speeding ticket question
If I appear for my court date, and the citing LEO does not, can I get it dismissed if I plead not guilty?

The first thing I do when stopped is get loud and then ask for the officers name and badge number. Scares the crap out of them. Don 0 -
Is this you?

The judge can also set another date to give the officer time to respond...
That's what will happen. They don't want to lose the revenue.
Just plead guilty(your not going to win anyway)and pay the fine.
It's cheaper than paying the fine and court costs too. As already mentioned.0 -

"No problem, sir. I'll even write it down for you. Oh, be sure and press hard, you're making three copies." [:D]0 -

-Okay, people. This old stuff about "don't break the law and you don't have anything to worry about!" Or, how about, "If you are going one mile over the speed limit, you are breaking the law and you deserve a ticket!" Boy are you guys brainwashed or what!! Come on!
Speeding tickets are handed out to generate money for the local government entity and for no other reason. Period. Just like freaking building permit fees. There's NO legitimate reason to have to pay outrageously high permit fees to build a house. It's backwards. Government is supposed to be there to serve the citizens, not the other way around.
To answer your question: If the officer does not show up, ask the judge to dismiss the case. If the judge says something like, "Well, let's just take the next case or two and see if he shows up.", you should say something like, "Respectfully, your honor, if it were me who didn't show up and the officer were here, I would lose the case. The officer has a responsibility to be here, regardless of his other police duties. I respectfully request that you dismiss this case." If he doesn't you'll just have to wait, but you have a basis for appeal. Also, if they surprise you with a cd of the car camera and radar, tell the judge, "Respectfully, your honor, I was not aware that the officer had this cd and was bringing it to court as evidence against me. I respectfully request that you postpone this hearing until two weeks from now and give me a copy of the cd and the software so that I may review it and be prepared for the hearing. If that happens, email me and I will give you a defense strategy.0 -
Well i know here in SC you can ask or they may throw it out completely if the cop is a no show. Also if its like SC, the cops actually have two or three days a month just for court for the tickets/citations they pass out so don't count on the cop missing a court date if your police departments are set up the same 0 -

I think that little cop car signature is the best I've seen yet! [:D]0 -

Just pay the fine, you know that you are guilty. I have many tickets and I have paid them all. I'm just glad that the officer didn't see what I was doing before he caught me[;)]
There was one time I was in a top end race against a guy in a F-355, we were maxing out in the 170MPH range, after the other guy broke off I slowed down to 85MPH and was stopped for speeding. I gladly paid that fine, $200 is far better than jail.
Bryant.... What the hell do you drive that goes 170 MPH?0 -
I don't anymore[;)]
It was a '76 Camaro that was built for top end racing. It was areodynamicly limited to 180, but she could have pulled 10 more with better areo. The heart of the beast was a 383 Chevy that was making 550 HP at 8000 rpm. Third gear at 100mph and she was only turning 2000 rpm. I actually drove that car to work everyday till I melted the heads. She has been sitting since 1995, I keep looking at building her again and doing it right this time, but it would take $60 to $80,000 to get it done. How can I possably do that when I'm setting up to shoot 3 gun?[:D]0 -
Hire a lawyer. Youre gonna have to pay someone off, might as well be him/her. Better than having the insurance bloodsuckers adding to your financial drain. 0
