Burglar Sheldon Reece, 32, was shot in the abdomen by homeowner Abel Sisneros in Fort Worth, Texas, in December. According to a report in the Fort Worth Star-Telegram, to enter the house, Reece had to boldly disregard two signs outside: "Warning. Nothing inside is worth risking your life for. Owners of this property are highly skilled to protect life, liberty and property from criminal attacks" and "No trespassing. Violators will be shot. Survivors will be shot again." Under criminal law, it's also authorized to prevent theft or criminal mischief of your property-but only at night.
It's up to the property owner to explain his justification in these incidents, but down here it's pretty liberally interpreted when faced with an intruder in your home.
The bottom line is that it's a matter of how the story is told. A person's actions may be completely justified, but if they tell the story wrong they can end up screwed. This is why, no matter what state you're in, you always want an attorney present before you say anything following such incidents.
BTW-Speaking of signs, I remember seeing some interesting offical Ft. Worth PD signs posted in retail establishments. Right over the counter of my local McDonald's was a red lettered placard stating: "ATTENTION-These premises may be occupied by a police officer armed with a shotgun. If ordered to halt, please comply."[:0]0 -
