CASSELBERRY -- (AP) -- A police officer has sued the family of a 1-year-old boy who nearly drowned because she slipped and injured a knee responding to their 911 rescue call.
The young boy, Joey Cosmillo, fell into the family pool in January. He was resuscitated but suffered brain damage and now cannot walk, talk or swallow. He lives in a nursing home and eats and breathes through tubes.
Casselberry police Sgt. Andrea Eichhorn alleges the boy's family left a puddle of water on the floor, causing her fall during the rescue efforts. She broke her knee and missed two months of work.
''The loss we've suffered, and she's seeking money?'' said Richard Cosmillo, 69, the boy's grandfather, who lived in the home with his wife and the boy's mother. ``Of course there's going to be water in the house. He was sopping wet when we brought him in.''
Eichhorn's personnel file includes numerous commendations. The 12-year veteran has worked as a hostage negotiator and prostitution decoy, and even wrestled razors away from a suicidal person.
Eichhorn's attorney, David Heil, said she now has persistent knee pain and will likely develop arthritis. He said city benefits paid by workers' compensation and some disability checks helped with medical bills, but it wasn't enough. The lawsuit seeks unspecified damages.
''It's a situation where the Cosmillos have caused these problems, brought them on themselves, then tried to play the victim,'' Heil said.
Police Chief John Pavlis said Eichhorn was a good officer, though he urged her not to sue.

Something's terribly wrong here.
The family should sue the city for sending a cop instead of an ambulance and EMTs to resuscitate a drowned kid.
They should further sue the city for sending a cop that didn't know water would be involved in a situation with a drowned kid.

So if somebody breaks into my home and I call 911 (In reality I shoot the SOB, then call 911) and the police show up and the intruder shoots a cop, then I could be held responsible? This could set a very bad precident if it gets anywhere. 0 -

Good point. How about responding to a bank robbery? Officer wounded and lawyers know banks have DEEEEEEEP pockets. Poor officer was just trying to protect banks assets so hears the jury.
A practical view is that the job could be hazardous and if not willing to assume the risks, seek employment elsewhere. Regardless of the outcome, it brings discredit to the profession and she should be dismissed.0 -

ok.. so I reserved comment until I was able to do a bit of searching and reading.
Seems the citys insurance paid her medical bills and disability, but she feels it's not enough. If her medical bills had not all been paid and she was "forced" to go after the homeowners insurance to cover the bills... well that I could understand. Going into a job where you have a high probabilty of being hurt and sueing when it happens just for some extra cash.. well that's pretty damn low.0 -

What a low life she is for inflicting these legal problems on this family.
By the way, I heard on the news today that she hurt herself WHILE Paramedics were treating the child. In other words, she was just a glorified bystander at the time of the injury.
As for suing the family's home insurance company, if she should collect, this will inflict further hardship on the family. They will be dumped by their insurance company, and have their rates raised considerably by a new company.0 -
