i dunno...she turns 18 in less than a month and can legally do what she pleases. i just hope she can hold out that long.

The legal process will take longer than a month. There has to be a reason and the child must be in a position to provide for themself.

The legal age in most states for emancipation is 18, unless otherwise ordered by a court. At the emancipation age one can do as they please. From what I understand it is used mostly in child support cases by parents paying child suppport so when they get 18 the suppport stops unless the court orders further payments while child is still in school..

Bottom line is when they turn 18, your control has stopped if they decide they dont want it anymore...[:(]

oh..yeah, you probably want more of the story...sorry about that.

Crystal has been in the Bahamas all week on vacation with her family, which has a couple of real a-holes in it. her cousin is in a bit of dire straits. her dad's wife refuses to acknowledge she exists and has blatantly said she wants nothing to do with her. her dad told her as they were leaving for the bahamas that when they get back he wants her out. he berates her and if she does anything to which he disapproves, then she gets the belt.
she lives part time with her alcoholic and abusive mother. she sleeps in fear of her mom because she too will raise hands against her when she's drunk, which is nearly all the time.
from what crystal tells me, her cousin has lost a lot of weight and has taken to...self abuse and other mechanisms to cope with everything.
she's a good kid. works 2 jobs, goes to school with straight A's and is very intellegent. she deserves a lot better than she is getting and we want to help by taking her in. i knew things were hard on her, but i didn't know how bad until crystal told me that her cousin was given a pistol by a friend in case something should happen. she sleeps with it under her pillow. i don't know what pistol it is and it doesn't matter...she's 17 and has a gun to protect herself from her own family.
we have no way to help her until she's 18 and even then it's gonna cause a stink with crystal's family. we need to save this girl before anything happens. what should we do?

Wouldn't that be one of the last concerns in this situation?

I'd start by talking to a lawyer.

She is not 18 yet, notify child protective services, or you can enter an injunction against the parents yourself providing you have proof and not just hearsay..I have heard many teens complain of the deplorable conditions they have to live under only to find that there is much overexaggeration. If you know the situation to be a fact, you can ask the court to step in..

can't afford an attorney and the girls dad seems like a nutjob enough to drive from CT to OH just to cause trouble.

all of his kids live as far away from them as they could get. she the last and has caught the brunt of it.

overexagration with this family isn't really a problem. I have seen them in action. they are extremely competitive and have even gotten into fist fights with each other over who won a game of horseshoes.

You dont need a lawyer,, go to child protection and file a complaint,, it is totaly anonomous if you want it to be. Petitioning the court does not require a lawyer..

I made the mistake of using a lawyer one time and he managed to get me screwed..

as far as i know, she turns 18 just before thanksgiving. if she can hold on until then, we'd go up to get her and bring her back to live with us. i think, once she's out of there, what my concerns will be is with the family and repercussions it might cause us. we don't want to get into a family war, but we just can't sit back and let anything happen to her cousin.

Take her in. Seems like the parents wouldnt care anyway. If the parents come to your property, call the police...........

Tell her to run away and let her live with you. If and when the cops come, she can tell them why she left and get family services involved and be out of the house legally then without you doing anything. I don't see how you could be charged with anything, all you did was take in a homeless kid. I would imagine the rest of the her family would say nothing.

Sorry if everyone thinks this is too simple.

Emancipation varies per state and some on education.
For example, in Oklahoma, a child turns 18 and is no longer in school, is emancipated. It can go to 21 if the child has not graduated high school and is still enrolled in high school.
You will need to check you state laws.

What part of Crystals family lives near you? if one of the grandparents ar close, they would have a better possibility of getting her to your area, lies are good sometimes, like "grandmas sick, can you come help take care of her".
You might want to take caution aiding her across / to cross state lines without one of the parents written consent.
    CYA.
    Another thing:

This is one of the chinese symbols for trouble, it represents 2 women under 1 roof.

Sounds like a great kid, do whatever you can to help her out. You will reap great rewards for being a blessing and protector to her.....

being that it is her dad's brother and niece, and all but one brother still live within the same state...very unlikely they'd help. crystal's dad lives in philly, but he's gone for weeks at a time due to his job, and the uncle that might help lives in doug wilsons neck of the woods. grandma is the ringleader of their family circus. they all look at her booze hound wrinkly bonebag visage as a saint and do whatever she commands. crystal's half sister lives close by and has offered her a place to escape as needed, but not on a longer term basis. she was just diagnosed with MD and really couldn't help as much as she wants too.
her dad would cause trouble just cuz he could. he knows we dodn't make even half of his salary. almost all of them are vindictive.

as for the 2 women under 1 roof...i already have crystal and my big sister living with me, plus 4 cats, 4 ferrets, and 2 dogs......

Sounds like the 1/2 sis needs some live in help, we're just looking for a means to get her to your area.[8D]

Kill it, bury it, lie about it, then do a television special called "BigFootaZilla" (or maybe "Sasquatchazilla")....make millions.

Be very careful about taking a "minor" across state lines.

anyone know anything about emancipating a minor?

Relative to other options you have it is very expensive. The court will want to be certain the minor would be able to take care of herself and it would take too long.

If her father said "...that when they get back he wants her out" and her mother is busy being drunk, then loan her enough money to live with a roommate for a couple of months. She would be removed from mom and dad but still be able to keep her jobs and stay at the same school.
