    Both the girl and Nifong need to be locked up. I can't beleive either are just getting away with this without being locked up for awhile.

    I don't feel bad for Nifong either. The system worked 100%, and worked 100% for the duke lacrosse players, if not 110%.

    Do you all know how often the prosecution plays games? Do you honestly think that the first thing that they do is say to the defense attorney "Here's every shred of evidence that we have in this case, and we invite you to contact us as well as the police and witnesses?" Of course not. As far as I'm concerned EVERY TIME that any prosecutor gives a press conference before a case is tried to completion, it is unethical.

    That being said, how many prosecting attorneys have you ever heard of being disbarred? I can't recall any. From personal experience, Nifong was par for the course, and he got what he deserved. The question is "why Nifong?" The answer is "Duke Money".

    My partner has a case now where the father has been accused of molesting the daughter, who is 17. Daughter complains now of something that allegedly happened 4-5 years ago. Claims that she went to the doctor when this happened.

    We ask for the records, that the prosecution has, and the prosecutor refuses to provide it. We then file a motion to compel the production of the same, and the Court says that we can get the records from the doctor. We issue a subpoena to the doctor, and doctor says she won't release the records without an authorization signed by the patient. We ask the prosecution to get the "victim" to sign an authorization, and prosectuion refuses. We file another motion to compel, and the Judge says we can show cause the doctor for failure to comply with subpoena. We do so, and she immediatley faxes all reocrds.

    Well, guess what? No mention of any molestatation, etc.

    So, we spent time and money (and we don't have the unlimited funds that the prosecutor has) and we found our exculpatory evidence. Now we know why the prosecution wasn't giving it up.

    Why bring this up? Becuase this is PAR FOR THE COURSE.

    None of this changes my initial post as to why I don't feel bad for the Dookies.

    I think you can count on the boys from Duke getting a few bucks for this one, and they should. I'm no advocate of wild lawsuits, but there were lots of folks out of line in this case and they were messing with people's lives and futures. Whether for better or worse, those young men will be associated with this for the rest of their lives and will never escape it. Ninety years old, and it will still be "The Boys from Duke". The people who caused that, or allowed it to happen, not only deserve to be, but should be, held responsible.

    I doubt that Nifong will be the one to provide the majority of the settlement since it is unlikely that he has the resources to settle even one claim, let alone the claims of all parties involved. It is a reasonable assumption that the local legal authorities and some form of bonding agency they have contracted with will be doing the heavy lifting in the final settlement of this case.

    If all there was available was what this clown owns, it wouldn't be worth the lawyer's fees needed to prosecute the case. I don't care what he has protected with a trust; it's not likely to contain enough to be worth spit.

    The millions already spent by both sides on this case will expand quite a bit before it is done, and if the charges raised are correct, those boys deserve every penny they can get from those people. I can assure you that if it had been my sons, I would have been close to ballistic if you didn't have more proof than we have seen so far, and I would have gone after them with every dime I had.

    I would have done it just to fry their ass for the pure entertainment value of it. You can call me "greedy" if you like, but this would have been pure and simple, unmitigated, vicious, revenge. It would not be kind, but it would have been for the jugular if my boys were on the line.

    I don't agree 100% on that statement, but it did work. I think the defendents might disagree, and I think it came very close to a complete failure and locking up three innocent kids.

    I don't think so. I think it was because this case became national news, Nifong knew it, and still played his games to assure his re-election rather than follow the law.

    I wish you had some sort of recourse with your state bar. Sound like you're dealing with Nifong Jr. to me.

    Sad. Do you feel sorry for your partners client? If so, why the double standard? I feel sorry for anyone falsely accused of anything, and don't understand why anyone wouldn't. A lie can ruin your life forever whether you the liar or the one being lied about.

    My understanding of the law is you can't present a known untruth to a jury on either side, yet defense attorneys will present evidence that someone else committed a crime when they know for a fact (their client told them) that their client is guilty. That is lower than whale crap, and that sits on the bottom of the ocean.

    Heff, I feel worse for Moop's client than the Duke boys. Her client has the misfortune of having a child with a lot of serious problems. It's his own kid.

    My whole point with the Duke kids, however, was that they made a decision to participate in something where a bad ending was certainly forseeable.

    I can agree with that statement, but it was a legal activity, be it immoral or not, to which they were charged with felonies and persued by a DA who knew they were most likely no guilty just to get votes in the upcoming election. One of the kids charged wasn't even at the event!

    I hope they learned a lesson about walking in a garbage dump makes you smell like trash, but they were innocent of the charges brought against them. I repeat, INNOCENT! Yet, they were ruined by a criminal prosecutor.

    Unethical is trying to get murderers, child rapists, etc "off" even when you know that they are guilty.

    For the life of me I do not understand why the original complainant isn't being charged with making a false report. She is being given a free ride, and the message it is sending is that it is OK to do this as long as it is against white men. Where were Jesse, Al, and the new Black Panther Party when Nifong was disbarred? They were quick to make a scene and pass judgment against the accused when the girl first complained, but now they are nowhere to be found. Al has done this before; his track record is to attack the white guy first no matter the facts. He has made a name or himself doing this; while the white media bows down to his ranting. No one is brave enough to call him what he is, a RACIST.
