However, they drilled one real close to my house just like that one, and while it was far enough away feet-wise (abput 600ft.) to not need my permission to drill, they gave me $4000, aside from damages payment, as a "inconveinence" payment. Told me it was to rent a hotel while they were drilling. It didn't sound too loud after that.[;)]

We leased part of our property last spring.The oil guys are back wanting the rest of the place.Hope to see a rig like that soon.The sound and smell ain`t so bad when it`s your oil they`re drilling for. 0 -

If you HAVE mineral rights and your property is in the section they are drilling then you get paid a percentage based on how much land you have in the section. No mineral rights, no money, unless they are drilling on your land then you'll get damages.
You don't have to sell the mineral rights when you sell the land. The mineral rights were sold off our land back in the 70's by the then owner for something like $15,000. he needed the cash and at the time the production had died around here. If we had full mineral rights on this place right now we'd be pocketing between 1-2 Million a month.[:0] As it is someone in Texas is sitting on their porch getting rich off the mineral rights here that were sold way back when.
Lesson: Always get the mineral rights when you buy land...you never know.

Mineral rights for Oil, Natural gas and Coal can be bought for pennies on the dollar here in WV through the State Auditor's office Delinquent Land Properties. They are tons of minerals rights that are delinquent.

Pick any County and then under Status choose "No Bid". Tons of Mineral (Min) rights up for the taking. My brother and I snatched up 350 acres of coal rights for less than $2500.00.0 -

Speaking of gas production here, don't know if it's the same with oil...would think so though. It doesn't matter who owns the land the drilling rig is on, if you have mineral rights you get paid a percentage of all the gas production in that SECTION based on how many acres of land you own in that section. They can set up on "Bob" your next door neighbors property and directional drill right under your house and you still get paid. No stealing going on. Although we don't have mineral rights, we do have a small "overide" percentage of gas production that did come with the property that the original owner kept, like a .0018% or something like that. 3 different sections come together on our property. We get paid for numerous wells off our property. Some of the wells will be in a section that we might only have 10-20 acres and we don't get much, others are in sections we have several hundred acres in and we get more of a percentage. I assume oil is the same way, but don't know for sure. no oil production around here.

Ben - the "stealing" of the oil is not true. If you don't own mineral rights - you don't own the oil. the person that has the mineral rights owns the oil/gas. It is his - if he can get it out. If he can't, he leases to someone who can and is paid a royality on what is produced. When you buy your property, you should know if you have minerals or not. Just because you own the surface doesn't mean you own the mineral rights.
When a well is drilled a directional survey is run to determine the BHL (bottom hole location) and/or well bore path. It must be filed with the state and/or feds - who in turn check to verify who has the lease and where the BHL is with respect to lease and unit boundaries. About as close to a lease line as you can get (without special permission from adjoining mineral interest owners and the state/feds) is 330'. Some are considerably further away. Direction companies are third party contractors. Get to close to your lease line and you have big problems. These rules were established to prevent the stealing of minerals. Units can be drawn about any way a company wants to draw them. Even when a hole is drilled next to your property, if it is 330' or 467' from the lease line, they do not have to include your property if they have enough acreage leased without it. You must have leased at least the minimum acreage required by the state to receive a permit to drill.
Damages and/or rentals are usually paid to surface owners. Field rules dictate what size spacing is required for each oil/gas unit - and they vary greatly - especially when a horizontal well with a long lateral is drilled.0 -
