My TWO bad Colt auctions and what GBroker suggests
You all remember the 1911....and how I got it back with a scratch. Recently we all know I have had a Colt Python that had been messed up pretty bad by someone on the recieving end of the transaction. This is pretty rare that an auction goes in this direction. In the years I have been doing this I have only had these two.
Since I have pretty well documented my guns condition in both cases they have suggested how I can "complete" these transactions is to re-list the guns and give the buyers a refund (minus my fees.) I agree that this would be fair.....but what if they don't agree? What kink of situation are we in here? I was just wondering just WHAT can this lead to.
I don't see where there can be any legal action taken against ME...when there is a third party involved (their FFL transfer dealers?) Just how long should I wait before I re-list the Python? I just got it back....I have been holding onto the 1911 for many months now. Both of these are similar and could happen to any of us selling guns on line.
I am just interrested in knowing the legalities of this situation. I seem to be holding all of the cards....and could be a real "bad guy" if I wanted to....but I want to be fair without being taken advantage of.

My qestion....
If I sell a gun on line....and it has to go to an FFL to be recieved by the buyer....when they get the gun it has been damaged....how responsible am I??? The only thing I can see that will be "fair" is to re-list the gun and settle up with the people who returned the guns to me......but what if they don't want to accept this agreement? Is there something THEY can do to ME even though there is a third party who actually recieved the gun from me?
What is the legal standing on sales and law suits concerning out of state sales? Wouldn't they have to sue the dealers who recieved the guns....I have NO IDEA what could happen.
Another question about transfers.....completely off track.....since I am supposed to keep a used gun 15 days before selling it, and the internet transfers come into my store as "used guns" most of the time....are we supposed to keep these guns for 15 days before transferring them? I haven't a clue on THAT ONE either.0 -
Well I will be the fallguy... I dropped my S&W 29-2 off the top shelf of the safe a few months back... It fell directly on the lip at the bottom and cut the right grip DEEP. I was sick. However it was my fault and only my fault. You buyer of the Python left you nice feedback on the transaction immediately after receiving the gun. If I were in your shoes I would have a 3rd party sell the gun.. at auction or fair market value being appraised by a competent FFL COLT DEALER and send the buyer that amount of money. Done deal. If they don't like it I will discuss it to another third party called a JUDGE in small claims court. Fair is Fair. 0 -

We all have this happen , not too often. I would ask your buyer what he wants to do. Third party, relist, etc. and go forward from there. 0 -

If the gun is in good shape when you leave it with the shipper, your responsibility ends then and there.0 -

If you agree to relist it, under the law it might be construed as an admission on your part that you knew it was damaged. In other words, you may be giving the buyer a legal avenue in which to sue you. An win!
Like zip posted...no good deed goes unpunished. You are doing a good thing if you relist but may be punished in the end. I'd at least get an acknowledgement (in writing) from the buyer stating he'll hold you harmless once the item is re-sold.

Since the item was not returned in the same condition that it left in and your pictures are well above average in terms of documenting the lack of damage. We agree that if you resell the item and refund the original buyers that amount (minus your fees, shipping etc) that we will consider the matter settled.
I sent an e-mail to the buyer of the Colt saying I will re-list the gun IF he sent me a letter saying that this is how we agree to handle things. I thought that I needed to "cover my rear" on that aspect....but I haven't heard from him.0 -

My .02, sounds to me like you're gonna get screwed outta a couple grand on this deal. IIRC, the pistol sold for over 3000.00, and now you'll be lucky to get 1000.00. Am I wrong, if I am somebody please let me know.0
