switch blade question
When did switch blade knives become illegal? I remember in VA in the 1950s they were available. My father kept one in his fishing tackle box.

1957. However if you only have one hand or one arm you can legally own and use a switchblade knife. 0 -
get a spring assisted knife.they are leagle because the blad has to be opened manual 30% then the srring takes over. it is a good way to go. 0 -
If they're illegal, they sure do sell them in alot of places. You can buy one at nearly any gunshow around here. And I've seen them for sale all around the country.
I think it's not illegal to own one. But illegal to carry it.0 -
i couldn't care less whether it's legal or not. if i want one i'll get one. 0 -

Maybe where you live, but that is not a universal exception, so you should first verify, then qualify.
Here is the Texas law on the subject:
46.05. PROHIBITED WEAPONS. (a) A person commits an
offense if he intentionally or knowingly possesses, manufactures,
transports, repairs, or sells:
(1) an explosive weapon;
(2) a machine gun;
(3) a short-barrel firearm;
(4) a firearm silencer;
(5) a switchblade knife;
(6) knuckles;
(7) armor-piercing ammunition;
(8) a chemical dispensing device; or
(9) a zip gun.
(b) It is a defense to prosecution under this section that
the actor's conduct was incidental to the performance of official
duty by the armed forces or national guard, a governmental law
enforcement agency, or a correctional facility.
(c) It is a defense to prosecution under this section that
the actor's possession was pursuant to registration pursuant to the
National Firearms Act, as amended.
(d) It is an affirmative defense to prosecution under this
section that the actor's conduct:
(1) was incidental to dealing with a switchblade
knife, springblade knife, or short-barrel firearm solely as an
antique or curio; or
(2) was incidental to dealing with armor-piercing
ammunition solely for the purpose of making the ammunition
available to an organization, agency, or institution listed in
Subsection (b).
(e) An offense under this section is a felony of the third
degree unless it is committed under Subsection (a)(5) or (a)(6), in
which event, it is a Class A misdemeanor.
(f) It is a defense to prosecution under this section for
the possession of a chemical dispensing device that the actor is a
security officer and has received training on the use of the
chemical dispensing device by a training program that is:
(1) provided by the Commission on Law Enforcement
Officer Standards and Education; or
(2) approved for the purposes described by this
subsection by the Texas Private Security Board of the Department of
Public Safety.
(g) In Subsection (f), "security officer" means a
commissioned security officer as defined by Section 1702.002,
Occupations Code, or a noncommissioned security officer registered
under Section 1702.221, Occupations Code.0 -

State law may overide Federal law, but Federal Regulations 5 USC 1244 states in part - The possession and transportation upon his or her person of a switchblade knife or a blade 3 inches or less is authorized to any handicapped individual who has the use of only one arm. 0 -

Would it not be much easier for everybody,and especially the poor visitors to your country...If the same laws applied to all states ? 0 -

Might be easier for vistors from countries where there is only federal law, but the United States is just that: A republic of 50 sovreign states. We have perverted and diluted our Constitution to and have given the federal government way too much un-Constitutional authority, but we are still 50 states.0 -
The laws regarding automatic knives are largely ignored around here (Kansas). I've carried one for 20 years. In my younger years a cop even asked me to empty my pockets one time. He looked at my automatic knife and then gave it back to me. 0 -

The reason is for this attitude is that they're antiquated statutes. At one time, switchblades were the common weapon for street gangs, but long gone are the days when the Sharks and Jets met for rumbles in the back alleys with them. The only times I've actually charged people with having one is when they needed to go to jail.
I carry a smallish Benchmade automatic knife as an ambidextrous tool, not a weapon. I began carrying one after being in a situation where I was up high, hanging on to someone with one hand and needed to cut them free of a binding around their neck. I couldn't reach my folder with my free hand and even if I'd been able to get it out I couldn't have opened it. Bad times there. I now carry an auto-knife in a centered position.0 -
Gee, Talented, I'm certainly sorry that American laws don't please you. But then, they don't please the criminal mexicans either, and the laws don't slow them down.
Just give me a list of the Federal or State laws in America that you would like to change, and I'll see that it happens.
Please hold your breath while waiting.

That's not how I read the law. In Virginia a switchblade is illegal to own, definitely illegal to carry unless you are LEO or authorized Govt. type.
mowart,
Since you are a Virginian this is the state code from the Va. State police website that pertains. Look at FAQ about guns, knives, etc.

You talking about the day-glo orange handled MC-1, made by Schrade and Camillus? I don't know about riggers, but these were in aircrew survival kits for many years.
I've been told they still issue one of the same style, only it uses a coil spring instead of a leaf.0
