"No guns" a question about the mall shooting.

    You could try in a civil suit of course, but I doubt you would win.
    Private property is just that, whether we agree with the rules they set, or not,........and I don't, but that is the way it is.
    Just avoid those places, is really all you can do.
    I understand your point though, quite clearly.

    Don't like the policy, don't shop there.

    I disagree with their policy, but I also disagree with the policy of suing someone with money(regardless of how large their part in it) everytime something bad happens.

    I'd be interested to see a poll of people in the mall asking:
    "If you were allowed to carry a gun in the mall, would you have had one when this shooting occured?"

    If no one around the shooter would have had a gun anyway, their policy had no effect.

    VT had what, one student with a CCW?
    I doubt their policy on guns changed anything - If the state made it easier to get a CCW, and more students had them, then maybe the VT policy caused students deaths.
    Also worth considering... how many VT students didn't get a CCW because they knew they couldn't carry on campus, where they would be most of the time anyway.

    I'm unsure if these policies actually result in more people getting killed, given how most people now wouldnt carry a gun even if they could.

    But I do know and beleive its a right the government has no business interfering with.

    One might take the position, that the no guns signs applies that the mall is resposible for making sure no guns are on the property. One story states that the cameras clearly show that he entered the building hiding something in a sweater.

    That is an interesting point you raise. It probably could be argued that if a business goes to the trouble to post no concealed gun signs, and that is enough to stop the lawful CCW holders from carrying their firearms, then shouldn't the business also have a obligation to make sure that NO BODY carried an illegal gun inside?

    Also, it cannot be argued against that the safest place for a handgun is in the holster of the lawful carrier. No one has ever been killed by such a gun carried in such a manner. So it would so ironic if a lawful CCW holder secured his firearm in the trunk of his car, went into the store unarmed, and a car theif broke into that car, discoverd the firearm, and then on impluse went into that same store and held it up.

    In such a case it would be even more tragically ironic if the lawful CCW holder in that store was shot and killed by his own gun.

    While far fetched, there is no reason this could not actually happen.

    I ignore those signs. Indiana law prohibits me from carrying on school property, on any property being used for school functions, Gov't buildings, casino's, and controlled access airports. I will abide by the state law but couldn't give a rats butt about a sign on a mall's front door or any other door for that matter. It's called concealed for a reason.

    I work at a college, and while I can't speak for students, I know that quite a few of us who work here haven't bothered getting a CCP (Florida) simply because we can't carry to work, we can't have it in our car if we do, we can't have it on our person, etc.

    So maybe if the GFZs disappeared (courts, etc. could have a "check in" area, just like a coat check, only with little safes for pistols, etc) more people would get permits and carry....

    The answer to any legal question...

    Our jury system is adversarial based. Two advocates face off against each other explaining their position within the boundaries of law. Whoever convinced the jury that their position is correct wins the trial. There is really no such thing as an open and shut case.

    I was told that this is precisely why Walmart does not forbid CCW in their stores...evidently a few stores started this practice of forbidding CCWs and their lawyers advised them that they would in effect be accepting full responsibility for the saftey and welfare of their customers in the event that they were injured or killed in a robbery. As I understand it, the Corp. headquarters put a stop to forbidding CCWs in their stores.

    I have never understood why these businesses arn't sued..up to their eyeteeth.

    Luby's Cafeteria, 1991, 23 people killed. One woman who had a ccw but left her gun in her car due to the "no weapons" policy of Luby's, watched both her parents murdered while she could do nothing. And here we are still in the same situation.

    You and fideau are incorrect. That mass murder was done back when Texas did not even have a CCW law. The woman who became well known as the woman who had her firearm in her car, and witnessed her parents being killed without being able to help, went on to become a Texas legislator and lobbied for a CCW law that was passed. So the Killeen event had nothing to do with a "no firearms allowed" sign.

    You are right Tr. Sometimes memory works on one side of my brain only.She left her gun in the car because Texas law did not permit ccw at the time. That is true that she had a lot to do with getting one passed.

    Virginia is easy to get a ccw where im at it took 7 days. My uncle lives about a block from the shooting and he knows all the cops there they are not bright cops at all

    I understand that the mall in Nebrasks where the recent shooting took place did not even have armed guards. I also understand that in some states off-duty cops do not carry in such places (such as the incident in Utah within the past year). We as gun owners need to have a unified response to such merchants, letting them know that we refuse to conduct business with them because of their ridiculous policy. With copies to every business manager there. Instead of having to decide whether or not to blow off their rule, and carry anyway, we should refuse to darken their door.

    But how long would they be allowed to have signs saying 'No women allowed', 'Whites only' or 'No towelheads' posted at the entrance?
    Not allowing a law abiding citizen with a CCW into a retail store because someone doesn't like guns, is just another form of discrimination.

    I`m from Ne and you can bet there will be lawsuits. There is already talk in the newspapers about it. I hope that Mall goes broke paying off suits. They wouldn`t let honest citizens carry legally but let in a idiot. They didn`t even have armed guards there. There were a few black colored guards but, they hit the road as the first shot. Bet the National news media doesn`t publish that.

    There was no CCW in texas when this happened so there would have been no need for any "no concealed guns" sign on Luby's.
