Hunting property trespassing prob,..advice needed!
OK,...here is the deal. Some 8-9yrs ago, I am sitting in the deerstand and look off to my right and see a guy in a brand new salt treated ladder stand sitting maybe 75yds from me,...ON THE PROPERTY DIVIDING LINE/DRAINAGE DITCH!!! Now,...you and I both know that when he sat his stand to face BOTH his side AND my side,..that he isn't going to be waiting all day long for a nice deer to step across that ditch onto his side!!!! Soooo, we post that ditch for maybe 50yds to either side of his stand, and staple a few to his steps going up the stand,....NUFF SAID Right??? The stand was gone when we came back the next week.
skip fwd a few years, and as I am making a new travel route into the property, I use the small burm along that ditch to get quietly some 250yds deep into the woods. Low and behold,...I come across several small trees cut down and layed across the ditch to be used as a bridge.[:(!] I throw said bridge into the ditch,...only to find it replaced each time traveling the trail to my stand. I finally cut it into peices with the chainsaw.[:D] However, over the next few seasons I have to remove his marking tape from trees across a good 200yds of our property EVERY SEASON. He has now switched to coming across and using a climber stand.
skip to the present,...I am woorking on stands yesterday before it warms up and the ticks and chiggers get too bad. What do I see at the base of a tree on the other side of the ditch[?] his climber stand and this years new marking tape trail onto our property (we rent, don't own it). Soooooo,..I take down all the tape AGAIN,..as well as reflective markers for use in the dark. And as I get more and more pissed off,....I decide a stronger message is needed.
Now I have me a climber stand[}:)][:D] Question is,..what do you guys think?????? should I return his stand and not have a war in the woods??? (I am really not trying to have a whack job all pissed off about his being warned repeatedly through my actions, trying to kill me in the woods) Do I keep it and just see how it goes, or do I throw it back on his side and staple another set of no trespassing signs up,..AGAIN. Plus staple one to the seat of this stand???
how do you think this will go and what advice would you provide from your viewpoint. It just twists my nutz that people can't respect boundaries when we pay to rent this property every year, and spend a lot of time grooming the woods to foster good hunting.

justC.... no kidding if you really want him to go away... poop in his stand[:D]...but rember no deer will come close to this area so you have to draw them to another spot. how you do this is pick 1 and only 1 white or red oaktree that only you know where its at, and right now take a rod with you and poke several holes in the ground all around it. fill these holes with fertilizer and leave. in the fall your tree will have the sweetest acorns that every buck around will find and it will become their favorite spot. i have used this many moons in the vast woods of the ozarks and my seasons don't last very long. aint no use gettin in no trouble, just have to outsmart him. rember to poop before season andsave hair from barbers.. they'll save some if you ask,and scatter or hang in some old nylon stockings in his area that he stole[:D][:D] 0 -

If the guy hasnt got the idea after all these years then taking his stand is not going to stop him from hunting the land and if hes on his land then there is nothing you can do and if hes on your land get pictures of him and call the police.. and watch your butt 0 -
the watch my butt thing is the real reason for my inquiry. I am most certain I am a better shot,..but an ambush in the woods doesn't leave much room for accuracy advantage. I don't need nor want a war in the woods,..but this guy is just plain ignorant and brazen. I guess when I am in the woods next time,...I will see if I can backtrack his trail across the other property and hopefully it will run to one of the houses down the road. if so,..I'll simply tell the DNR officer to go have a chat with the inhabitants of said domicile,..as well as to have him say he confisctaed the stand. IF the guy is dumb enough to say that it was on his side,..he just admitted to being the offender,.....done deal. 0 -
Since you are gonna stalk him anyway, why don't you put a round a few feet away from him. Nothing like the supersonic "crack" to get your attention.
That happened to me once on opening day, and I was gone in a heartbeat, never went back there either.

woodshermit,..it's MD. The property behind us and on the other side is rented by a big club,....NEVER had a problem. They even waive as we go by their lodge. There is a small slice on my side that we don't know who owns. 0 -
Thanks. I live in a state (ME) and local area where all land is assumed by law to be open unless specifically posted and posting one's land is frowned upon and resented by the locals. I've never posted my land, but, do prohibit motorized vehicles on about a mile of woods roads to prevent damaging the roads and discourage littering.
It just seems curious that you and others who have responded to the thread seem to want to avoid contacting law enforcement for help with a resolution. Or, did I miss something?0 -
my reluctance is because I don't want a bunch of different guys walking around and setting up in my woods leaving all types of human scent and disturbing the area. That will run my large bucks off in search of alternative bedding areas. I may however have to let that happen this year to get it resolved for the future[V] 0 -
It sounds like you're not really looking for advice but a fight where you'll be on the wrong side of the law. You've been offended and are looking for satisfaction instead of enforcement of your contract with the lessor.
That you acknowledged, but put off enforcement of past trespasses will act in your disfavor when it comes down to cases.
I suggest you examine your real objectives in this matter. I see them as mutually exclusive. You can't have personal satisfaction outside the law without threatening your prime hunting site.0 -
by "people walking all around and setting up in my area" I WAS REFERRING TO THE DNR OFFICERS.
we will be posting every 50' as the law states. I will also try to backtrack his trail to find it's beginning. Once I have established it's origin, the DNR will be informed of where he goes in,..and how he gets to my property through the woods. then the trap will be set with an officer and maybe even a game camera. The LEGAL way....
his stand will be returned to his tree the next trip we make into the property, along with a "no trespassing" sign stapled to the seat. When he gets to his tree, he will be staring at a LOT of no trespassing signs up and down the property lines.0
