FFL/ Transfer of Pistol
Hello All,
I am having a pistol transfered from one state to my own. Neither myself or the other party are FFL holders.
As my old FFl dealer just passed away,( God rest his soul), my NEW FFL dealer says he wants $30 just to recieve it and it MUST come from a FFL dealer, (new federal law???).
The other parties FFL wants $50 to do the transfer and he wants $25 for his shipping and handleing!
This is over $100 just to get this pistol over a State line!
I thought Mr. Lincoln striped us of our States Rights 142 years ago!
No thats right, he gave us Federal Income Tax and Big Goverment.
Anyway, Can someone tell me the true law here? Also, do they HAVE to ship it "Over-night"?

It has to be shipped to an FFL and some FFL's will not accept shipments from non-FFLS, I don't know why. A non-licensee has to ship a handgun through either Fedex or UPS and both are expensive and they usually have to go overnight.
Quick answer...You cannot legally ship a handgun to another person in another state without going through an FFL at least on the receiving end.0 -
...Find a new FFL, there is no new Federal law, that's the "law" of your FFL, not his interpretation just HIS rules. Transfers usually run $30-55 bucks most everywhere.
...An 01 FFL can ship handguns via USPS, cheaper and the best way IMO. As an unlicensed shipper as Bondai said, you must use UPS or another carrier, luck...[;)]

Everything is changing world wide. Violence is up in South Africa and you can't protect yourself. I am going back to South Africa and I can't take a revolver pistol, last time I had a permit and law enforcement looked at it and said I could wear it in an outside holster as long as it wasn't concealed, now if you bring a pistol it has to have a long barrel be a single shot and have a scope, you can't wear it in a holster in town only out in the bush hunting. 0 -

GB has the ablility to find an FFL in your area. What they will charge and there policy on who they nwill allow to ship to them. Use the GB service and find another FFL my 2 cents 0 -
Go to the GB homepage and under nuyer's tutorial there's a link to find a local FFL.
The law allows a non-licensee to ship to an FFL but many dealers won't do it.
Shipping of guns has always been a major pain for me and even when it works it's not cheap.0 -

Call some of these guys you might find them a little more reasonable. No your dealer does not have to refuse shipments from a non FFL dealer but some do. The sender has to verify that it is going to an FFL holder but all the reciever has to do is enter it in his books just like the person walked in and sold it to him face to face. as long as he has a name and address for his records he is legal. Some just don;t know and or don't care to learn the laws and regulations.

No, it is not illegal or even unlawful but if the buyer fails to get immediate approval on the NICS check the FFL would have to make two trips.0 -

everything I have always read stated a dealer must do business at his licensed premises only, the exception being an "approved" gun show... has that changed recently?0 -

actually, you are 100% wrong... August 2005 ATF FFL newsletter states the following:
"FFL's are required to conduct business from their licensed premises. Licensees may not sell firearms from other than their licensed premises, with the exception of gun shows or other events dedicated to sporting use of firearms and held in the state where the FFL's premises are located..."

It is still legal in Colorado to sell firearms face to face, without an FFL. Unless your at a gun show, or selling FA machine guns etc.

Yes I have been to Jensens, they are the place that requires an FFL on in coming pistols and claims its a law. They have a very nice place, but i have often had to wait for a long time while that tend to the needs of every Police Officer in the place, and then only after they all have left, will I get a short brief answer to my question/customer service. Every time I have been in there I have been made to feel like a 2nd class customer. I guess gone are the days of the old corner gun shop.
You know the one, it always had a barrel in the corner with a bunch of old barrels and bayonets in it.

Yup, Every since there move, Jensen seems to be getting farther and farther away from the little guy. I had heard that they started "making up" their own laws. They can do what they want, it's their place. They are just driving away the old (and some new) customers.
I still like their new place better than the old one. Not as crowded.
Some places require a firearm to come from an FFL, but it is NOT the law. I have NEVER seen a private citizen, that wanted to sell/pawn a firearm, turned away from a gunshop, or pawn shop because he didn't have an FFL.
NO ONE, would be able to sell or pawn a gun to a dealer, if that was the law.
DUHhhhhhhhh. Why do they "say" it's the law???
Some do it to cover their backside, others because they are pissed that you didn't buy the gun from them, and they want to make it as hard as possible for you. They can charge what they want for transfers, that is why some charge $10, others 10% of the cost of the gun. A $1,000 gun will cost you an additional $100 through those guys, and that doesn't include shipping.
If it isn't too late, I hope you can find someone to work with through wipala's list. I'm not familiar with anyone up that direction. If you haven't made a commitment yet, shoot me an email, I "may" be able to point you to some help.0 -
Thank you Pickenup, and everyone for all the help and advice. This is a done deal now, but i will be looking for another FFL next time. I collect the Va. Dragoons from Interarms and put an add on the WTB list. A Gentlemen answered and gave me a fair price, its not his fault our FFL dealers are just out to get what they can. I gave my word and I'll stick to it......even if it costs me and extra $50!!!

I can tell you that in NY any handgun that comes in the shop from out of state MUST come from an FFL .. your state laws vary on these regulations. Id be damn sure you knwo what they are .. In our business its not worth to do something your not sure of whether its ok or not .. We call our County Pistol Clerk to find out various laws and etc and get a different answer every time .. 0 -

Thank you very much for your help! I am going to change over to Loveland Pawn and save myself $5 on the transfer cost. But all the dealers on this list, still say it is a Federal Law that an out of state pistol must come from a FFL holder and include a copy of that FFL.
Another question.... Lets say I want to send a pistol to a non-FFL holder,( out of state), for repairs and/ or custome work, and he is sending it right back to me after work is completed. Most this go thru an FFL?

The only way to answer this, is by quoting the BATF. Notice the first rule. (I-1)
I. GUNSMITHS
(I1) Is a license needed to engage in the business of engraving, customizing, refinishing or repairing firearms?
Yes. A person conducting such activities as a business is considered to be a gunsmith within the definition of a dealer.

(I2) Does a gunsmith need to enter in a permanent "bound book" record every firearm received for adjustment or repair?
If a firearm is brought in for repairs and the owner waits while it is being repaired or if the gunsmith is able to return the firearm to the owner during the same business day, it is not necessary to list the firearm in the "bound book" as an "acquisition." If the gunsmith has possession of the firearm from one business day to another or longer, the firearm must be recorded as an "acquisition" and a "disposition" in the permanent "bound book" record.
(I3) Is an ATF Form 4473 required when a gunsmith returns a repaired firearm?
No, provided the firearm is returned to the person from whom it was received.

(I7) Is a licensed gunsmith's return of repaired or customized firearms to their owners subject to the Brady law, including the provision for making background checks on transferees?
No, but it is unlawful to transfer a firearm to any person knowing or having reasonable cause to believe that such person is a felon or is within any other category of person prohibited from receiving or possessing firearms. (See also Question P24.)
