Trooper Unfairly Fired For Extramarital Sex Incidents
A judge says the state Highway Patrol was wrong to fire a state trooper for having extramarital sex with a woman in his car and at a district station because other troopers who did the same or worse remained on the force.
Monty Steven Poarch was fired in 2003. But evidence in the case showed that another trooper who also had an affair with the woman was suspended without pay for five days.
Administrative Law Judge Melissa Owens Lassiter's decision this week calls for Poarch to be reinstated with back pay.
The state Highway Patrol says it will appeal the decision.
Another administrative law judge and a Wake County Superior Court judge both ruled in the case that fired state employees who want their jobs back can see if agencies are consistent in applying discipline.
Poarch is now a lieutenant in the Caldwell County sheriff's department. His attorney, Michael McGuinness of Elizabethtown, said Poarch is grateful for the decision and wants his job back.

Was he on duty? If one has sex on the job, unless his/her job is having sex, should be fired. Same as stealing from the company/government. 0 -

Sex at the office and in your issued car (if it was his duty car) is plain wrong. If that is the case, he should have been fired and not reinstated.
If the other trooper just sexed her up, but not at the 103, or in his car, it is not a comparison.0 -
Been a lot of discussion concerning that case and a couple of others in the local paper. Far as I'm concerned, firing him was the right thing to do, reinstating him would be wrong. Working as a police officer after bing fired from a position such as that is wrong too. He needs to get into another line of work like maybe seling insurance or service manager down at Tire Kingdom. 0 -

from what i have seen when a trooper sees a couple having sex in their car they are arrested. he should be arrested too. 0 -
We had one about 13yrs or so ago take the option to resign or be fired because he took a female violator up on an offer at the end of his shift. Sure cost him, his badge, wife home and all he had. 0 -

Case law says that discipline of officers must be fair and equitable. You generally can't give one a verbal reprimand and another a 10 day suspension for the same offense.
That said, I have zero sympathy for an officer messing around on duty, or for anyone who commits adultery.
Like Txs, I too have encountered quite a few folk getting busy in cars, but have never arrested any of them unless they happened to have an outstanding warrant.0 -

In the PORAC magazine I get each month the are numerous cases listed about police officers being reinstated after being fired. When you read the facts you wonder how these cases got that far, and the political motives of some police cheifs or sheriffs. 0
