A possible law suit in the wings???????

In light of this new to be law:

Would it not be possible to sue over medical records being disclosed without a warrent signed by a judge or the patients written consent?????????

I am no lawyer but by looking this site over I say that the records cannot legally be turned over!

    did you read all that?

    I know I wont... Why do laws have to be 500 pages long at best... Why does it take teams of people, committees and a staff to review a law. If one man has to follow that law shouldn't it be legible by one man?

    Turned over to who and why? According to hipa laws no information
    about an individual's health may be disclosed to anyone except
    physicians and medical personnel directly related to the care of
    the patient unless given permission by the patient.

    Turned over to the government for the purpose of the new NCIC checks to determan if a person can own a gun!

    And if your statement above is correct then the VA cannot disclose the records of the veterans for the NCIC program!

    If the powers that be pass a "Law" that any person who is diagnosed as "Mentally unstable" be reported by the medical representative then they will be reported but I read it to say "Adjudicated" meaning declared by the court..????????????????????????

    I mentioned the same yesterday,.......this is gonna take some time to shake out.
    Court records are of "public record", so no issue with those being put in.
    I wondered about HIPPA myself in this scheme.
    I still don't have an easy feeling in my gut about this,.......at the very best, they have opened a door that will continue to swing!

    No medical records are public Bobski, if the powers that be want mental records on people and pass a "Law" then you can bet your bippy that those reports will be handed over be it the VA or Public Hospitals or private doctors and clinics.. Whether it is legal now or not is not the Question..The Question is , Will this new law compell institutions, VA, Private, Public, to report anyone that is diagnosed with mental illness, and as to what degree?

    Funny how the same politians that think The Patriot Act is terrible and are worried about the rights of those in Guantanamo, have no problem with this law.
