I feel for your adopted son. Domestic voilence laws and how the police handle them is out of control.

    That is my worst nightmare.

Time for some major azz-kissing until things blow over. He doesn't need a domestic violence charge hanging over him, given the information presented. This is not legal advice, just common sense.

the cop sounde a little sick when he called, said he couldnt believe what was going on, but would have to come see him.
did make some comment to the effect that "you cant drag someone around, it's not cave-man days"

By the same token..you can't hold someone captive!! Maybe his best bet would've been to call the police himself.

In Va. any Domestic situation between family members or someone who lives with you shall be taken to jail if there is a cut, scratch, bruise or any sign of assault. If both parties have visable injury both must be taken to jail.

I cannot believe she would try this kind of mess. Whatever you do....don't let that nut job put a restraining order on him OR let domestic violence charges. I would definately get your own lawyer to at least scare the crap out of her. Maybe it seems like it will cost a fortune....but to hire a lawyer and make it at least seem like you are willing to spend all the time and money it takes to give her heck might be worth it. You could have her thinking that you are going to take her child away from her....put her in a mental institute....drag her to court where she will have to pay a ton of her own money to her own lawyer. Beat her to it.....scare her to death and maybe....just maybe she will be thankful that ALONE is all you want in the end. Some people are nut jobs.....sorry.

    I'm Hannibal Smith,
    and you've just found the A-Team [:D]

    unfortunately I'm just kidding,
I don't know what kind of advice to give you, similar BS happened to a VERY close friend of mine and he has a BS "sex offender" entry on his record now [:(!]
Only highly illegal ideas are coming to mind currently

Been there. Got aressted for D-V for accidentally stepping on wifes (now ex) toe. Judges are usually reasonable people. In my case the judge dismissed the charge.
Your son is in a bad spot. He should get out now, or believe me she'll have him thrown in jail again and again.
But expect a fierce child custody/visitation battle. In fact, don't expect to see the child much if at all. Fathers rights don't mean squat.
I went thru YEARS of denied visitation, take her to court, she gets verbal slap on wrist, does it again.
    The heartache is just beginning.

Get the best lawyer you can afford and fight the DV charge to the end.

A conviction on this and say "bye-bye" to guns.

o.k. for quite a while we didnt see much of him because of her, so i can now add to the history a bit.
she had previously tried to get a pfa and it was denied, the cop that night said the only mark was a reddening of the skin on one ankle, but she was claiming he "dragged me around the apartment".
cop also added that she was acting like a real drama queen tho that would be just his personal take and doesnt help much (but she really IS just that.
she has also threatened several times to return to indiana and not allow him to see his daughter, and to fill the child with propaganda so she will "hate his guts and never want to see him" when she doesnt get her way.
also refuses to get any kind of job

i also told him that if he gets to plea his side to point out that he is currently re-couperating from foot surgery. tho he is able to walk, the pain involved pulling that kind of weight any distance would be nearly impossible (she is a big girl)
also as someone else noted, if he had drug her so far, where are the rug burns on her butt, arms etc.?
also his mother went to collect his clothes and the shotgun, before she has time to remember it and make any kind of weapons threat claim
since it was a late night call there was an emergency pfa granted untill monday, we are hopeing that the physical evidence along with her earlier denial of a pfa will go a long way to get whatever judge gets it to throw this one out as well
and also hopeing that this time will wake him up to get rid of her for good
