    I was in a similar accident some years back...a lady rear ended us and pushed us into the car in front of us. She was liable.

    The peace of mind is that your insurance carrier stands in front of you in times like this. Call the insurance company and do not worry about liability. The various carriers involved will sort it all out and you ONLY need to be concerned about making sure your wife is OK.

    From your description of her injuries, it sounds like she got smacked by her air bag. Hope she gets well soon.

    Generally when someone is pushed into a vehicle ahead of them because they were hit from behind, the person causing the initial impact will be responsible for all the damage.

    Get the poor woman to a doctor and have her looked after because neck and back injuries can seem like minor aches and pains at first, but can quickly turn into major disabilities. Turn everything over to your insurance carrier, that is what you have been paying those premiums for all of these years.

    -Be careful here. Your insurance carrier is NOT your friend. Don't leave everything up to them.

    Your wife could be seriously injured and not realize it. She should immediately have a full MRI of her spine and head. Especially look for damage to the neck area and the L1/L2, L2/L3, L4/L5 vertabrae/disc materials.

    You should get an attorney and have the attorney deal with the matter.

    It has been my experience that the various parties will hold the car that hit them in the rear responsible for the various damages. Unless your wife can prove that she was completely stopped at the time the second car behind her struck the car that initially hit her, your insurance will be held liabel for damages to the car in front of her. But then I'm not a lawyer[8D]

    In California and state of Washington the last car to strike the car(s) is at fault. I was in a smilar three car bump and push (a few times[:D]).

    She being in the middle is just a victim going for a ride. Lawyer up and see the shister (I mean a barister[:D]).

    Speaking of neck pains I've been going to the neck and back breaker. And dude told me after I mentioned my neck was wonky a week after the last cracking session was scar tissue from accidents breaking loose (or he was covering his 6 since I did tell him I've been in numerous bummper cars). The last car accident was back in 2002 which was real bad. Funny how the body will cope. With that in mind sue for future medical. I didn't since I was fine (or at least I thought I was).

    Agreed! Anytime you're rear ended---that person just bought the wreck.

    A bit of advice, tho. Waiting for a settlement (for your vehicle) on a wreck can take a long time. If you are in need of replacing your vehicle without delay and you have collision insurance, tell your insurance agent that you want to collect, for your car, on your collision. You'll collect faster, to replace your car, and nothing will be held against you on your insurance since your insurance company will get repaid from the person at fault. Been there--done that!

    Just asking, but she may have been cited or even noted in the police report as following too close to the vehicle in front of her. If that is the case she may very well be liable for the vehicle/injuries in front of her. Get a copy of the police report and a lawyer.
