a strongly worded letter to their corporate offices, I guarantee I wont have any more dealings with them again. I hate chain stores.

assault at the least Battery more likely. Assault is confrontational Battery they lay hands on you. I would call the cops and file charges and sue the store. They would settle and fire the idiot greeter.0 -
Battery Basics
In both criminal and civil law, a battery is the intentional touching of, or application of force to, the body of another person, in a harmful or offensive manner, and without consent. A battery is often confused with an assault, which is merely the act of threatening a battery, or of placing another in fear or apprehension of an impending and immediate battery. A battery is almost always preceded by an assault, which is why the terms are often used transitionally or combined, as in "assault and battery."
The Restatement (Second) of Torts, Sections 13 and 18, states that an actor commits a battery if he acts intentionally either to cause a harmful or offensive contact or to cause imminent apprehension of such a contact and a harmful or offensive contact actually occurs.
Criminal Battery
The difference between battery as a crime and battery as a civil tort is merely in the type of intent required. A criminal battery requires the presence of mens rea, or a criminal intent to do wrong, i.e., to cause a harmful or offensive contact. Accordingly, a defendant found guilty of the crime of battery is often sued by the defendant in a civil action for the same offense/incident.
Simple criminal battery is most often prosecuted as a misdemeanor. Repeat offenses or the specific nature of the offense may warrant more severe treatment. For example, in some states, a second or third offense against the same individual is a felony. In cases of domestic violence, many states do not permit battery charges to be dropped against the defendant, even at the request of the victim, because of the potential for repeat or escalated harm.
Most sexual crimes include elements of battery (since they are basically non-consensual contacts), and some states actually have penal codes listing the specific crime of "sexual battery."
Aggravated battery is a simple battery with an additional element of an aggravating factor. This is most often the addition of a weapon (whether use was real or merely threatened), and is almost always a felony offense. Other aggravated batteries include those committed against protected persons (children, the elderly or disabled, or governmental agents); those in which the victim suffers serious injury; or those occurring in a public transit vehicle or station, or school zone, or other protected place. These are all aggravating factors that will enhance simple misdemeanor batteries to the level of felonies.
Civil Battery (Tort)
A battery is an intentional tort. The elements to establish the tort of battery are the same as for criminal battery, excepting that criminal intent need not be present. For a tortious battery to occur, the requisite intent is merely to touch or make contact without consent. It need not be an intention to do wrong, and the wrongdoer need not intend to cause the particular harm that occurs.0 -
Sue him. He didnt have a right to touch you. You were doing nothing wrong, He could have said "Hey, Mister, hold on." Instead, he took it upon himself to physically touch you, in which you did not want.

As a Bass Pro employee I would like to say that you're right. It is against company policy to touch any person in that manner. If that guard was employed at my store he would have been released of his duties. It is the store policy to check any object that is brought into the store, but he could have gone about the situation in a different manner. In any business you will find that 1 out of every 50 people is a complete looser. There are 500 employees in my store, so by that ratio you might encounter 10 that are not useful. So when you're a company the size of Bass Pro you have to deal with the bad seeds once in a while. 0 -
...There would have been a confrontation on the spot! The BP I patronize is great, nothing like that jerk-off working there to my knowledge.

Timing is everything. If you knew battery like I know battery, I would have had the manager there pronto. And my indignation and screaming about a wrongful battery and a neck injury would have drawn a crowd. Then suggesting a visit to the doctor and chiropractor would be awful expensive before consulting with the local ambulance chaser, and greatly admiring a nice shotgun in the rack. And then gathering the names and phone numbers of any witnesses. I'd let them put two and two together. 0 -
Whatever you do [file charges etc...]; you must do it quickly or you will not have a good chance in court.
File for punitive damages [persons involved], and take the store to the cleaners (but make sure they dont lose your pants[8D]).0 -

Pickenup...yeah, its their Outdoor World store in commerce city. right off of n quebec and i 70. called northfield. basically another excuse to put macys, BP, nordstroms, and a ton of other fancy places in an otherwise unusable area in an attempt to make a cesspool like commerce city look attractive to out of towners. 0 -

Like you said, it's a cesspool anyway, no matter what stores they move into the area.
I keep hearing they are putting in a Cabela's down on I-70 and Youngsfield. First it's on, then it's off. Don't know for sure. We will see.0 -
That is a nice BPS. Cabelas is really going to have to do something big to out do them. I think that store has really hurt Gander MT off of 225 0
