Get the idiot's ID and record the information on it. Call the local PD or SO and run the serial number, assuming it still has one, through NCIC. If it's clear, offer the idiot a choice.

Of course, in its present configuration, it's the barrel that is the problem. If it can be easily removed, toss it and you have a usable SKS receiver.
Then, you can pay the idiot for the parts.
I have had two Smith & Wesson revolvers with obliterated serial numbers come into my possession over the years. In each case, I kept the parts and destroyed the frames.
I was at a gun show one day when a fellow walked up with a Mossberg pump shotgun that had been sawed off too short. When he showed it to me, I removed the barrel and told him not to re-install it. I advised him to put the barrel in a vise and mash it flat. He didn't want to sell it for what I wanted to pay for a Mossberg w/o barrel, so he walked away with his gun in pieces.

Being a cop you have no choice (?) but to seize the weapon and take the person into custody. To do otherwise would be failing to uphold the law since you are a sworn officer of the court.
For non-cop FFL's it would be an unlawful seizure regardless of the legality of the item. It would set a FFL up for a host of problems to determine legality. Example; How many FFL's are not aware that weapons made before '68 were not required to even have serial numbers if they were originally made without one?
How many FFL's that sell on Gunbroker screw up buying and selling to non-licencees? Many are afraid to accept shippment from a non-licencee even though it's perfectly legal to do so. Not all FFL's are Einsteins and to start seizing things that may or may not be legal is just wrong.
"Hey buddy, you can't have that stock on that Broomhandle Mauser, it makes it a short barrelled rifle. I'm gonna seize it".

Being a cop has little or nothing to do with it. The gun owner may be terribly ignorant, but he is committing a felony in your presence. In that case, in Texas anyway, anyone can make an arrest.
I mignt give the idiot the benefit of the doubt and reduce the gun to legal components, or I might turn him over to the police, but the gun would not leave the shop with him.0 -

Three times in my life I've had people show me illegal fully auto rifles they had. I don't know what made them think that that I wanted to know about these things but I certainly didn't. BTW- These folks were casual acquaintances whose names I can't even recall now, and all this happened about 25 years ago.
I'm not a cop so I don't try to enforce the law. But I don't want to have someone involve me in their crimes, either.
I didn't see anyone ask this, but did you actually measure the gun? Some rifles can look to be cut back quite a bit and still maintain a 16" barrel and a 26" overall length. Although that barrel looks awfully short.0 -
At the end of the day....the store still has its windows...you know, the giant glass that just aches to be broken by idiots who are mad at you.
I don't like the gun laws we all have to abide by. These guys come in from time to time and most have shotguns that are too short, not many rifles though. I haven't had many illegal guns to deal with.
The ONE AND ONLY time I did call the ATF was over a belt fed machine gun that had gotten mistakenly given to us by someone who called themselves a "gunsmith."
I don't plan on ever being a person to take a gun away from anyone who owns it. If they want to part with it for what I offer in parts (never will I need the parts of an SKS like this one) then I will buy what I can....but I just try to let them know exactly how bad it is...and hope they trust what I am telling them to be correct.
I have a large following as a friendly store and I try to be that way with EVERYONE....even the thugs...who don't know any better. We all need to learn these things from someone.0 -
This thread reminds me of the time I had a guy ask what a case M-67 grenades was worth. If he hadn't have done it in front of the whole roofing crew I might have looked into it for him but as it was I just let it slide. 0
