Lubbock, Texas -- A Lubbock County grand jury on Tuesday declined to indict the store clerk who gunned down a suspected robber.
The clerk fatally shot Jesse Jermane Pearson in November after chasing him from the scene of a robbery, investigators said. Pearson, 32, is suspected of using a knife to rob the Carl's Corner store at 98th street and Martin Luther King Jr. Boulevard. Pearson left the store and fled in his car.
The clerk chased Pearson north on MLK, where Pearson's vehicle broke down near the intersection of U.S. 84 and MLK. As Pearson left his vehicle and tried to carjack the vehicle, the clerk opened fire, killing Pearson.
When officers arrived, they found Pearson inside the clerk's vehicle.
The shooting was investigated as a homicide and was presented to the grand jury Tuesday. The grand jury decided not to indict the clerk.
However, this shooting was not the clerk's first run in with the law.
According to court records, the clerk was released from the Lubbock County Jail on Oct. 10, following a May 2006 arrest for an aggravated assault charge that was downgraded to assault.
According to a police report, the clerk had pointed a handgun at his father following an argument with his mother. The father said when he came out of the garage and saw the clerk pointing the gun at him, he knew his son was "fixing to shoot" him. While the clerk was not paying attention, his brother tackled him to the ground and his father picked the gun up and hid it. The clerk was arrested by Slaton police, according to a police report.
The clerk also was arrested by Lubbock police in June of 2006 following an incident during which a passenger in the car he was driving pulled a handgun on a teenage couple in a car next to theirs. According to a police report, "numerous handguns and ammunition were located in the vehicle" the clerk was driving. The clerk and another man were both charged with aggravated assault and unlawful possession of weapons.
