Another C&R Question
I am applying for mine and was just currious.
Can you use your C&R to purchase a C&R eligable gun as a gift for a family member?
I know it is legal to do under normal routes without being considered a straw purchase. But would it change useing your C&R?

Why is the rifle reflected in item below C&R eligible? Normally C&R, but it's been tapped. My understanding is that any gun tapped the owner must show evidence the tap was 50 or more years ago unless it is original & C&R. Comments please.

I Looked at the C&R list on the BATF Web Site for a particular model of a Revolver and it was not listed. Since this Model was last made in 1950 can it be shipped to a C&R holder since it has not been manufactured in over 50 years? 0 -
No. The C&R is for personal collecting only. A C&R holder is not a dealer or a transfer agent. 0 -
...You can't order/buy a firearm for someone with your C & R, as Sax said, an 03 does not give you the priveldge to conduct business in firearms.
...That said you can use your 03 to purchase a firearm(s) and then give or sale that firearm(s) to whomever you please, you just have to log it out of your bound book. An 03 allows you to thin out your collection as you see fit which enables you to enhance your collection. There is no rule saying you cannot sale or give as a gift any firearm(s) you purchase with an 03.
...You just can't "take an order" for a gun for someone, that's considered "dealing in firearms" which is prohibited under an 03...[;)]

Both saxonpig and Colt gave an excellent answer.
The key is intent. You can not buy a C&R firearm with the intent that it is going to be a gift or you are going to sell it. But like Colt said you can do whatever you want with any you allready own.
I know it is confusing, but let me you use a couple examples. Lets say you collect M1 Garands and allready own several. You pick up another at a gunshow that is in better condition of one you allready own, so you decide to sell/give one away from you collection. That is perfectly fine.
Now lets say you see AIM is selling Yugo SKS for say 150 dollars, but if you buy 3, they are only 120 dollars each. You know your brother is also interested in one, but dosen't have a C&R, and you think the neighbor might be interested in one also, so you get the 3'fer planning on selling/giving the other 2 away to your brother or neighbor. This is not legal.
