HAMLIN - A Hamlin town police officer was on administrative leave this week after being charged in two sex-related cases.
Hamlin Mayor Brian Barrett confirmed Monday afternoon, August 6, that Town Policeman J.D. Scites, 20, of West Hamlin is on paid administrative leave pending the outcome of the charges against him. Barrett said he took the action after receiving information from law enforcement personnel regarding Scites.
Until contacted by a reporter, Barrett said he was not aware that Scites was formally charged Friday, August 3, with a felony in connection with one of the alleged incidents. "Nobody told me he had been charged," Barrett said. "I'll go to the courthouse and get a copy of the charges."
Scites was charged by Corporal J.M. Pardee of the Huntington Detachment of the West Virginia State Police with committing the crimes. According to Corporal B.M. Greenlee of the Hamlin State Police Detachment, the Hamlin detachment asked the Huntington detachment to assume the investigation because Hamlin state police often work directly with municipal officers in their jurisdiction.
Scites was arrested Friday and appeared before Special Lincoln County Magistrate Joey Kohari, who is sitting in for Magistrate Helen McCormick. McCormick is off work due to health concerns.
In the criminal complaints filed in the case, Scites is first charged with an alleged incident from April of this year.
The complaint maintains that Scites "did unlawfully and feloniously engage in sexual intercourse or sexual intrusion with another person who is less than 16 years old and who is at least four years younger than the defendant."
In the narrative on this charge, Pardee wrote that he "spoke with the victim, a 14-year-old female. She stated she had sexual intercourse with the defendant in the woods near the Lincoln County Board of Education."
Pardee wrote that he later spoke with Scites, who confirmed that he "did have sexual intercourse with the victim."
Pardee said the victim told Scites her age.
David Moye, a Hurricane attorney, is representing Scites in the matter.
Bond on the first charge was set at $10,000 and was posted so that Scites was released Friday.
Scites acknowledged, on a form prepared for the purpose, that he knew the penalty, if convicted, is one to five years in jail and/or up to a $10,000 fine.
The second count alleges that Scites "did unlawfully engage in sexual penetration or sexual intrusion with another person who is under the age of 16 and is four years younger than the defendant."
The criminal complaint says Pardee spoke with the alleged victim, a 15-year-old female. "She stated she had sexual contact with the defendant in his vehicle on Buffalo Creek Road," Pardee wrote.
Pardee continued, "The defendant admitted to this officer to the digital penetration of the victim's vagina."
Again, the victim said she told Scites her age.
Barrett said he believed Scites was continuing to work as a truck driver for a private company, a position he held while he was serving as a town policeman.
The mayor said he had "no plans" to bring the matter up during a regularly scheduled meeting of town council Monday evening.
"We will probably have to let the case take its course," he said.

I was unaware that West Hamlin even had a police force. I thought they had a ticket writing constable. Maybe Hamlin annexed them. Although that little "hill" between them tends to make that unlikely. The county used to have just one judge. I liked the area (rural)and at one time thought of buying land there but didn't like the drinking water. (especially the water that burned) If a Statie gets in disfavor thats one of the areas they'll assign him to. Thats the area where the Restaurant owner shot up the courtroom trying to kill the guys that raped and killed her daughter and grandaughter a few years back! (sadly she missed)
Wonder if his daddy is the one that the kids call "oneshot"?
Milton (different county but fairly close) had a rather large police officer at one time with an odious reputation that they called "Big John" that somehow "allegedly" managed to get his stun gun tangled up in the swivel seat at the DQ and zapped hisself. Right after school let out. The place was filled with high school kids that were shall we say "delighted",They cheered him while he fried.
If you guys don't think the "boys" from lincoln county are tough....one of em done went and broke the sound barrier! [:0] [:D]
LEO's You really don't want to take up for these small town types that only have their position because of family ties. "clown" don't really describe them. Most town's in WV require that their officers graduate from the State Police Academy before hireing them fulltime. But some just pin a badge on the mayors nephew and let the chips fall where they may.

And there are others.It states 19 is the minimum age to apply, not actually hit the road as a Trooper. By the time all the application procedures are completed, state standards for peace officer licensing are met and FHP specific training are completed they'll be 21.
