Somebody explain this to me?
Toby Keith's dad was killed years ago, when he crossed the median and crashed into a bus, head-on.
How the heck were the family able to sue and collect millions of dollars from the bus Co?
I got nothing against Toby Keith, or his family. BUT far as I'm concerned this is what's wrong with are motor vehicle insurance system. This is why are premiums are so astronomical. Instead of suing the goober who caused the accident that killed their dad, they sued the bus company and got millions of bucks.
A pox on all the freaken blood-sucken lawyers who put them up to this.

Toby Keith, his mother and his siblings have been awarded $2.8 million in damages in the 2001 collision that killed the country music star's father.
A jury returned the verdict against Elias Rodriguez and Pedro Rodriguez, operators of Rodriguez Transportes of Tulsa, and the Republic Western Insurance Co.
According to evidence presented at trial, a charter bus owned by the Rodriguezes was "in urgent need" of brake repairs before H.K. Covel was killed in the March 2001 accident on Interstate 35, said attorney Greg Dixon, who represented Keith's family. The Rodriguezes had been advised of the brake problem before Covel's truck crossed the center median and struck the bus, he said.
The family initially suspected Covel suffered a medical condition that caused the truck to veer out of control. It later learned another vehicle had bumped the truck and filed a wrongful death lawsuit to clear Covel's name, Dixon said.
The verdict was returned last week. "The jury found no fault on the part of Mr. Covel in the wreck that claimed his life," Dixon said.
The plaintiffs, wife Carolyn Covel, daughter Tonni Covel and sons Toby Keith Covel and Tracey Covel, alleged that H.K. Covel would not have died if the bus had been equipped with properly working air brakes.

Its the same old thing, you can sue anyone for anything...right or wrong. If the bus' brakes were truly bad, then I guess they had a case. 0 -

If the brakes were that bad by DOT regulations it should not have been on the road! So there for if it had not been on the road it would not have killed him!
DOT regs are very strick on brakes! Expecially on buses!0 -
the story also says a vehicle bumped him and sent him over the median, to me it would be that persons fault, but then again the bus company HAS THE MONEY. regardless of the brake on the bus, in situations like this good or bad brakes its a 50/50 chance living or not. Also being Toby Kieths father his name i'm sure played a part in the case. 0 -
Some guy crosses the median and crashes head-on into a bus going down the interstate at 60+ mph. It wouldn't make a bit of difference if the brakes were perfect. The results would still be the same. 0 -

Again the bus should not have been on the road!
Comercial DOT regs are very strict on this expecially on buses!
It make matters worse to show either that the driver knew of this problem or did not do a pretrip inspection (which it had to be one or the other)!
If there is a mechanical problem on any comercial viechle the company is most assured to lose a law suit!0 -
How can you win a lawsuit like this? Easy. Find 12 men that feel "we oughta do something for that family" and get them on the jury. As far as "the bus should not have been there"- if you are ever involved in a traffic accident in Saudi Arabia, you will find that same logic- namely, if you had stayed in the US, you would not have been there. And would everyone please get out pen and checkbook- yeah, your insurance rates WILL rise to cover this- and thousands more like them. PS if the jury wants to "do something for that family", might I suggest they take up a collection IN THE JURY ROOM? 0 -
It has come to be that "victims" are never held accountable. Everytime there is a "tragedy" someone else must be found to be at fault and those at fault must pay.
Similar thinking in that violent criminals are not to blame because of racism, povety, etc. they are also "victims".0 -

I understand that. I am sitting on a class a cdl right now with a haz mat endorsement. At least I will be until my next dot physical is due. [:(] Not that it matters, as I haven't driven a truck since 1996. But my question is still the same. Yep, the bus had bad brakes. OK. Ticket the driver, cite the company. But Keith's dad CROSSED the center line, left his lane of travel, and HIT the bus. Looks like he should bear some, if not most or ALL, of the responsiblity also. At least in a common sense world, he would have.0 -
