Stolen Honda 3 wheeler recovery
A guy I work with had his Honda 3 wheeler stolen a few months ago. We figured he would never see it again. Wednesday someone spotted it in the back of a truck. Working with the description of the truck, and the route it was traveling, we found the machine. The police were called and the machine was recovered. The person who had it claimed to have bought it from someone who had it dismantled and most of the parts were in a box. The info was sent to the prosecutors office. The condition of this Honda is now very poor. The new axle is bent, the new exhaust is badly dented nad numerous other parts are missing or damaged beyond repair. When he bought this 3 wheeler he went completely through it and put about 1,000 dollars in parts in it along with an enormous amount of time. My question is, can any court action be taken against the perpetrator to recover his loses. The blue book price could never reflect the true value of this machine. If the thief ends up being a minor, would his parents be responsible for this damage. Thank you for all replies.

You're going to have to find someone to sue and then prove it in court.
If you can do the first two things, what are the odds the person being sued will have the money?0 -
Small claims court would work. 0 -
Get a lawyer and take them to small claims court. I had to go there once to get about six thousand dollars from a guy. The lawyer cost me $500 and I won. The guy didn't have the money to pay me, so I had to go to the sheriff and the sheriff told the guy that if he didn't pay they would come into his house basically hold an auction of his stuff until they got enough money to pay me back. Anyway, he ended up borrowing the money from a friend to pay me. Now it's his friend's problem. [:D]
Also, don't be surprised if the people you are taking to court keep getting the date pushed back further and further due to a streak of family members suddenly dying or some other lie like that. The jerk I took to court got the whole thing delayed by a few months at a time. Each time the date was near, he would call with some excuse as to why he couldn't go.
I hope your friend wins.0
